Michigan former clerk and attorney charged after alleged unauthorized access to 2020 voter data

LANSING, Mich. (AP) — Michigan’s attorney general announced charges Wednesday against a former township clerk and a lawyer who had supported attempts to overturn the results of the 2020 presidential election, alleging they accessed voting systems without authorization in a search of fraud.

Former Adams Township Clerk Stephanie Scott, a Republican, and her attorney, Stefanie Lambert, were charged with multiple felonies, including unauthorized access to a computer and using a computer to commit a crime.

“When elected officials and their proxies use their positions to promote baseless conspiracies, show blatant disregard for voter privacy, and break the law in the process, it undermines the very essence of the democratic process,” Attorney General Dana Nessel said in a statement. “Those who engage in such reckless conduct must be held accountable for their actions.”

The charges are the latest to be brought against people in multiple states who had been entrusted to ensure the security of election systems but instead allowed others to breach them in a futile search for evidence of widespread fraud in the 2020 presidential election. Multiple reviews, audits and recounts have affirmed Joe Biden’s victory over Donald Trump. Election clerks in Colorado and Georgia are among those who promoted conspiracy theories about voting machines and now face charges for allowing unauthorized access of voting systems.

Scott allegedly ignored instructions from the Michigan secretary of state to turn over her township’s voting tabulator to an authorized vendor and withheld the tabulator until it was seized by Michigan State Police, according to the attorney general’s statement. The statement also alleged that, under the direction of Scott, Lambert transmitted data from the township’s poll book related to the 2020 election.

Biden won Michigan by nearly 155,000 votes over then-President Trump, a result confirmed by a GOP-led state Senate investigation in 2021.

Lambert’s attorney, Daniel Hartman, said in a statement that his client did not violate the law and that she “remains steadfast in her efforts to bring transparency to the people’s election data, processes and procedures.” Scott did not immediately respond to an email seeking a response to the charges.

In a separate case, Lambert, a pro-Trump attorney, has been charged with the felony of improperly accessing voting equipment and, in the past, has sued unsuccessfully to overturn Trump’s loss in Michigan.

Scott, who oversaw elections in a small conservative town, was recalled from her position in 2023.

When it came time to prepare for her township’s November 2021 election, Scott said she had accuracy concerns and had considered paper ballots and a hand count before settling on using the same system.

“Quite frankly, I was coming to a moral quandary of even running this election,” Scott told The Detroit News.

The state intervened after Scott allegedly refused to allow a contractor to perform preventive maintenance and failed to conduct accuracy tests, among other issues. She was barred from her duties in October 2021.

The Hillsdale County clerk’s office discovered that a tablet that contained important software and the operating system had been removed when it took custody of an election tabulator and a voter-assist terminal from township offices to prepare for a public accuracy test. It was later seized by Michigan State Police after Scott allegedly refused to turn it over.

Virginia school board votes to restore Confederate names to two schools

School board members in Virginia’s Shenandoah County voted early Friday to restore the names of two schools that previously honored Confederate leaders – four years after those names had been removed.

The 5-1 vote came after hours of public comment during a meeting that began Thursday evening from people speaking on both sides of the issue. Vice Chairman Kyle L. Gutshall was the sole opposing vote.

“I ask that when you cast your vote, you remember that Stonewall Jackson and others fighting on the side of the Confederacy in this area were intent on protecting the land, the buildings and the lives of those under attack,” said a woman urging the board to restore the Confederate names. “Preservation is the focus of those wishing to restore the names.”

Gene Kilby, the last surviving son of James Wilson Kilby, a Virginia civil rights activist who helped desegregate schools in Virginia, criticized the move to keep the names.

“Why are we here tonight to go back to a time in history that was very cruel, where hatred and racism continued throughout this county and throughout the United States?” Kilby said. “Is this the type of legacy that you want to put in Shenandoah County’s public school buildings?”

In the years since the 2020 killing of George Floyd, the names of Confederate leaders, Confederate monuments and symbols have been removed from numerous schools, universities, military facilities and even the Washington National Cathedral’s windows.

Nearly four years ago, the Shenandoah County School Board made such a decision and moved to rename Stonewall Jackson High School and Ashby Lee Elementary School. The schools had been named after Confederate Gens. Thomas “Stonewall” Jackson, Robert E. Lee and Turner Ashby.

That 2020 move was part of a resolution condemning racism and affirming the district’s “commitment to an inclusive school environment,” according to school board documents.

The schools have been called Mountain View High School and Honey Run Elementary School since July 2021, according to board documents.

But the composition of the school board is different now than it was during the 2020 decision – all six seats are held by different people.

Changes could be a six-figure expense

After a group of residents named The Coalition for Better Schools asked the board last month to consider restoring the original school names, members discussed the issue in a work session, heard public comments and scheduled this week’s vote.

In an April 22 work session meeting, the six board members criticized how the names were changed in 2020, saying it was wrongly done, was rushed and lacked public input. Board member Gloria E. Carlineo said in the work session that it also “eroded” confidence in the school board.

Carlineo told CNN her vote would be based on how the names were changed in 2020. A decision that, she said, took place within days and with Covid-19 restrictions that limited the community’s input.

“So, for me, the main consideration is whether we, as a democratic nation of laws, will choose to ignore a decision made by a governmental body that exploited the tragedy of COVID or will rectify a wrongful action that has deeply divided our community. I choose the latter,” Carlineo told CNN before Thursday’s meeting.

CNN reached out to the other five board members for comment ahead of Thursday’s meeting.

Jessica Sager, a spokeswoman for Shenandoah County Public Schools, had said the district has not yet obtained quotes on the estimated cost of a name change. In 2021, the district estimated it would spend more than $304,000 in costs related to changing the two school names and a middle school mascot, according to district documents.

Those costs were related to uniforms and equipment for athletic teams, resurfacing of a gym floor, signage in buildings and scoreboards, among other items, former Shenandoah County Public Schools Superintendent Mark Johnston told board members during a meeting last year.

The motion says that if approved, private donations would be used for the restoration of the school names and not by “the school system or government tax funds, though the SCPS will oversee disbursements relating to restoration costs,” according to Thursday’s meeting agenda.

Some residents refuse to move on, parent says

Parents and residents expressed their opposition and support to restoring the school names. In an April 3 letter to the school board, the Coalition for Better Schools said it believed “that revisiting this decision is essential to honor our community’s heritage and respect the wishes of the majority.”

The group told CNN before the vote took place that it “has full confidence in our current school board to listen to the voice of its constituents and follow the wishes of the majority in the county. Unfortunately, the previous school board did not take those things into consideration. We believe that ‘We the People’ is an important part of our Constitution and should be upheld at every level of our government.”

Sarah Kohrs, a mother of two students attending schools in the district, is among several parents and residents who said ahead of the vote that they were opposed to restoring the Confederacy-tied names and were frustrated it was being considered.

“It’s very frustrating to know that here we are four years after that, and we still have a small portion of the community that just refuses to move on,” Kohrs told CNN.

She said attention should be focused on what students want and need to succeed, like repairing leaking roofs, a sound system for track meets, or having enough varsity letters with the current school names.

“We still don’t even have all of our athletic equipment from the name change in 2020. We’re still utilizing old hurdles, sometimes that have the name of Stonewall on them,” Kohrs told CNN.

Shenandoah County Public Schools serves more than 5,600 students, and about 75% are White, 18% Hispanic and 3% Black, data from the state’s department education shows.

Barron Trump to serve as GOP convention Florida delegate in political debut

Barron Trump, former President Trump’s youngest son, was named a Florida delegate for this year’s Republican National Convention, marking the 18-year-old’s debut into politics.

Barron Trump will serve as one of the 41 at-large GOP delegates to represent Florida at the July convention, where the party is expected to officially nominate his father as its presidential candidate to run against President Biden in November, the Florida GOP confirmed to The Hill.

Trump, who turned 18 earlier this year, joins three of the former president’s other children — Eric, Tiffany and Donald Trump Jr. — who were also selected as delegates. Eric Trump will serve as delegation chair, the Florida GOP noted.

NBC News first reported Barron Trump’s selection as a delegate Wednesday.

The Hill reached out to the Florida GOP for further comment.

“We are fortunate to have a great group of grassroots leaders, elected officials, and members of the Trump family working together as part of the Florida delegation to the 2024 Republican National Convention,” Republican Party of Florida chair Evan Power said in an emailed statement to The Hill.

Barron Trump, who was 10 when his father was elected to the White House in 2016, was mostly kept out of the public spotlight while the former president was in office.

His name was brought back into the public eye last month after the New York judge overseeing the former president’s hush money criminal trial was forced to weigh whether former President Trump could skip trial to attend Barron Trump’s graduation on May 17.

Judge Juan Merchan eventually granted former President Trump special permission to miss trial for the graduation.

The Republican National Convention will take place from July 15-18 in Milwaukee.

Former President Trump, who became a Florida resident in 2019, won in the Sunshine State in both the 2016 and 2020 presidential elections.

MIAMI (AP) — Former President Donald Trump's youngest son, Barron Trump, won't be serving as a Florida delegate to the Republican National Convention after all, his mother's office said Friday.

“While Barron is honored to have been chosen as a delegate by the Florida Republican Party, he regretfully declines to participate due to prior commitments,” Melania Trump’s office said.

Republican Party of Florida chairman Evan Power had said Wednesday that the 18-year-old high school senior would serve as one of 41 at-large delegates from Florida to the national gathering, where the GOP is set to officially nominate his father as its presidential candidate for the November general election.

Power did not respond to a request for comment Friday.

In an interview earlier Friday on “Kayal and Company” on Philadelphia’s Talk Radio 1210 WPHT, Donald Trump was asked about Barron joining the Florida delegation. “He’s really been a great student. And he does like politics," Trump said. "It’s sort of funny. He’ll tell me sometimes, ‘Dad, this is what you have to do.’”

Barron Trump has been largely kept out of the public eye, but he turned 18 on March and is graduating from high school next week. The judge overseeing Donald Trump's hush money trial in New York said there would be no court on May 17 so that Trump could attend his son’s graduation.

Donald Trump Jr., Eric Trump and Trump's youngest daughter, Tiffany, are part of the Florida delegation to the convention taking place in Milwaukee from July 15 to July 18.

I get what you are saying, as a 26 year military vet I liked the history and continuity of old base names- Ft. Bragg, etc....BUT I support the name changes because why should American bases be named for individuals who fought against the US AND black American could/ or do feel harmed by these names being celebrated---- I also understand Southern roots/ white tradition- why should minority dictate to the majority? The human condition- we sure haven't ever got things right. If you're a Christian- would Christ change the names- I have my answer.

Arizona officials say they can’t find Rudy Giuliani to serve him with indictment notice

Arizona prosecutors have tried for weeks – and so far failed – to serve Rudy Giuliani with notice of his indictment related to an alleged scheme to overturn the 2020 election results in that state.

Giuliani is among a group of former President Donald Trump’s allies indicted last month in Arizona alongside the 11 individuals who acted as fake GOP electors from the state in the last presidential election.

But the former New York City mayor and one-time attorney for Trump is the only defendant prosecutors have been unable to serve with a summons, according to Richie Taylor, a spokesperson for the Arizona attorney general’s office.

The summons is a formal notice that Giuliani has been criminally charged and must appear before a judge on May 21.

CNN has reached out to a spokesman for Giuliani for comment.

A team of prosecutors and investigators working for Arizona Attorney General Kris Mayes, a Democrat, has made multiple attempts to locate Giuliani, Taylor told CNN.

The day after the state-level grand jury handed up its indictment, two agents for the attorney general’s office traveled to New York City with plans to hand-deliver the notice to Giuliani, Taylor said.

The agents believed Giuliani was likely in his New York City apartment because he had recently video streamed from there – which they determined by matching the setting of the feed with pictures of the interior of the residence from an old real estate listing.

But upon arriving at the building, a person at the front desk told the agents they were not allowed to accept service of the documents, according to Taylor, who added that the individual did not dispute Giuliani lived there.

“We were not granted access,” Taylor added, confirming details previously reported by the Washington Post.

While Trump is not among those charged in Arizona, the details in the indictment suggest he is “Unindicted Coconspirator 1.”

“In Arizona, and the United States, the people elected Joseph Biden as President on November 3, 2020,” the indictment reads. “Unwilling to accept this fact, Defendants and unindicted coconspirators schemed to prevent the lawful transfer of the presidency to keep Unindicted Coconspirator 1 in office against the will of Arizona’s voters.”

Trump’s former White House chief of staff Mark Meadows, his close adviser Boris Epshteyn, the Republican National Committee’s top lawyer for “election integrity” Christina Bobb and former Trump campaign aide Mike Roman are among those charged in Arizona alongside Giuliani.

All of the defendants except Giuliani have been served.

WASHINGTON (AP) — An upside-down American flag, a symbol associated with former President Donald Trump’s false claims of election fraud, was displayed outside the home of Supreme Court Justice Samuel Alito in January 2021, The New York Times reported Thursday.

A photo obtained and published by the newspaper shows the flag flying on Jan. 17, 2021, days after Trump supporters stormed the U.S. Capitol on Jan. 6, 2021. Dozens of the rioters were carrying similarly inverted flags and chanting slogans like “Stop the Steal.”

The report could raise concerns about Alito’s impartiality as the court considers two major cases related to the attack, including charges faced by the rioters and whether Trump has immunity from prosecution on election interference charges.

It comes as another conservative justice, Clarence Thomas, has ignored calls to recuse himself from cases related to the 2020 election over his wife, Ginni Thomas’, support for Trump and as public trust in the Supreme Court is at its lowest point in at least 50 years. Judicial experts said the flag clearly violates ethics rules set to avoid even the appearance of bias.

At the time the flag was flying, the court was still considering whether to take up cases over the 2020 election. It ultimately rejected them over dissent from three conservative justices, including Alito, who was appointed by Republican President George W. Bush. He wrote that the court’s consideration of the cases would have no impact on the 2020 election but “would provide invaluable guidance for future elections.”

Alito, for his part, acknowledged the presence of the flag at his home in Alexandria, Virginia, but said it was placed there by his wife.

“I had no involvement whatsoever in the flying of the flag,” Alito said in an emailed statement to the newspaper. “It was briefly placed by Mrs. Alito in response to a neighbor’s use of objectionable and personally insulting language on yard signs.”

Martha-Ann Alito had been in a dispute with another family in the neighborhood over an anti-Trump sign on their lawn, and neighbors also interpreted the flag as a political statement, the Times reported. It isn’t clear how long the flag was flying.

Judicial ethics codes focus on the need for judges to be independent, avoiding political statements or opinions on matters they could be called on to decide. The Supreme Court had long gone without its own code of ethics, but adopted one in November 2023 in the face of sustained criticism over undisclosed trips and gifts from wealthy benefactors to some justices. The code lacks a means of enforcement, however.

Amanda Frost, a law professor at the University of Virginia, told the newspaper that flying the flag upside down is “the equivalent of putting a ‘Stop the Steal’ sign in your yard, which is a problem if you’re deciding election-related cases."

Even if it was placed by his spouse or someone else living in the home, “he shouldn’t have it in his yard as his message to the world,” she said.

The Supreme Court has warned its own employees about public displays indicating partisan leanings, the newspaper reported. The court did not respond to questions about whether those rules apply to justices.

The U.S. Flag Code states that the American flag is not to be flown upside down “except as a signal of dire distress in instance of extreme danger to life or property.” It has been used as a protest symbol on both the left and the right on a range of issues over the decades. It took off as a symbol of Trump's “Stop the Steal” campaign as he spread false claims that the election he lost to President Joe Biden had been stolen.

U.S. Rep. Matt Gaetz evoked language adopted by the far-right Proud Boys extremist group as he appeared at court Thursday to support Donald Trump at his hush money trial, reflecting the undercurrent of activist elements present among the presumptive GOP nominee's supporters as he seeks a return to the White House.

“Standing back, and standing by, Mr. President," Gaetz wrote as he posted a photo on social media of him with other congressional Republicans standing behind Trump in a hallway outside the courtroom where the former president's felony case is in its fourth week of testimony.

The Proud Boys — whose leaders were convicted of seditious conspiracy after the Jan. 6, 2021, attack on the U.S. Capitol — have used that verbiage since Trump, during a 2020 campaign debate, said: “Proud Boys, stand back and stand by.”

That came in response to a question from debate moderator Chris Wallace asking if Trump would condemn white supremacist and militia groups that had shown up at some social justice protests across the country that summer following the death of George Floyd.

“I don’t know who the Proud Boys are," Trump said a day later, after facing widespread criticism for his failure to condemn their actions specifically, adding: “Whoever they are, they have to stand down. Let law enforcement do their work.”

Proud Boys leaders and supporters later celebrated Trump’s initial words on social media. A channel on Telegram, an instant messaging service, with tens of thousands of the group’s members posted “Stand Back” and “Stand By” above and below the group’s logo.

After Trump's debate comment, membership for the Proud Boys “tripled, probably,” member Jeremy Joseph Bertino told the House committee that investigated the Jan. 6 insurrection. Bertino pleaded guilty to plotting with other Proud Boys members to violently stop the transfer of presidential power after Trump lost the 2020 election to Democrat Joe Biden.

Members wearing the group's black and yellow insignia have shown up on the sidelines of Trump's rallies across the country this campaign cycle, in which Trump has made the Jan. 6 attack a cornerstone of his bid. Having previously vowed to pardon the rioters, Trump has at some rallies played a recorded chorus of prisoners jailed for their roles in the attack singing the national anthem and referred to them as “hostages.”

Gaetz, of Florida, was part of a contingent of conservative lawmakers who showed up at court to support Trump on Thursday, the latest in a procession of elected Republicans journeying to the New York courthouse in recent days to defend the party’s presumptive presidential nominee. Trump is accused of having arranged secret payments to a porn actress to hide negative stories during his successful 2016 campaign for president.

Asked in an email if Gaetz intentionally used the verbiage adopted by the Proud Boys, spokesman Joel Valdez said, “the tweet speaks for itself.”

That's what Menendez is doing right now in court. Blaming his wife for everything to save his skin.

Oddly enough the two of them were just on the opposite sides of a CFPB decision, where Thomas wrote the majority opinion and Alito wrote the dissent. Can't say I expected to see that.
