Yes, but can that gun be loaded like the one was in his carry on?
My understanding is no, a checked gun cannot be loaded.

My understanding is no, a checked gun cannot be loaded when it is in checked luggage (checked as in stowed in the cargo hold. But regardless, NO gun, loaded or unloaded, can be in carry on luggage. )

Right. I knew even a checked gun couldn't be loaded...it's only common sense. I thought I put a crazy face after my question.
I really just wondered what he was going to do with it had he remembered it was in his carry-on bag. Just toss it in his suitcase? Or, was he actually going to unload the weapon?
Oh well, we'll see how this plays out.

I bet he gets probation with no jail time and the Goodell will suspend him for 4-8 games.

Shaun Rogers is still in jail Posted by Mike Florio on April 2, 2010 12:02 PM ET Arrested Thursday for possession of a loaded gun as he prepared to build board an airplane, Browns defensive tackle Shaun Rogers remains in jail. According to the Associated Press, Rogers has asked either to be charged or to be released from custody. Rogers' lawyer fears that the player will be held without charges over the Easter weekend. And, presumably, Rogers really needs his basket full of Peeps. web page

Bail set and paid Quote:
Rogers, 31, told officers that he had forgotten the gun was in his bag and that he carried it for personal safety during travel. Police say Rogers has a license in Michigan to carry a concealed weapon.
His agent, Kennard McGuire, earlier said Rogers made a mistake he deeply regrets.
"Shaun is from a tremendous family that knows right from wrong," McGuire said in a phone interview. "He is completely remorseful and sorry. While he does have a permit to carry a weapon, carrying it into the airport was an unintentional mistake. He will fully cooperate with all the authorities."

Peen you are the legal expert here, what is a 4th degree felony carry as a penality if found guilty?

My guess would be probation with community service on the legal side.
On the NFL side. Two game suspension.

Hopefully, someone else's community, besides Cleveland's.
What trade value the guy had just evaporated, because no one...except for maybe the Raiders, wants a nose tackle that can't remember he has a loaded (chambered) 40 cal semi auto pistol, in his carry on luggage.
The night in jail was the best thing that could have happened to Rogers if the Browns do decide to keep him around. Mangini can hang it over his head that no other team in the NFL wants him and the Browns only want him if he is willing to play to his potential.
Don't get me wrong...I liked the Rogers that played for Crennel...but hated the Rogers that put his time in for Mangini.

Cleveland Browns star Shaun Rogers released from jail; to appear in court Saturday morning By Pat Galbincea, The Plain Dealer April 02, 2010, 4:18PM CLEVELAND, Ohio -- Cleveland Browns nose tackle Shaun Rogers is expected to be in court Saturday morning after being charged with carrying a concealed weapon. Rogers, 31, was released from City Jail Friday after being formally charged and posting $1,000 bond. That came one day he was arrested at Cleveland Hopkins International Airport for having a loaded handgun in his carry-on bag. Rogers, 31, is scheduled to make an initial appearance 8:30 a.m. Saturday in Cleveland Municipal Court. Patrick D’Angelo, his attorney, said Rogers will plead not guilty, and the case will then be bound over sent to the Grand Jury. Following his release from City Jail today, Rogers spoke briefly outside the Justice Center, where he apologized to the fans, the Browns, team owner Randy Lerner and Cleveland Police for what happened. "I’m truly remorseful, and I really can’t put into words how unfortunate the incident is," Rogers said to reporters. "Again, I’m completely sorry." D’Angelo said Rogers did not intentionally pack a handgun — a .45 caliber Kimber semiautomatic.which police said was cocked in "safe mode." He’s been going back and forth, especially to Detroit trying to sell property which is currently being rented by ex-Browns defensive tackle Corey Williams, now with the Lions. Rogers has a permit to carry the weapon in Michigan. "Shaun, like a lot of players, is constantly on the go," D’Angelo said. "At 12:30 p.m. he was grabbing everything he could to pack his bags again but forgot that the weapon was there." Rogers was having his luggage inspected at Concourse C when the gun was found. He was arrested without incident. "I can’t believe the vitriol and venom that I’ve read and heard on talk show commentary," D’Angelo said. "People saying ‘Who does he think he is, how stupid is he trying to get a gun past airport security?’ That’s not the case at all. "Shaun didn’t intentionally put that weapon there, flaunting his right to bear arms. It was a mistake, and he realizes the severity of what he did. That’s why he’s apologized to everyone who will listen." D’Angelo said he filed a writ of habeas corpus Friday morning to get Rogers released because the city’s financial crunch had many workers furloughed through Monday. No prosecutor was immediately available to review Rogers’ case and set a bond until the writ was filed. Otherwise, Rogers would have spent Easter weekend in jail. He was released at 1:30 p.m. web page

Eh, the raiders probably aren't the only team - the Bengals have a soft spot for this type of player. The steelers are becoming that way, it seems - heck, even the ravens.

Yeah I don't understand all the anger. It was a dumb mistake. I actually feel kind of bad for him. I get pretty discombobulated when I travel a lot.

Those Kimbers are pretty guns. It was cocked and locked, sounds like he knew what he was doing as far as carrying goes. He must not have paid attention during the firearms storage part of the concealed carry class though.

I don't think many believe the guy was going to shoot out a window or two to suck a few babies out, then shoot the pilots in the head in a effort to crash the plane.

Lets see where did I leave that loaded gun? Laundry hamper? No! Babies playpen? Nope. In the shower? Nah. In the sofa? Nope, but here's 87 cents. At the Airport? Voila! Thanks, Mr TSA man. It's always the last place you look! What a maroon. Well, at least he didn't shoot himself ala Plaxico Dumbarse. I'm gonna guess, he keeps the bullets in the gun because otherwise he wouldn't remember where he put them. Even Barney Fife always knew his bullet was in his shirt pocket. I wonder if Deputy Fife ever forgot where his gun was during his trips to MT Pilot? The Browns ought to get him a pointy helmet for this caper.

Rogers has been a good citizen all along from what I remember. I think what he did was stupid, stupid, stupid...but... I feel better about the whole thing now that I know where he was when the gun was "found" and that he has a concealed carry permit. It does not excuse him for being irresponsible with his gun, but the concealed carry permit carries a lot of weight to me. BUT he carried into a prohibited area so that penalty must be paid. He is not a bad guy ala Bengals and Raiders players ...but he did do a dumb, bad-guy type of thing. By no means do I think we should cut him or trade him do to this mistake...and I say that simply due to the concealed carry permit.

I believe any state that has a CCW law will honor a CCW permit from another state.
It was not an illegal weapon, he just carried into an area that was illegal.

Agreed,, but there will be a price to pay and he's gonna have to pay it.. don't' know if this is something he can plead out of,, Fine, community service, suspended sentence maybe? dunno.
Is that something that is possible Peen?

You are correct sir. Just because you have a permit in one state - it is no guarantee another state will honor it. The CCW license holder is responsible for checking that out before they travel.
And yes, Michigan and Ohio honor each others license. (not sure "honor" is the word I want, but you get the meaning)

I think it said in the article - one of the first ones - that a third degree felony is punishable by anywhere from probation to up to 5 years in prison.
And I think the prosecutor charged him with a 4th degree felony, which is a lesser charge.

Whether or not he does time or community service, if convicted we're going to lose him for at least some portion of the season when Goodell smacks him with a suspension, probably 4 to 8 games going by what he's done to others.

Shaun Rogers' gun was cocked with a bullet in the chamber as Browns lineman tried to board a plane at Cleveland Hopkins, report says By Donna J. Miller, Plain Dealer reporter April 05, 2010, 11:00AM
PD fileShaun Rogers CLEVELAND, Ohio -- The police report that details Browns player Shaun Rogers' arrest Thursday at Cleveland Hopkins International Airport for carrying a loaded gun says that the gun was cocked and had a bullet in the chamber.
The cocked semi-automatic handgun was on safe mode, patrolman Mark Tescar wrote in his report. There were seven bullets in the magazine and one in the chamber.
Rogers, 31, of Strongsville, told investigators that he forgot he put the black .45-caliber Kimbra Ultra II inside his brown carry-on bag during a recent visit to Detroit.
Rogers has a "good Michigan concealed pistol license issued May 9, 2006," Tescar wrote.
The gun was found by an X-ray technician at security checkpoint C at 12:15 p.m. Thursday.

I'd be surprised if a suspension was over 1 game. He accidentally brought a gun to the airport. He didn't kill a guy with his car, beat his wife, stab a person, shoot a gun into a crowd of people, or arrange a dogfighting crime ring. He brought a loaded gun to the airport by accident. Poor judgement to not check his bag but barely something to get worked up over.
He'll be fine. A big fine, some community service, and probation.

As much as I believe him when he says he completely forgot about having his weapon packed in a bag (something I could see myself doing as I have a horrible memory), I can't accept the excuse (True or not) when it is added to the fact that it was also cocked w/ a round in the chamber. He started making his bed long before the airport incident when he was in Detroit.

"Cocked and locked" is the standard as far as carrying the 1911 style 45 that Rogers had. I don't think it adds anything of significance to the story.

Goodell comes down pretty hard on guys that make the league look bad, full of gangster thugs or whatever.
I don't think Roger's legal issue would make anyone think that he is a gang-banger. Therefore it won't reflect as badly on the league in Goodell's eyes.
I think jail time is the biggest worry as far as him missing games.
