'Woman Shoots, Kills Home Invasion Suspect In Trotwood'

TROTWOOD -- A home invasion turns deadly when the homeowner takes the safety of her family into her own hands.

One of three home invasion suspect was shot and killed during the incident, and has been identified by the Montgomery County Coroner's Office as Azikiwe Presley, 29, of Dayton.

Trotwood Police were called to a home at the dead end of Atlas Road around 6:00 Monday morning.

Police tell FOX 45 three masked men armed with firearms forcibly entered and attempted to rob the homeowner.

"Any time you have a homicide or a home invasion of this magnitude it's unusual unless they're looking for something specific," said Trotwood Police Capt. John Porter.

Porter said the homeowner called 9-1-1.

"I got my gun and I started shooting and they ran," the female caller told dispatchers. "They all three had guns, I'm confused ... they must not have had bullets because after I pulled the trigger they just took off, instead of firing back. I don't know if I hit one or not, I don't see blood anywhere."

The three suspects were caught on home surveillance outside the residence, before they kicked their way inside.

Police say two kids were asleep inside the home in the room where the invaders kicked their way in.

"Most of them woke up to the sound of them forcing entry into the home they kicked the back door," said Capt. Porter.

The suspects headed straight for the female who called 9-1-1.

"He hit me in the head with the gun 'cause I was in the laundry room," the caller stated.

The victim told Trotwood Police the suspects then demanded she lead them to "the money," and that she complied, leading them into a back room where a safe was located and two other kids were sleeping.

Trotwood Police said two of the suspects tried to steal a safe, while the third held the victim and two kids at gunpoint. They say the homeowner was able to get away and grab a gun she had hidden in the room, then started firing shots at the suspects.

"I got my gun and I started shooting and they ran!" the homeowner told dispatchers.

One suspect was killed by the gunfire, and was later found outside by Trotwood Police.

Police say the deceased is a male in his 20s from the Dayton area, and that he was in the yard between the victim's home and another house, still armed with a TEC 9 submachine gun.

Two suspects got away, and police are still looking for them.

The victim told police she did not know what kind of vehicle the suspects left in, because it was not parked in view of her home.

Trotwood Police spent Monday evening questioning neighbors on nearby Glen Helen Road if they had any information about the invasion.

I'm happy her and her two kids are safe and okay.

We could pass laws that would only allow law abiding citizens to own a gun.
But I'm not certain criminals would heed those laws.They are,after all,criminals.
Wouldn't work any how.Those laws would somehow be deemed racist,or would deny some criminal of his constitutional rights.
The best solution is to just keep shooting 'em.Kill enough of them,eventually we'll run out of criminals.

I don't understand your point? I'm sure it's just as easy for them to get ahold of a stolen firearm/etc as it is their drug of choice. You make it seem like responsible people should suffer and have their rights stripped because the select few who decide to be criminals/irresponsible.

Taking away the responsible people's right only makes it that much easier for the irresponsible to carry out their agenda. But yeah, this is the age old, never ending debate on the proper way to handle gun control.

I'm going to guess that the woman who shot the intruders is not some angel though. A safe full of money that the thieves knew about points to some sort of illegal activity.

A similar story happened near where my son lives in Galloway - one of his neighbors kids got shot breaking and entering a house a few blocks away. The boy, who was 17 I believe, was shot and killed by the homeowner. They had bought drugs there before and knew there was cash as well as the drugs, tried to steal it and got killed. I believe that the woman was eventually arrested for something drug related.

Not saying that is what happened in this story, but it seems as if there will be more to it IMO. The burglars knew what was there somehow.

The issue is the incompetence in compiling and updating background info. Criminals and the mentally ill are already not legally permitted to purchase firearms, and the background checks are supposed to help prevent them from doing it. You can make the background checks more encompassing or more stringent, but they are only worth as much as the data is accurate. You can do a google search and see how inept the NCIS (background check system) is.

The problem isn't a lack of laws, it's the lack of enforcing current laws. There's nothing new to put in the books that will lessen the probability of criminals obtaining firearms.

There are other things that don't add up. They kicked down a door in a room people were in yet nobody was yelling and making noise. The mother also didn't hear them kicking the door in even though she was awake, and how long is it going to be before somebody starts screaming about her keeping a loaded gun in the house in a place where kids could easily get it?

They kicked in the outside door not the bedroom door and the woman called 911 as they were trying to get in the house.

If All this happened as they were trying to get in this whole story wouldn't make any sense.

The 3 guys kicked in the door and as they were doing so the woman called 911, when the guys got in they pointed their guns at the woman and asked her where the money was kept so she took them to the room where the safe was and where 2 of her kids had been sleeping and also where her gun was kept, when in the room two of the guys grabbed the safe and carried it out and when the third guy wasn't looking she grabbed her gun and started shooting.

Not Enforcing Existing Gun Laws—That’s A Crime

If anybody in Chicago is culpable for the armed carnage on that city’s mean streets, it’s Mayor Rahm Emanuel, who never misses an opportunity to blame peaceable, law-abiding gun owners for the daily bloodletting by violent Chicago thugs.

Emanuel steadfastly refuses to demand application of tough federal laws that would surgically rid the streets of criminals who currently terrorize many Chicago neighborhoods. And that represents a kind of aggressive political malfeasance.

For Emanuel—a former U.S. congressman, former chief of staff in President Barack Obama’s White House and former Bill Clinton White House gun-ban guru—to intentionally blow off federal laws punishing illegally armed violent criminals is especially vile.


The reason is simple. If Chicago citizens knew the extent of existing harsh criminal sanctions and that those laws could readily be applied to prosecute real criminals, Emanuel’s endless call for new “gun control” would be seen for what it is: an evil campaign to disarm the innocent. And those federal laws apply equally in every corner of the nation.

That reality goes for New York City Mayor Michael Bloomberg, and for every other mayor signed on to his phony national political machine, Mayors Against Illegal Guns. It also goes for U.S. Attorney General Eric Holder and President Obama.

A January 2013 Chicago Tribune story headlined, “U.S. struggles over which gun crimes to prosecute,” reported, “Obama’s Justice Department has shown little appetite to prosecute what it considers low-level firearms crimes… officials with the department said.”

If “low-level” prosecutions of the most violent armed criminals in Chicago were the norm, that city—with thousands of shootings and armed robberies added to its growing number of murders—would see scores of the worst violent gang members and armed drug dealers sent to prison in sure, swift prosecutions. That’s true for every city in America.

But Chicago, with the most vicious armed criminals in the nation, ranks 89th out of 90 U.S. Attorney districts. That ranking comes from Syracuse University’s Transactional Records Access Clearinghouse (TRAC), which provides the gold-standard review of federal law enforcement performance.

Given thousands of violent crimes involving armed criminals, including record numbers of murders every year, Chicago has seen pathetically few federal gun-law prosecutions: 63 in fiscal year 2011.

How many of the 506 murders involving firearms in Chicago last year would never have happened had Obama’s Justice Department taken criminals off the streets?

A simple look at the law answers that question. Everything real violent criminals do to acquire a firearm is already a serious federal felony. Under federal law, lying to a licensed dealer, lying on the form 4473, and straw sales are all federal felonies that are almost never prosecuted. Holder’s Justice Department calls them “paper violations.” Yet those are the very crimes that they say demand a “universal background check”—a national registration scheme—for all of us.

So let me cite—from a federal public defender fact sheet—a few of the existing federal statutes dealing with armed criminals once they have their guns. I’ll give you the prison term first along with the citations in the United States Code (U.S.C.).

• 10 years—18 U.S.C. § 922(g)—for possession of a firearm or ammunition by a felon, fugitive, or drug user… And possession means touching a gun, any gun, handgun, rifle or shotgun. Any firearm that Dianne Feinstein would ban for us, is already an illegal gun for violent criminals.

• 10 years—18 U.S.C. § 922(j)—for possession of a stolen firearm.

• 10 years—18 U.S.C. § 922(i)—for shipment or transport of a stolen firearm across state lines.

• 10 years—18 U.S.C. § 924(b)—for shipping, transporting or receipt of a firearm across state lines with intent to commit a felony.

• 5 to 30 years consecutive mandatory minimum sentences—18 U.S.C. § 924(a)(1)(A)—for carrying, using, or possessing a firearm in connection with a federal crime of violence or drug trafficking.

• The death penalty or up to life imprisonment—18 U.S.C. § 924(j)—for committing murder while possessing a firearm in connection with a crime of violence or drug trafficking.

• 15 years mandatory minimum—18 U.S.C. § 924(e)—for a “prohibited person” who has three prior convictions for drug offenses or violent felonies.

• 10 years—18 U.S.C. § 924(g)—for interstate travel to acquire or transfer a firearm to commit crimes.

So, if every possible aspect of acquisition, possession, transport, transfer of a firearm by criminals demands harsh and swift punishment under existing law, what is it that Emanuel, Bloomberg and President Obama really want?

I agree that it's not very smart, but I believe the kids are teenagers so it's not as likely an accident would happen as if it were young kids.

In my neighborhood just showing a weapon makes half the people faint.

In her hood, the kids would be fully trained to lay down grazing fire while I cleaned house.

Texas counts down the hours until new Open Carry law takes effect

Gun rights supporters in Texas counted down the hours, minutes and seconds to New Year's Day, because when the clock strikes midnight, licensed firearms owners in the Lone Star State can openly carry their handguns in public.

The non-profit group Open Carry Texas, which supports the law, posted a countdown on its website.

Texas already allows openly carrying rifles and shotguns, but has banned having handguns visible since just after the Civil War. On New Year's Day, it'll be the 45th and largest state to sanction some form of open carry, with California, Florida, Illinois, New York and South Carolina still banning it.

The woman never heard of asking, "Who's there?" Her husband is a cop so maybe they were expecting to be attacked that night or something but man to shoot your own kid because you're too stupid to ask a simple question before shooting is just plain ...

Sadly there are more of these stories than "home owner shoots intruder" stories. A lot more.

Yeah sorry not buying that one either...now if he said the media talks about shooting the wrong person more then the ones where they defend their home from the bad guys...I might be inclined to agree there.

Woman fatally shoots 27-year-old daughter after mistaking her for intruder, police say

ST. CLOUD, Fla. —Police in St. Cloud said a woman mistook her daughter for an intruder, fatally shooting her late Tuesday night.

Investigators said the woman was asleep in her bed when she thought someone had broken into her house and was quickly approaching her.

According to police, the homeowner fired one round at the subject, who was later identified as the homeowner's 27-year-old daughter. The victim was taken to Osceola Regional Hospital, where she later succumbed to her injuries.

"It's shocking, I tell you that much," said neighbor Harry Morris.

St. Cloud police officials said they aren't releasing the names of the mother or daughter since a person in their household is in law enforcement and Florida law permits the withholding of identities in such cases. Sources tell WESH 2 News the mother is a dispatcher with a local law enforcement agency.

"I was terrified. I was here with my daughters and we woke up when we heard the sirens and the lights were reflecting in the home. My dog kept barking," said neighbor Cynthia Rivera.

Police said the incident appears to be an accidental shooting, but the investigation is ongoing and is considered to be an open investigation.

"I mean, it's the holidays. It's very sad for any family member, especially a mother, you know, to accidentally kill their daughter. My condolences for the family. I'm imagining all St. Cloud is grieving as well," Rivera said.

Detectives are investigating the case but said so far the mother's story matches the evidence.

Wonder if she will be charged with ...

Negligent homicide is a much lower intent crime and is used as a charge when one person causes the death of another through criminal negligence. The charge does not involve premeditation, but focuses on what the defendant should have known and the risks associated with what he did know.

Not saying she should be but is her relationship with the police department having any bearing on this case?

Guess I should read more about it before assuming anything.

i remember a story a few years about about a homeowner trying to shoot somebody robbing the house.

a round ended up popping a lil a girl in the house across the street.
