Former FBI informant charged with lying about the Bidens’ role in Ukraine business, undercutting GOP impeachment inquiry
Special counsel David Weiss charged a former FBI informant with lying about President Joe Biden and his son Hunter Biden’s involvement in business dealings with Ukrainian energy company Burisma Holdings, undercutting a major aspect of Republicans’ impeachment inquiry into the president.
Alexander Smirnov, 43, is facing charges in connection with lying to the FBI and creating false records. He was arrested Thursday at Harry Reid International Airport in Las Vegas, after his arrival in the US from overseas, and will make his initial appearance in federal court Thursday afternoon.
CNN is working to determine whether Smirnov has an attorney.
The indictment alleges that Smirnov’s story to the FBI “was a fabrication, an amalgam of otherwise unremarkable business meetings and contacts that had actually occurred but at a later date than he claimed and for the purpose of pitching Burisma on the Defendant’s services and products, not for discussing bribes to [Joe Biden] when he was in office.”
Congressional Republicans have championed Smirnov’s now-discredited allegations for roughly a year, though not by name. They fought with the FBI to obtain memos about what Smirnov told investigators and publicly released the materials over the FBI’s objections. The congressional Republicans repeatedly praised Smirnov as “credible” and put his uncorroborated claims front-and-center in their impeachment inquiry into the president.
While announcing the impeachment inquiry, then-House Speaker Kevin McCarthy said “a trusted FBI informant has alleged a bribe to the Biden family.” The FBI is now using some of the same memos that congressional Republicans released as part of their indictment against Smirnov.
“For months we have warned that Republicans have built their conspiracies about Hunter and his family on lies told by people with political agendas, not facts,” said Abbe Lowell, Hunter Biden’s lawyer, in a statement to CNN.
“We were right and the air is out of their balloon. This is just another instance of Chairmen Comer and Jordan peddling falsehoods based on dishonest, uncredible allegations and witnesses,” he added.
House Oversight Chair James Comer said in a Thursday statement to CNN that his investigation into the president does not revolve around Smirnov or his claims made in the FD-1023 – a form the FBI uses to memorialize information gathered from confidential sources – that Republican legislators have cited.
“To be clear, the impeachment inquiry is not reliant on the FBI’s FD-1023. It is based on a large record of evidence, including bank records and witness testimony, revealing that Joe Biden knew of and participated in his family’s business dealings,” the Kentucky Republican said.
He said the FBI had previously defended Smirnov’s credibility.
“When asked by the committee about their confidence in the confidential human source, the FBI told the committee the confidential human source was credible and trusted, had worked with the FBI for over a decade, and had been paid six figures,” Comer added.
GOP Sen. Chuck Grassley of Iowa, who publicly released the 1023 form last year after the FBI declined to do so, said his goal has been to make the Justice Department investigate the bribery allegations against the Bidens.
“This indictment isn’t enough,” a Grassley spokesperson said in a statement. “The public has a right to see all the underlying evidence supporting the Biden Justice Department’s case. The Biden administration must show it’s work.”
According to court records, Smirnov told an FBI agent that he had spoken with the owner of Burisma about the company’s efforts to buy a company in the United States.
As part of his report to the FBI, the indictment alleges, Smirnov also noted that someone referred to as “Businessperson 1” was on the board of Burisma and was also the son of an individual referred to as “Public Official 1.” Though the indictment does not identify these individuals, sources identified “Public Official 1” as Joe Biden and “Businessperson 1” as Hunter Biden.
During Joe Biden’s campaign for presidency, Smirnov allegedly submitted reports to the FBI about two meetings with Burisma executives from 2015 and 2016, during which the executives admitted that they hired Hunter Biden to “protect us, through his dad, from all kinds of problems.” Smirnov also allegedly reported that executives paid $5 million each to Joe and Hunter Biden while Joe Biden was vice president so that Hunter would “take care of all those issues through his dad,” referring to a criminal investigation being conducted by the then-Ukrainian prosecutor general into Burisma.
“In truth and fact, the Defendant had contact with executives from Burisma in 2017, after the end of the Obama-Biden Administration and after the then Ukrainian Prosecutor General had been fired in February 2016, in other words, when [Joe Biden] had no ability to influence U.S. policy and when the Prosecutor General was no longer in office,” the indictment states.
It continues, “In short, the Defendant transformed his routine and unextraordinary business contacts with Burisma in 2017 and later into bribery allegations against [Joe Biden], the presumptive nominee of one of the two major political parties for President, after expressing bias against [Joe Biden] and his candidacy.”
FBI informant lied about Biden's Burisma ties, indictment says
Special counsel David Weiss charged an FBI confidential source with felony false statement and obstruction crimes for providing allegedly false information about President Biden and his son Hunter Biden, the Justice Department announced Thursday.
The big picture: Alexander Smirnov, 43, was indicted by a federal grand jury in the Central District of California after being arrested at the Harry Reid International Airport in Las Vegas, Nevada, on Tuesday, according to a DOJ statement.
Prosecutors allege Smirnov falsely told FBI agents in June 2020 that officials with the Ukrainian energy company Burisma paid the Bidens $5 million each in 2015 or 2016, according to an indictment that was unsealed on Thursday . The indictment against does not specifically name the Bidens.
Zoom in: Smirnov became what the FBI refers to as a "Confidential Human Source" in 2010, and it's alleged he first reported "fabrications" about the Bidens in June 2020, according to the indictment.
"In truth and fact, the Defendant had contact with executives from Burisma in 2017, after the end of the Obama-Biden Administration and after the then-Ukrainian Prosecutor General had been fired in February 2016," the indictment states.
"[I]n other words, when Public Official 1 [Joe Biden] had no ability to influence U.S. policy and when the Prosecutor General was no longer in office," it adds.
“In short, the Defendant transformed his routine and unextraordinary business contacts with Burisma in 2017 and later into bribery allegations against Public Official 1, the presumptive nominee of one of the two major political parties for President, after expressing bias against [Joe Biden] and his candidacy."
Of note: Smirnov allegedly said Burisma officials told him they hired Hunter Biden, who's identified in the indictment as a businessperson, because he would "protect us, through his dad, from all kinds of problems."
When FBI agents interviewed him last September, the indictment alleges Smirnov "repeated some of his false claims, changed his story as to other of his claims, and promoted a new false narrative after he said he met with Russian officials."
Context: Attorney General Merrick Garland appointed Weiss last August as special counsel to lead the investigation into Hunter Biden related to tax charges.
Zoom out: House Republicans have cited unverified information provided by FBI informants as part of their so-far unproven Biden bribery allegations in their impeachment inquiry into the president.
Hunter Biden is scheduled to appear before the House Oversight and Judiciary Committees committees for a deposition on Feb. 28 as part of that inquiry.
And Comer says the Biden impeachment investigation will continue.... He justified it by saying they have other evidence. But a while back, he said that this witness was the backbone of the investigation.

The big picture: Alexander Smirnov, 43, admitted that "officials associated with Russian intelligence" were involved in passing a story about Hunter Biden, per the government's memorandum in support of his detention. Prosecutors alleged in the filing that Smirnov told an FBI handler that the Russian Intelligence Service intercepted several cellphone calls placed at a hotel "by prominent U.S. persons the Russian government may use as 'kompromat' in the 2024 election." Smirnov was indicted by a federal grand jury in the Central District of California after being arrested at the Harry Reid International Airport in Las Vegas, Nevada. Prosecutors alleged Smirnov falsely told FBI agents in June 2020 that officials with the Ukrainian energy company Burisma paid the Bidens $5 million each in 2015 or 2016. CNN — The former FBI informant charged with lying about the Bidens’ dealings in Ukraine told investigators after his arrest that Russian intelligence officials were involved in passing information to him about Hunter Biden, prosecutors said Tuesday in a new court filing, noting that the information was false.
Prosecutors also said Alexander Smirnov has been “actively peddling new lies that could impact US elections” after meeting with Russian spies late last year and that the fallout from his previous false bribery accusations about the Bidens “continue[s] to be felt to this day.”
Smirnov claims to have “extensive and extremely recent” contacts with foreign intelligence officials, prosecutors said in the filing. They said he previously told the FBI that he has longstanding and extensive contacts with Russian spies, including individuals he said were high-level intelligence officers or command Russian assassins abroad.

Prosecutors with special counsel David Weiss’ team said Tuesday that Smirnov has maintained those ties and noted that, in a post-arrest interview last week, “Smirnov admitted that officials associated with Russian intelligence were involved in passing a story about Businessperson 1,” referring to President Joe Biden’s son, Hunter Biden.
The revelations about Smirnov’s alleged foreign contacts were disclosed as part of Weiss’ arguments to keep him in jail while he awaits trial. A federal judge, however, ruled later Tuesday that Smirnov be released while he awaits trial. The release was granted with several conditions, including Smirnov surrendering his passports.
Prosecutors alleged that Smirnov “claims to have contacts with multiple foreign intelligence agencies,” including in Russia, and that he could use those contacts to flee the United States.
The explosive revelation comes amid backlash over how Smirnov’s now-debunked allegations played into House Republicans’ impeachment inquiry into the president.
Smirnov has been charged with lying to the FBI and creating false records. He has not yet entered a formal plea, and his lawyers told CNN in a statement, “Mr. Smirnov is presumed innocent.”
According to the new court filing, Smirnov told investigators he was in contact with “four different Russian officials,” all of whom are “top officials” and two of whom “are the heads of the entities they represent.” Prosecutors did not independently verify in the filing whether Smirnov’s reported contacts are legitimate, nor whether the Russians provided him with disinformation about the Bidens.
The false information that Smirnov reported “was not trivial,” prosecutors wrote.
“It targeted the presumptive nominee of one of the two major political parties in the United States. The effects of Smirnov’s false statements and fabricated information continue to be felt to this day,” prosecutors said, making an apparent reference to the turmoil in Congress over the discredited bribery allegations – which were a key element of the GOP impeachment probe.
Of particular note is a story Smirnov allegedly told the FBI in September 2023, alleging that Hunter Biden was recorded making phone calls in a Kyiv hotel that is “wired” and “under the control of the Russians.” Federal agents said they knew Smirnov’s story was false because Hunter Biden has “never travelled to Ukraine.”
Smirnov told investigators Russian intelligence officers would use the hotel to intercept cell phone calls made by “prominent US persons,” prosecutors said, which the Russian government could use as “‘kompromat’ in the 2024 election, depending on who the candidates will be.” Kompromat is a Russian term that refers to compromising information used for blackmail.
The story, prosecutors noted, matches the story Smirnov told his handler about Hunter Biden being recorded in a foreign hotel.
“Thus, Smirnov’s efforts to spread misinformation about a candidate of one of the two major parties in the United States continues,” prosecutors wrote.
And, prosecutors wrote, Smirnov claims to have met with Russian intelligence officials as recently as November and December 2023.
“What this shows is that the misinformation he is spreading is not confined to 2020,” they wrote. “He is actively peddling new lies that could impact U.S. elections after meeting with Russian intelligence officials in November. In light of that fact there is a serious risk he will flee in order to avoid accountability for his actions.”
Hunter Biden informant re-arrested days after released by court: Special counsel
Alexander Smirnov was released from custody on Tuesday by a magistrate judge.
Alexander Smirnov, the indicted former FBI informant at the center of the Hunter Biden probe, was re-arrested Thursday, the special counsel's office said.
Smirnov was released from custody Tuesday by a Nevada magistrate judge less than a week after he was indicted on alleged false statements and obstruction charges. Smirnov's attorneys said in a statement that their client was in their office preparing his defense when he was taken into custody.
"We are pursuing lawful remedies to once again seek his release," attorneys David Z. Chesnoff and Richard E. Schonfeld said in a statement on Thursday.
The special counsel's office did not immediately provide more information about Smirnov's latest arrest.
Court records filed by Smirnov's attorneys showed the warrant for Thursday's arrest was signed by the California federal judge overseeing his original case.
The warrant requests Smirnov be brought directly to District Judge Otis Wright to answer the charges brought against him in special counsel David Weiss' original indictment filed last week charging him with making false statements to federal law enforcement and creating a false or fictitious record.
Smirnov's attorneys filed an emergency motion with the Nevada magistrate Judge Daniel Albregts who ordered his release on Tuesday to have the government explain itself or hold another detention hearing. Albregts has ordered the government to file a response to Smirnov's attorneys by Friday.
Later Thursday evening Judge Wright posted a sealed order on his docket scheduling a hearing on Weiss' request that Smirnov remain detained pending trial, however, there was no date or time listed on the docket entry, according to court information at the time.
Smirnov was arrested on Feb. 14 after arriving in the U.S. from overseas and indicted the next day.
Smirnov was a confidential source for the FBI and allegedly provided "false derogatory information about [President Biden] and [Hunter Biden] ... in 2020, after [Biden] became a presidential candidate," according to the charging documents. He allegedly told his FBI handler unverified claims that in 2020, Biden and his son had accepted $10 million in bribes from a Ukrainian oligarch.
Weiss noted in his indictment that in July 2023, investigators pursuing Hunter Biden launched "an investigation of allegations related to" the informant's prior claims -- shortly before a July 26, 2023, court hearing where their negotiated plea agreement with Hunter Biden fell apart.
Republican lawmakers had frequently cited Smirnov's claims as the reason for impeachment inquiries into the president. House Oversight Committee Chairman James Comer released a statement last week that Smirnov's charges did not undermine the GOP impeachment inquiry.
During a court hearing Wednesday, Weiss revealed in a court filing that after his arrest last week, Smirnov told the FBI "that officials with Russian intelligence were involved in passing a story" about Hunter Biden.
Weiss added that Smirnov claims that he has active contacts with "multiple foreign intelligence agencies" and that he had planned to leave the U.S. just two days after his arrival last week "for a months-long, multi-country foreign trip."
The special counsel asked the judge to keep the former informant in custody as he awaited trial the judge denied the request but under the condition that Smirnov surrendered his passport, wore an ankle monitor, and be restricted to traveling only to Nevada and to California for court purposes.
If convicted, he faces a maximum penalty of 25 years in prison.
