New Smoking Ban To Affect Trucking Companies

HUBER HEIGHTS, Ohio -- Ohio?s new smoking ban begins on Thursday morning and will affect businesses all across the state.

However, the ban has caught an entire industry with thousands of employees off guard. No one told them they would be covered by the ban until now.

The ban will affect bars, bowling alleys, restaurants and offices, but now some employees are learning that the smoking ban will also affect trucking companies and their drivers.

On Interstate 70 in Huber Heights there has been a steady stream of trucks and now those truckers are about to hit a major bump in the road as the new smoking ban will include their workplace, which is the cab of their trucks.

Trucking companies are doing the best than can to follow the new law. An official at one trucking company said he will be announcing some changes in places and said he expects the employees to comply with them.

Another part of the dilemma is the law's rule that a no smoking sign has to be on every door, leaving trucking companies to place a sign on every rig.

The State Trucking Association said it now has to try and convince Ohio lawmakers to cut them out of the new ban.

It passed because other people know whats good for you. Same as the trans fat thing--other people telling you whats good for you. Tell me how to live, what to eat, what to believe. Hell, pretty soon we won't even have to think for ourselves, our sweet ass lawmakers will do it for us.

I could ALMOST see this as viable if the company has multiple drivers for a truck... if one day a smoker drives it and the next day a non-smoker drives it... then it at least makes some sense to me... but most OTR truckers drive the same truck day in and day out.... most dump truck, concrete trucks etc also have a primary driver who drives the same truck almost all the time...

and I will say that this is just living proof that the law has little to do with the second hand smoke health concerns.

well, not 100% true, but damn close.

The club has to be completely private and 'members only' with children not permitted in at all. I think you're also not allowed to serve food there and/or have like a D-4 liqour license.... or something like that.

Anyway, kinda learned all of that because my Elks lodge is dealing with it all as well now. We're a 100% private club, members only, etc... but because members can bring their families down it by law has to be a non-smoking facility, even in the bar area.

As for the odor being present the next day, this is not second hand smoke, it's an odor some may find unpleasant. I know you were clear to say almost, but if they are able to do it based on bad smells, where does it go from there?

And to the ref: I know the Ohio ban is different, I'm not sure of the specifics. In NY it falls under the safe workplace act and no place with employees can allow smoking. I believe there is at least a temporary exemption for "cigar bars" specifically, but I'm not even sure about that.

That is the way I understood it to be here also. And there is no exemption here for cigar bars.

I think ours was a temporary stay. I know that a local place that was sort of a cigar bar in that it was next to a bar and had an open common area, is now walled off. Incidentally the bar now boasts an "space available" sign. I also have two friends who closed bars they worked all their lives to get over this.

funny how Ohio will take this strong of a stand, yet we remain as a state one of the worst offenders with regard to factory pollution air quality. Two or three of the worst toxin spewing power plants call Ohio home.

Here is the definition of private club in the issue:


(G) Private clubs as defined in section 4301.01(B)(13) of the Revised Code, provided all of the following apply: the club has no employees; the club is organized as a not for profit entity; only members of the club are present in the club's building; no persons under the age of eighteen are present in the club's building; the club is located in a freestanding structure occupied solely by the club; smoke from the club does not migrate into an enclosed area where smoking is prohibited under the provisions of this chapter; and, if the club serves alcohol, it holds a valid D4 liquor permit.

My understanding of the rule and i'm only 1/2 way through reading it, but yes, if your a company in Ohio ( collecting money for services rendered) and pay taxs on that money than your a company, an you are under this law, it dosent matter if your self employed or not,. Thats my take, best bet is to call your local chamber of commerance or your lawyer.

You are right GM and the worker's I believe have to be voulenteer's but they can get away with paying them under the table.

Guess Ohio going through same thing has Erie with a smoking ban. But I'm with this ban because I would like to go to a bar or some other place and not come out smelling like smoke. <img src="/images/graemlins/plthumbsdown.gif" alt="" />

Besides most places in erie except bars are going non-smoking.

I've pretty much had enough of it. Since I'll be going back to work by the end of February,I'm seriously thinking of going on the road,out of state to work. I've looked into it already. Great wages and mainly working in southern states that have little to no smoking restrictions.

Because here,I won't be going out to dine,won't be going to any bars to watch the games anymore and just don't feel comfortable in such an environment.

People vote for issues they don't understand the impact of. They don't seem to understand,that the other issue called for seperate rooms,with walls,dividing the smokers from the non smokers. They didn't bother to see,that their rights were protected under a moderate measure. But instead,chose to vote for a proposal that infringed on my rights.

It's a shame that people don't open their eyes and comprehend what it is and what it is not,that they promote. All the bill that was passed promoted,was hurting businesses and putting many of those businesses out of business.

I a copy of the new law, smoking is NOT prohibited in privet residences, expect during buisness hours of operation as a chil care or adult care facility for compensation, during the hours of operation as a business by a person OTHER than a person residing in the privet residence.....basically if you work at home and other people who dont live there are present you cant smoke, but if you and other people who do live thier are present you can smoke,

Family owned and operated places of employment in which all employees are related to the owner, but only if the enclosed area of the place of employment are not open to the public, .....basically if you work at home and the public dosent come in to your residence, than you can smoke, ....

Now if you own your own truck and the public isnt welcome, ( Lot lizards...... <img src="/images/graemlins/rofl.gif" alt="" />) are not brought in than Can you smoke, my reading according to this rule is yes..)

Sunday permits are D3 i think & they are mucho $$$

Florida has a smoking ban that includes all public buildings and any restaurant/bar that serves food. Clubs, as long as no food is served, are allowed to have smokers.

Because of the nice climate here, most restaurants now have outdoor patios for diners that wish to smoke during dinner.

While the smoking ban is good for me, I didn't care either way, I was perfectly happy with the practice of "smoking & non-smoking preference" that was merely market driven rather than government enfoced.

Yes and I believe some maybe allowed to stay smoking but I'm not to sure of the details. Suppose to be voted on tonight.

Guess all bars are gonna have to go nonsmoking, must of changed from last time I read about this ban. Like I said, I'm still for the ban but at the same time fair amount of places are going nonsmoking.

when I was up for the bungles game <img src="/images/graemlins/frown.gif" alt="" /> I had a nonsmoking room but smoked anyhow! Well just got my credit card bill and there was an extra $250.00 charge for smoking in the room! Now that is 4 expensive cigarettes!

Alot of bars are still smoking (mainly downtown) which I think they want to target along with other places where people still smoke. Which its mainly bar owners who are complaining that they'll lose business but I doubt they will since other nonsmoking places are still doing good.

At the meeting last night 50 people came in support while 7 came against so the public wants it so health board and council decided to put up for vote.

People dont what others to have choices, they want them to be banned...smoking now, whats next, sick people....if you've been sick in the last three weeks, or had a tempurature above 100 degrees, please take a seat in the east side of the resturant, behind the wall....Some dont wanna smell others smoke, well I sure dont wanna catch other peoples colds....why not, some may laugh....it's comming, <img src="/images/graemlins/thumbsup.gif" alt="" />

Sure that's right? I think in a smoking ban law it should read no more than 20% of the room can be designated SMOKING room.
