Get ready for high times on the highway.

As New York moves toward legalizing recreational marijuana, the instances of motorists driving while stoned is likely to surge, if the past experience of weed-legal states is any indicator.

In Colorado, where pot sales began in 2014, 69 percent of pot users said they had driven while high at least once in the past year and 27 percent said they drove stoned almost daily, according to preliminary survey results released by that state’s transportation department in April.

The number of fatal car accidents in Colorado increased by 40 percent from 2013 to 2015.

And drivers in fatal accidents testing positive for pot rose by 145 percent from 2013 to 2016, according to a 2017 Denver Post analysis.


The level of THC, the psychoactive ingredient in marijuana, in one deceased driver was a staggering 68 nanograms per milliliter. The legal limit in Colorado is 5.

And as more motorists got stoned, there was no parallel plunge in drivers getting drunk. In fact, drivers who tested positive for alcohol in fatal crashes rose 17 percent from 2013 to 2015, the newspaper reported.

Mixed findings on Colorado marijuana, traffic deaths

The number of highway deaths involving Colorado drivers who had marijuana in their system grew again in 2017, a new state study shows.

At the same time, traffic fatalities in which drivers had enough marijuana in their bloodstream to be deemed legally impaired dropped sharply, from 52 in 2016 to 35 last year.

The reason for this seeming contradiction: Marijuana can remain in the bloodstream for weeks, so a positive blood test may not mean a driver was stoned at the time of a deadly crash.


As the Colorado Department of Transportation study notes, “The presence of a cannabinoid does not necessarily indicate recent use of marijuana or impairment.”

Overall, the number of fatalities involving positive tests for marijuana has nearly doubled since recreational legalization in 2014, from 75 that year to 125 in 2016 and 139 last year.

Colorado law specifies that drivers with five nanograms of active tetrahydrocannabinol (THC) in a milliliter of their blood can be prosecuted for driving under the influence of marijuana.

A striking finding in the new study was the death toll involving people driving around with a cocktail of drugs in their bodies. In one year, deaths where drivers tested positive for cannabis, any alcohol and other drugs tripled — from eight in 2016 to 25 last year.

The report also found that drunken driving deaths had increased again. Twenty-six percent of those killed in crashes, or 171 people, had blood alcohol content of 0.08 percent or greater, Colorado’s drunken driving limit, compared to 161 in 2016 and 151 in 2015.

Meanwhile, traffic deaths generally continued to increase on state roads, going from 546 in 2015 to 608 in 2016 and spiking to 648 last year.

CDOT spokesman Sam Cole said the department considers the number of deaths in which the driver was marijuana-impaired under state law to be the most reliable indicator of its impact on the highways.

By that measure, marijuana-related deaths are clearly down.

“Presence does not indicate impairment,” he said. At the same time, “two years does not make a trend.”


Kristi Kelly, executive director of the Marijuana Industry Group, welcomed the state finding that marijuana-impaired highway deaths declined last year.

She added that the industry intends to keep campaigning against smoking and driving.

“We don’t think our job is done,” she said.

Henny Lasley heads Smart Colorado, a group concerned about the effects of legalization on children.

She worries that the latest highway death statistics will be used to loosen state regulations and promote public consumption of marijuana products.

First, “The science of impairment is lacking,” she said.

“More concerning is why people are combining” marijuana, alcohol and other drugs, she said. “The combination is very concerning.”

Cole agrees.

Before fatal drug-related crashes, “drivers do tend to combine,” he said. “When you combine, it will amplify your impairment.”




Because THC stays in a human's system for upwards of a week, it's going to be really hard to draw direct conclusions from any statistics in the short term.

I mean people have the right to kill themselves as long as they aren't killing anyone else, right?

The thing I worry about is the government deciding what's healthy and not healthy for me and controlling what I can eat.

And I do have to wonder how many of those "marijuana related fatalities" were people that would have been drunk had pot not been legal?

Here's one thing I can tell you. I used to smoke so much weed it took three months to get it out of my system. That 68 nanograms per milliliter they stated? My levels were higher than that after not smoking for an entire month. That has zero to do with being high on weed.

You should know how this works Diam. We both used to drink a lot. Would you have been drunk after having three beers in an hour? According to the law you would have.

This sin't about whether you're actually high or not. It's an arbitrary number used for a cash grab. Just like .08 is with alcohol.

A slower driver, yes. But that’s name the same as better or even average. Smoking while driving is dangerous and that’s why there are laws against it.

So I don’t understand what the point of the thread was. Unless this was yet another useless attempt at trashing people just because they didn’t choose the same vice as you did.

I'm more than fine with getting rid of alcohol, cigarettes, and ENFORCING the federal laws on illegal drugs like pot.

I've lost family and friends to all three. As in death caused by using them. They are not safe. FDA would ban any food stuff that does half the negative effects that these things have. But God forbid the government lose their income from the sin and dummy taxes. Not to mention the lobbyist who put profit above the health and well being of Americans too stupid to put their health first.

Bro .. when i was in the service ... now this was back when drug testing first came out ... one of my buds who smoked weed daily was toking up when they came to get him to go take a random drug test ... he passed it ... *LOL* ... i’m Sure technology has improved immensly but after witnessing that ... i’m still skeptical ... *L* ...

Dang ... that’d suck to get a driving while stoned ticket if u hadn’t toked in a day ... that’d sure be a bummer ...

We agree. The more we allow the government to control, the more and more they will control other things as well.

I always found it weird, that you cannot overdose on weed and its illegal, but advil is perfectly legal. Take 15 of those things and it will be the your last headache, I guarantee it.

I almost got hurt/killed because the guy in front of me was driving 25 on the freeway, this past week, and all I could think of was, that guy must be high,
other than, I can't find the 4 way flasher button, were going to get killed from behind, hope we don't get hit, how do I get away from this bad driver trying to get people killed on the highway.

so dangerous, so stupid, why do people want to legalize this stuff when anybody who wants that crap already has it anyway.

Who drives 25mph on the freeway and doesn't pull over.

Not really. I use it every night so I can sleep. If it shows up in a test the next day when I'm driving thats still bullcrap that I should get a ticket for it.

Tell me who didn't see this coming... Anytime you impair your motor skills, things happen. Drugs (legal or not), Booze, Blood sugar drops (i'm diabetic and it happens)

And that's what happens. Back in the day I could have quit for over a week and still failed that test. Probably even longer.

Just like I brought up about the three beers. When we both drank a lot more, we wouldn't have even noticed three beers in our system. But that would put us above .08 and a DUI conviction. The standard road side sobriety test tells if your reactions are impaired or not.

But pass one of those and see what happens. More likely than not they'll pop a breathalizer on you anyway. I know because it happened to me many years ago. I was just under the limit, but if I passed the first test, why bother giving it to me if it didn't mean anything?

It's just a money racket. They don't care if you are sober, as long as their test can rake in the money. Don't get me wrong here. I'm all for getting impaired drivers off the road. What I'm not for is ruining the reputation of people who actually aren't impaired at all.
