Mox I agree 100%. Almost all benefit of the doubt should go the homeowner in that circumstance... Normal civilians are not trained or equipped to assess the threat level and give a measured response. And, most importantly, you should not have to put yourself at greater risk, to protect "the rights" of a person who broke into your home.

I think the rub here is the execution piece of this story. It's like the pharmacist in Okc a few years back. Two boys came in to rob him, he pulled his gun and shot one, ran outside and took a few shots at the other and missed. Came back in and shot the one on the ground again. If he'd have stopped when he neutralized the threat he wouldn't be in jail today.

From all accounts they had been shot and were incapacitated.. then he moved in and shot them again, which is the part most everybody has a problem with. If he had delivered the kill shot with his first or second shot from across the room, then called 911.. people might still have a problem with the way he moved his truck, sat in wait for them, etc but the legal system would have treated him entirely differently and I believe public opinion would be a lot different..
That said, I have a question... I believe he shot the boy first, incapacitated him, then killed him.. then it was close to 8 minutes before the girl came downstairs? Am I understanding that right... why didn't she run?
