sounds like racism is involved.

CCW is not a license to shoot! pulling a weapon and yelling to stop might fix things.

We don't have real justice,

The internet censored my real thoughts on capital punishment of for sure cases where the victim was minding their own business,
it should be swift and public.

It's a tough call. By all accounts, Jones, the pregnant woman instigated the fight. That seems to be clear.

Had it been the other way around and Jemison, the woman who fired the shot, started the fight, shot and killed the fetus, she would have been charged with attempted murder, and murder. That is clear as well.

In either case, a child/fetus was killed. The way the DA sees it, you can't have it one way and not the other, and I agree with that for the most part. I don't think the DA out of bounds in pressing charges. I don't think it out of bounds had they not.

Interesting case. We'll see how the jury feels. Sometimes law doesn't have all the answers. That is why we have juries. If it did, we would simply have bench trials and the judge would rule on the law and render verdict.

No one has questioned why in the hell a mother who is five months pregnant would start a fight w/another woman? And she was so threatening that the other woman was justified in shooting her.

This is more the part of your post I was addressing. Stand your ground laws only require you "felt threatened". It's a very low bar that exists in some states that sets a very low standard of excusing shooting someone.

I'm not sure of the actual details here, so I can't say for sure. But what I will say is some of the stand your ground laws in America create a situation where a lot of people can be shot and killed with very little provocation.



While I don't uphold the man pushing the shooter, there certainly was no excuse to kill him over it. It amazes me how little it takes to be sentenced to death by a fellow citizen these days.

It's cases like this that push the law to it bounds. Laws get changed all the time as the need presents. Lawmakers can't imagine every possible scenario that will put pressure on the borders of the written law.

That is why there are appellate courts, and state and federal supreme courts to try to sort it out.

It's not that simple for me. I am not arguing so much about this particular law, but I don't see the mother as a victim.

She was pregnant. I know you don't have kids, but here is how it works for most folks. Woman gets pregnant and the number one goal is to do everything you can to give birth to a healthy baby.

If you smoke, you stop.

If you drink, you stop.

If you do drugs, you stop.

You eat healthy. You make sure you don't lift a lot of weight. You don't overexert yourself. You may even do things like listen to classical music while learning how to relax your entire body.

Why do you do those things? Because the baby's health is the number one thing. They are more important than you are.

So, I find it hard to feel that this particular mother who so aggressively attacked another woman that it resulted in a justified shooting is a victim. She should have never put herself in that situation given the fact that she was pregnant.

I'm sorry, but I can't think of a justifiable reason for a mother to put her baby in such a situation. Even if the woman didn't have a gun, do you really think that getting into a physical altercation w/someone while you are pregnant is justifiable.

I'm guessing the mother is a piece of trash.

I think this whole debate is set up to determine whether a 5th month fetus is a human being. Finding this woman guilty/not guilty of manslaughter will set a hell of a precedent for the looming abortion battles.

While it's far from settled law, this debate already has some precedent... people have been charged and convicted of murder/manslaughter for killing a pregnant woman's baby. In that respect, some courts have already ruled that the unborn baby has rights..

This is just the first case I can remember where the pregnant mother was at fault for starting the incident that led to the death of the unborn baby and is being charged the same way.

Now, with that said, it is going to create a serious precedent... what if the woman is in a car accident that is her fault and the baby dies? Vehicular manslaughter? What if the woman is on drugs and the baby dies? Manslaughter?

This is certainly going to be interesting...

First, The pregnant woman committed felony criminal assault. She must have, in order for the shooting to be ruled justifiable self-defense. She caused the situation which resulted in the death of her child.

Knee-jerk, emotional reactions made with no knowledge of the situation or the law are something you are certainly entitled to, but which serve no useful purpose.

What might be useful would be to examine WHY the pregnant woman endangered her child, and it is much, much more than just that she is a stupid twit. That is almost certainly true, but it is not the only or even primary reason.

Examine Swish's guess at the cause of the argument, and the circumstances around it that may very well be true. Then ask why it is that these conditions are most likely the case, or easily believable, and you will start along the path which leads you to the real problem.

The answer is not "racism, racism, racism!", but the thought process that produces such an answer most definitely is.
