Sessions invokes 'Anglo-American heritage' of sheriff's office

By Maegan Vazquez, CNN
Updated 3:08 PM ET, Mon February 12, 2018

Washington (CNN)Attorney General Jeff Sessions on Monday brought up sheriffs' "Anglo-American heritage" during remarks to law enforcement officials in Washington.

"I want to thank every sheriff in America. Since our founding, the independently elected sheriff has been the people's protector, who keeps law enforcement close to and accountable to people through the elected process," Sessions said in remarks at the National Sheriffs Association winter meeting, adding, "The office of sheriff is a critical part of the Anglo-American heritage of law enforcement."

"We must never erode this historic office," Sessions continued.

Invoking "Anglo-American heritage" seems to have been an impromptu decision by the attorney general. A written version of the remarks says that Sessions was supposed to say: "The sheriff is a critical part of our legal heritage."

Ian Prior, a spokesperson for the DOJ, said in a statement that the term "Anglo-American law" is common parlance among lawyers and legal scholars, pointing to a number of opinions from the US Supreme Court.

"As most law students learn in the first week of their first year, Anglo-American law -- also known as the common law -- is a shared legal heritage between England and America. The sheriff is unique to that shared legal heritage. Before reporters sloppily imply nefarious meaning behind the term, we would suggest that they read any number of the Supreme Court opinions that use the term. Or they could simply put 'Anglo-American law' into Google," Prior said.

Principal Deputy Assistant Attorney General Bill Baer used the term in a speech in 2016.

The concept of the office of sheriff -- being an independent, elected law enforcement entity -- originates in Anglo-Saxon England. The word "sheriff" combines the Anglo-Saxon words "shire," meaning "county," and "reeve," meaning "guardian," Cato analyst David Kopel notes in The Washington Post.

He's not wrong. Most police forces sprung from slave patrols in the south or Indian Constables in the north and west. Probably not a good thing to brag about.

What part of our nation? New York, Florida and the entire west was founded by others. In fact, New Amsterdam was the first colony in America to have a sheriff.

I found that here

A website so blue, they're pro-Arpaio. Also interesting fact: Ohio was the first State to call for elected Sheriffs.

The first 3 organized police forces in the country, according to the internet, were in Boston, New York City, and Albany.. Your notion that the heavily populated northeast didn't have police forces before the south and the west is just idiotic.

Very nice of CNN to tack this bit on the end showing that he is actually being factually correct in noting that the SHERIFFS office, to which he was speaking, was started and grown in England before coming here..

I put it into google as they said, and you wow, the results

Quote:
Alternative Title: Anglo-American law
Common law, also called Anglo-American law, the body of customary law, based upon judicial decisions and embodied in reports of decided cases, that has been administered by the common-law courts of England since the Middle Ages. From it has evolved the type of legal system now found also in the United States and in most of the member states of the Commonwealth (formerly the British Commonwealth of Nations). In this sense common law stands in contrast to the legal system derived from civil law, now widespread in continental Europe and elsewhere. In another, narrower, sense, common law is contrasted to the rules applied in English and American courts of equity and also to statute law. A standing expository difficulty is that, whereas the United Kingdom is a unitary state in international law, it comprises three major (and other minor) legal systems, those of England and Wales, Scotland, and Northern Ireland. Historically, the common-law system in England (applied to Wales since 1536) has directly influenced that in Ireland but only partially influenced the distinct legal system in Scotland, which is therefore, except as regards international matters, not covered in this article. The legal systems in the United Kingdom have, since 1973, experienced integration into the system of European Union law, which has direct effects upon the domestic law of its constituent states—the majority of which have domestic systems that have been influenced by the civil-law tradition and that cultivate a more purposive technique of legislative interpretation than has been customary in the English common law. The regime of human rights represented by the European Convention on Human Rights (1950) has exercised a similar influence in the United Kingdom since the passage by Parliament of the Human Rights Act 1998.

Seems like a non story to post about. . . . .

I understand the terminology. I just thought that Jeff Sessions, who has often been accused of being racist, would choose to use those words when they were not part of his scripted speech.

BUT the scary part is the backlash. I do not want to see Sessions step down or be replaced because that would give Trump a way to fire Mueller.

North = Northeast... Should've been more clear about that, but with the original colonies+ you can only go north, south or west. It was not my intention to say that the north east didn't have police departments, especially as my second post says that the first Sheriff in the US originated out of New Amsterdam (Modern day Manhattan).

You know that sheriffs are not part of common law, right? In fact, they're pretty much the opposite. On one hand you have an informal system of rules and laws that assume legality over time. On the other you have an appointed/elected law enforcement officer who is supposed to enforce laws.

While Sheriffs have their roots in England and could be described as Anglo-American, they are not part of common law. Please do not conflate the issues.

Ahh, in case you hadn't notice, this country was run by American Indians before any Anglo showed his/her face here.

Jeff Sessions is a racist... no question, he's got a long long history of it.

This is just another brick in the wall for him. Honestly, he doesn't understand who he offends. It's like, if you aren't white and southern, he just doesn't care if you live or die.

But that's part of being the AG under Trump....Another Bigot

LOL,,, I won't until you stop eating what Trump and his Croonies are shoveling into you.

I'm not a racist,...

Yes and the Anglos stole everything from Natives..

HA HA,, ON the tax cuts... Have you watched your feckless Leader's actions lately. He's calling for almost 7 Trillion in spending.. He's taking away from the those that have the least.

But more important, did you see his Infrastructure deal, all he's doing is throwing all the costs back to the states... But when it comes to a states decision to either be a Sanctuary State, or for it to decide if it wants Medical Marijuana, he and his racist AG want to punish them for it.

You know, my info doesn't come from the talking heads in the media. I hear or read something, then do research. You, like Trump, hear it on FOX or Brietbart or InfoWars or Jeff Christi, AKA Rush Limbaugh and automatically think it's real

You have no room to tell me not to drink the kool aid.. I'd rather do that, then eat the poop that you are eating.

again, its funny that he would say something like this with emphasis during black history month, and during a time when cop/minority relations has been at its worst since the civil rights movement.

but is anybody surprised? combine this with his support for the war on drugs, as well as the support of private prisons...BOTH of which seems to affect minorities the most in this country, and this would actually be expected from the likes of Sessions.

DC thinks is a giant leap, but to us non white dudes and a lot of other white americans who actually see it for what it is, its EXACTLY whats going on.
