ABC News has learned that Geoffrey Berman, the U.S. Attorney for the Southern District of New York, is recused from the Michael Cohen investigation.
Two sources familiar with the matter tell ABC News Berman was not involved in the decision to raid Cohen's office because of the recusal.
The recusal was approved by Deputy Attorney General Rod Rosenstein.
The raid of Cohen's handled by others in the office of the U.S. Attorney for the Southern District of New York and approved by a federal judge.
Berman is a Trump appointee with ties to Rudy Giuliani who donated money to the 2016 Trump campaign.
The U.S. Attorney's office declined to comment.

a couple things... This was through the Southern District of New York, so the following is true; This investigation into the raid yesterday will not stop if Mueller is fired and any charges to Cohen or anyone else from this raid would not be able to be pardoned because they are from New York.

well, it could be perilous and could end up with something completely unrelated to what the search is. If investigators in the process of executing a lawful warrant find evidence of other crimes, that evidence is admissible. It would probably have to start another investigation, as the taint team will only send to the prosecution evidence of cohen and trump working together.

But Rosenstein is a Republican. James Comey was a Republican. Robert Mueller is a Republican. Mueller was appointed by Rosenstein.
And let's not allow ourselves to suffer a case of temporary amnesia: when RR appointed Mueller to replace the fired Comey, he was hailed by both party's bosses as a peerless, unimpeachable operative; the consummate no-nonsense professional. Now, apparently only one side still feels that way, and it's not too difficult to see who changed and why. That's not Mueller's fault either. Or Mueller's boss, for that matter.

And it may also be true that you personally are tired of this, but Robert Mueller is not. And neither am I. And neither are millions of other American patriots who want to know the extent to which Russia f'd with us. If 45* has zero culpability, he has nothing to worry about. After all, he says there was no collusion. Fine. Mueller's after the truth about Russians. 45* should be just peachy.
We both know what a constitutional crisis Mueller's firing would kick off. Even ranking R's on CapHill are constantly warning him what a suicide move that is.
I think there's a very real possibility that he'll do this incredibly impulsive and risky thing. He's wanted to do it all along (because he doesn't know anything else), and he's been pushing away all the folks who were advising against it. And if he does, it will kick off a s#storm that will make the last 18 months look like nap time at ABC Daycare center.

Lawyer Alan Dershowitz spent time at the White House on Tuesday after heavily criticizing the FBI's decision to seize documents from the office of Trump's personal lawyer Michael Cohen.
"Some news - Dershowitz has been at the White House for part of today as Trump seeks his input, and he’s supposed to have dinner with the president tonight, per WH sources," New York Times reporter Maggie Haberman said on Twitter Tuesday.
The FBI raided Cohen's office on Monday, seizing emails and records related to the $130,000 payment made to adult-film star Stormy Daniels in exchange for her silence on her alleged affair with Trump more than a decade ago. During an appearance on Fox News, Dershowitz reacted to the raid, calling the act it a "dangerous day" for "lawyer-client relations."
"If this were Hillary Clinton [having her lawyer's office raided], the ACLU would be on every TV station in America jumping up and down," he said. "The deafening silence of the ACLU and civil libertarians about the intrusion into the lawyer-client confidentiality is really appalling." Dershowitz, a Harvard law professor emeritus, has also been a vocal critic of Robert Mueller's investigation into the Trump campaign.
