I agree, it's why we make sure to collect I9 forms and ensure that the proper documentation is collected. In the case of mass fraud where ICE busts a company full of hundreds of illegals? I think the company should be investigated and hopefully charged with wrongdoing. The specific reason I threw the racial profiling comment down was on the content of teetubs post, specifically his "red flag" a non-english speaking guy named John Budd who looks hispanic should be a red flag That's textbook racial profiling. If you disagree I'd like to know why.

The name John Budd and being a non English, Hispanic person is possible but highly unlikely. 2+2 isn't 7. It's an obvious red flag.
Now you can call that racist if you wish but it looks a lot like common sense to me.

It's not as I wish, it's as the 1972 Equal Employment Opportunity Act demands. If you were to disqualify hiring someone because you thought that their name and race did not ADD UP as you claim, and they were in fact eligible, that's an easy open and shut discrimination case.
Common sense is a horrible argument to use in defense of racial profiling. Albert Einstein said "Common sense is the collection of prejudices acquired by age eighteen." It is a logical fallacy to say something is right because "it's common sense."

Common sense allows you to call someone and report something you consider suspicious. And not hiring someone because you feel they're being dishonest in their application or interview process? Never heard of such a thing. Once again, it's all in how you interpret it.

Common sense as I'm sure you are aware, has suprisingly little value in a court of law, for better or ill  I can totally understand the desire to deal with something that may seem obvious. But employment law is rife with potential landmines if you aren't careful. I've had to educate my team overseas on some of the pitfalls, because the law isn't the same in Europe as it is in the US.

I would feel very uneasy if I had a lawsuit thrown my way, and my justification for not hiring John Budd was on suspicions he was here illegally and it was based on his specific situation. There's a fair bit of case law available that finds for the plaintiff in race based discrimination. Even if my justifications were later found to be TRUE it's possible I could be judged against because it shows a pattern of discrimination. The only safe forms of due diligence are ones that you apply to all candidates. In this case if I required every applicant to submit to a background check, work eligibility check, etc, that would be different. But that still means I cannot treat this person in question any differently than any other job candidate because of their race or name. All I can do is pass the information along and wait to see what comes back.

How would you feel about a civil lawsuit by a victim's family asserting wrongful death on the behalf of an employer who looked the other way on an employee's questionable identity with the idea that had the employer not provided opportunity to a person who had no legal status to be in the community where a murder happened, then the murder would most likely never happened.....which lawsuit do you fear the most? Which one will cause you to lose sleep at night? Which one do you want weighing on you mind in your dying days?

You can find lots of reasons not to hire someone. If you feel they are not being honest, you don't have to hire them.
In a court you have to prove discrimination. Loosely based insinuations aren't enough.
There are lots of reasons not to hire someone, and indeed concerns over honesty is one. It's one I had to address before in my professional life. And maybe this is the eggnog talking , but your last sentence seems to imply it only matters what is provable in court? Is guiliani providing you legal counsel? In seriousness, while I am aware you can definitely fake your intentions in a courtroom, that makes it sound like you're OK with discrimination as long as people don't get caught doing it. To do so ignores the long history of why we have AD laws to begin with.

If an applicant tells me their name is John Budd and they can't speak a word of English, I question their honesty.

I'll suggest you consult legal counsel the next time you hire. I have gone through the whole song and dance with legal as well as HR, and everything you've posted in this thread is dangerous language to use when reasoning why you would not hire someone. The most dangerous aspect is that you are disqualifying someone on a basis that does not apply to the job, and also does not uniformly apply to all candidates. You would claim the candidate is disqualified because you don't think they are being honest. And you base that dishonesty on their name and language barrier. Additionally, you could expose the business to defamation of character. If instead you you disqualified on the basis of not speaking english, and english was a job requirement, you'd be fine. See how that works? If you still disagree, that is your right. And if you do, then someone with your views, who is also in charge of hiring, is the reason Employment Practice Liability Insurance exists

The second best is that in college he ran for student council but got booed off the stage after saying that he should be able to throw his garbage on the floor because “that’s why we pay janitors”.
