Agent says Henry passed clear; authorities say more testing needed

CINCINNATI (AP) -- Prosecutors say more testing will be needed to determine whether suspended Cincinnati Bengals wide receiver Chris Henry has failed a drug screening that is part of his probation for letting minors drink in his hotel room.

Henry's agent, Marvin Frazier, insisted that the drug test was negative and the Bengals said they were awaiting more information from the authorities in Kenyon County, Kentucky.

"With respect to the northern Kentucky proceedings, reports to date may not be based on complete information," the Bengals said in a statement. "More information is expected to be made available shortly, once all the procedural tests are complete, and the club will await any action until that information has been released."

Meanwhile, the Bengals, plagued by a series of off-field problems for more than a year, waived linebacker A.J. Nicholson hours after he appeared in court Monday on a domestic violence charge.

A spokeswoman for the Kenton County attorney's office said there would be more testing in Henry's case.

"We know that there are inconsistent reports about the routine drug screenings," spokeswoman Melissa Pryor-Reed said. "As a result of these inconsistencies, further tests are currently pending."

Frazier, citing information he received from the Bengals and Henry, said an initial screening, which he compared to a home-pregnancy test, had been followed up with one that confirmed there were no drugs in Henry's system.

"It's negative," Frazier said. "They jumped the gun on it."

After reports circulated early Monday that Henry had failed a drug test, the chief prosecutor for Kenton County said authorities were awaiting the final analysis.

"We have to wait for confirmation from the state lab. We have suspicion on a field test," Ken Easterling told The Cincinnati Enquirer. "We cannot confirm or deny (Henry's test sample) contains a controlled substance."

Failing a drug test could result in Henry's current NFL suspension of eight games being extended. He could also face more jail time in Kenton County, just across the Ohio River from Cincinnati.

Henry served two days there after pleading guilty to letting minors drink in a hotel room he rented. The judge suspended 88 days of the 90-day sentence.

A message seeking comment was left with Henry's attorney, Robert Lotz.

The Bengals said to the club's knowledge, Henry had been complying with legal and NFL-required procedures.

Henry, the Bengals' No. 3 receiver, has shown big-play ability, and the offense struggled last year when he was benched one game by coach Marvin Lewis and suspended two more by the NFL.

Henry was arrested four times over 14 months, but had avoided jail time on the other three charges.

The Bengals waived Nicholson, who pleaded not guilty Monday in Kenton County court to a domestic violence charge. His girlfriend tried to recant her claim that Nicholson hit her, but a judge would not allow it. Nicholson remains free on $5,000 bond, with a hearing set for May 31.

The fifth-round draft pick from Florida State in 2006 was hampered by a hamstring injury last season and appeared in only two games. Bengals spokesman Jack Brennan said the team had no comment on the decision to waive Nicholson.

Nicholson had previously pleaded no contest to burglary and grand theft in Tallahassee, Fla., and was sentenced to two months in a work program. He was also placed on two years' probation, which could be jeopardized by his arrest last Friday on the domestic violence charge.

The Bengals, who had nine players arrested in a nine-month span, were part of the reason NFL commissioner Roger Goodell introduced a conduct policy last month that stiffens penalties and holds franchises responsible when their players get into trouble.

Henry, a third-year pro, and former West Virginia teammate Adam "Pacman" Jones became examples of the crackdown, with Goodell suspending Henry for eight games and Tenneesee's cornerback for the season.

"I must emphasize to you that this is your last opportunity to salvage your NFL career," Goodell wrote in letters to the players.

Since his college days at West Virginia University, Henry has been a problematic receiver. During his junior season with the Mountaineers, he was ejected from a game at Rutgers due to multiple unsportmanlike conduct penalties and was suspended for the season finale at Pittsburgh.

December 15, 2005 - Chris Henry was pulled over in Northern Kentucky for speeding and marijuana was found in his shoes. He was also driving without a valid driver's license, and without auto insurance. On January 30, 2006, he was arrested in Orlando for multiple gun charges including concealment and aggravated assault with a firearm. [1] He was reported to have been wearing his Number 15 Bengals jersey at the time of his arrest. Henry pleaded guilty in both cases and avoided jail time in both cases.
May 4, 2006 - Cincinnati media reported that Henry is being investigated by Covington police in connection with a sex crime, which allegedly occurred in a hotel room in Covington, Kentucky early on April 30, 2006. No charges have yet been filed, and on May 24, 2006, Covington police reported that there is no proof anything happened and that the alleged victim might now face charges for filing a false police report.
June 3, 2006 - Chris Henry was pulled over outside on Interstate 275 at 1:18 a.m by Ohio Highway Trooper Michael Shimko. At 2:06 a.m. Henry voluntarily submitted to a breathalyzer test at Milford Police Department and registered a .092 blood-alcohol level, .012 above the level permitted by Ohio law. [5]
September 25, 2006 in the early morning, Bengals linebacker Odell Thurman was pulled over for a DUI. The truck Thurman was driving belonged to Rookie Reggie McNeal. Neither McNeal nor Chris Henry were charged with any wrongdoing by authorities, however, Bengals Head Coach Marvin Lewis benched Henry for the Bengals loss against the New England Patriots.
October 6, 2006 - Henry was suspended by the NFL for two games for violating the league's personal conduct and substance abuse policies. NFL policies forbid Henry from taking part in practices, however, he was allowed to attend any team meetings. Henry missed the Bengals' October 15, 2006 game at Tampa Bay Buccaneers and their October 22, 2006 game against the Carolina Panthers. [6]
January 25, 2007 - Henry pleaded guilty to charges of providing alcohol to minors, an incident that occurred at a hotel in the spring on 2006. He was sentenced to 90 days in jail, with all but two of those days being suspended. [7]
April 10, 2007 - Henry was suspended for the first eight games of the 2007 NFL season for violations of the NFL's personal conduct policy. [8] His suspension comes with a stern warning that future misconduct may result in the end of his career with the NFL.

but what do I know,Browns fans are so knowledgable about football,especially the Bengals.

It would be nice for a few Bengals to get their act together and just concentrate on football. Its stressful following the Bengals..you never know when you turn the computer on whats going to headline the Bengals website.

No, I didn't hear it (please share)...but I've been harsh on Lewis for quite some time now...my Bengals friends have long disagreed with me, because winning a little cures a few ills...but at this point many are starting to wonder...

Quick example: When the Tribe brought up Joey Belle out of LSU, they were well aware that he was a hot-head who could get himself into trouble - he'd already had some incidents in college. He was an accounting major there, and didn't get a degree, but the Tribe put a call into my father, who was pretty close with the organization at the time, and asked if he could find offseason work for Belle in the accounting department of his hotel. And there was Joey Belle, behind a desk for the winter because the Tribe basically said 'THIS is what you will be doing for us during the offseason...this man will pay you, and we'll see you in the spring.' He worked in the office for months, and no problems ever arised. Eventually, Belle became too big of a star to be told what to do in those scenarios, and I think today almost all of these kids are too big for that sort of thing...I also think that a baseball team could get away with that a little easier than a football team, but the point is, the Bengals organization really needs to clamp down.

Being a Bengals fan,its difficult to really draw a conclusion with Marvin Lewis and the players he drafted that ended up in a police report. Maybe he though he could be the one to turn these guys around into good citizens.
Taking players like Odell Thurman and Chris Henry is huge risk,huge return if it pans out.
I'm not going to fault Lewis for taking Chris Henry in RD 3.He wasn't a constant troublemaker at West Virginia.He had a on field incident in a game and was suspended a game. Football is emotional game.
He was a 1st RD talent that you got in a middle RD.Marvin and WR's coach Hue Jackson interviewed him personally. They felt convinced he was worth the risk.
Hopefully Chris has turned the corner.
As far as Odell Thurman goes,Marvin ever since he got to Cincy he has been looking for that playmaker at ILB. He had gone through guys like Kevin Hardy,Brian Simmons and Nate Webster with little success.
Thurman had some red flags for sure as a Bulldog. But apparently Lewis felt Odell had put his issues behind him.
Lewis took David Pollack in RD 1 and it made sense to draft his teammate in RD 2. I can understand the desire to want chemistry.Especially when its like getting 2 1st RD'ers in the same draft you already have ex Bulldog Robert Geathers at DE.
If Lewis wouldn't have drafted Henry and Thurman,some GM would have. They could mean difference makers to a team on the rise.
And in that 2005 season,they were difference makers......
I think Marvin Lewis is one of those coaches that believes in giving players second chances.
He drafted Ahmed Brooks in hopes he could turn it around..
Well so far Brooks has been a ideal teammate after a controversial career at Virginia....
but no one(media) wants to report that...it doesn't sell enough.

Bengals head coach Marvin Lewis said on a national radio interview Wednesday that he believes local law enforcement profiles his players.

Lewis, speaking on the Dan Patrick Show on ESPN Radio, used wide receiver Chris Henry's incident with Cincinnati police on March 25 as an example. Henry was stopped at 1100 Vine St. on March 25 for failing to use a turn signal. Henry was subsequently issued citations for driving without a license and failing to wear a seatbelt.

All of the citations were later dropped.

"I think there's profiling, no question," Lewis said. "We're (Cincinnati) a small place - our guys stand out, and they know that, and you've got to do things the right way. But when you are arrested for, or you are pulled over for, not putting on your turn signal, there's something wrong there.

"Many people make right turns without putting on their turn signals and it's unfortunate that we've had a guy that's pulled over for not putting on his turn signal."

Lewis did not return a phone message from The Post Wednesday evening seeking further comment.

Officers from the Cincinnati police public information office were not available for comment Wednesday evening.
