Well to be honest....Michelle was 9 and the other lady was an adult. And while I do think it would have been good policy for McDonalds to give the woman something, I certainly don't think they were reponsible for the entire incident which is what the lady was looking for. Come on DC...you are big on personal responsibility. If McDonalds paid everything...what responsibility in this action does the woman take??? Absolutely NONE. When most of it falls in her lap....(oooooooh....sorry...pun was NOT intended)

Coffee should be served at whatever temperature it is best tasting at. No, you absolutely should NOT be told to wait at least 5 minutes. You should have the simple sense to CHECK for yourself whether or not it is safe for you to consume. You are taught how to do this as a child by sipping at your soup, hot cocoa, etc...

She spilled it on herself due to her own negligence. There was no negligence on the part of the restaurant. She ordered a hot beverage, they gave her a hot beverage, in a cup designed for a hot beverage. To the normal human, those things combine to make for a pretty big clue that the contents are hot. She then proceeded to mishandle her hot beverage and had an accident. Then, like a good American, she proceeded to blame someone else for her screw up and she got a good enough lawyer to convince the jury that though she is the only one that was involved in the accident, someone else caused it.

I bought a bicycle once and hit a rock in the road causing me to flip over the handle bars. I should have sued.

The manufacturer, of course. Clearly it was their fault I did something stupid. They didn't put a warning on the bike about hitting objects in the road.

I have matches. They suck, because when I use it like the directions say: "open box, grab match, shut box, strike match on the striker pad." and then it lights and I hold my finger on the flame, I get burned. Can I sue?
And dang, I hate it when I use the mower like I'm suppose to, but then my foot slips underneath the deck and I mow my toes off. Can I sue?
Couple of days ago I nicked my face with a razor. Should I sue? I mean, my wife said I looked stupid with a band aid on my chin. Mental anguish?
Last week I was taking the counter tops off in my in-laws house they just bought. Laminate counters. I checked, and all I saw was glue - they were glued on, not screwed. As I was lifting them, then sliding my hands along the counter - I got jabbed with a nail. (never in my life have I seen laminate counter tops nailed to the cupboards - it was as if they put the counter in, nailed it down, then laminated it after - but they didn't do that.......) anyway, could I sue?
Not trying to rip on you brownsfan - just saying people sue over dumb things all the time, and sadly, if the company getting sued is seen as "rich", they all too often get taken to the cleaners.

Lemme tell you about lawsuits. Now, the lady I'm referring to didn't get rich, ok? However, a lady in town has, or, perhaps I should say HAD - fallen on the sidewalk in front of a business. She says because the sidewalk was icy. Of course the ambulance came, took her to the hospital - and she was fine. But, she got money out of it from the business' insurance company.
Fast forward 2 years. Same lady. Different sidewalk, different business. Same thing.
Fast forward about 3 years. The lady's daughter did the same thing. Got money.
Fast forward to 2 years ago. Wed. night - parents picking kids up at church. Rainy night. The entry to the church is tiled. Tile, wet shoes - they just don't add up, do they? The daughter came running in from outside, tried to quit running, and fell.
Myself and 3 other dads were standing there and the comments were made "I wonder how much this is going to cost the church?"

I know, it is sad how it works, especially when they can then see a history and yet can still get money.
I came to work over the winter, and it was one of the days that the ice was really bad. I got out of my truck and started to walk across the parking lot when I slipped, went airborne, and landed flat on my back. Hurt something terrible, and I was pretty sore for a couple days. I didn't even think about suing the company who owns the building.

Wasn't it Walmart that got sued because a woman stepped on a skateboard that was in the aisle and fell and hurt herself and after reviewing the video it was HER SON that got it down and left it in the aisle and Walmart had to pay anyway?

That lady and daughter are greedy, lazy nuts...or at least their consistent law suits suggest that to me.
I slipped in an icy parking lot (in one of the few areas the hotel didn't plow/salt and it was black ice - couldn't see it), I sprained my ankle something fierce - it was darn close to breaking. The hotel asked me to send them my ER bill, they paid it and that was it. I didn't ask for anything more and I also didn't try to get money out of them for missed work.

Just watched this show last night. It was one sided but brought up valid points. The girl who got raped in Iraq didn't fair so well when she finally got her case to civil court.
