Ok, let's say for a second that he can't comment on an ongoing investigation.... then the way you get the ball rolling is you meet with congress, you meet with the attorney general, you lay out your case of why you think you were wiretapped, you build your case just to see if you have a case... then, if there is deemed to be something there, then you issue a press statement that an investigation has been started. He does have to lay out a case. He has to state where that information came from, determine it's credibility, etc before they should ever launch an investigation.
