I'm sure we can take certain points of that list and make decent arguments about it being heavy-handed, but I just see both sides of that negotiation sitting down at the table and both saying to each other, "last year sucked, let's not do that again". Makes sense to me, and I doubt there will be many players that will subject themselves to the left-side column.
