Smoking is permissible in private clubs as long as you permit ONLY members, correct?
So why don't these bars fire up a "Nightly Membership" program?
Charge like a $3.00 "Membership Fee" at the door, have the patron sign a simple agreement (which stipulates that they knowingly and willingly are joining a 'smoking club') and then hand out a printed membership card, good for that night only.
Basically, the bar would charge a cover at the door like most of them do anyway, pass out a card and then resume business the old way. Change the color of the cards every Saturday, and allow people to quickly re-enter the bar if they show their card... others wait in line.
Seems like a nice & easy way around the crappy law.

I don't remember the details - but there was something about that in the law....something about a private club can't have any paid employees - something like that.

Then the bars of Cleveland should set up a parent company that empoys the bar workers, and they "volunteer" their time to work at their private clubs.
Or... convince them to work for "free", gratuities only... and of course the bar owner would nightly give a gratuity in roughly the amount of the hourly wages..... this shouldn't be that big of a stumbling block as most of them only make a hair over $2 an hour anyway.
There's ways around it, people just aren't looking hard enough. There's always a loophole.

I believe there is also a stip. about food sales in the bar, and most of the profits must come from booze sales.

Here in Florida it is that way. Any drinking establishment that serves food, must not make more than 10% of their gross revenue from food if they want to keep smoking inside. Seems to work very well for us down here.
