Update: Surry Co. prosecutor 'somewhat upset' by Vick property search 06:07 PM EDT on Friday, June 8, 2007 Two parallel investigations are underway into whether dogfighting occurred on Surry property belonging to Michael Vick, Commonwealth's Attorney Gerald Poindexter told 13News Friday. Surry County is still considering charges in the case and Poindexter says it appears the U.S. Attorney's Office has an investigation of its own, after federal authorities conducted a search of Moonlight Road property Thursday. ESPN Radio is reporting that nearly three dozen dog carcasses were found. Poindexter said he does not know what was found. Poindexter did call Thursday's search "a breach of protocol" and says he found about it around the same time federal authorities began scouring the grounds for evidence. Watch the report "I was somewhat bothered by it and upset," Poindexter said. "I didn't realize the U.S. Attorney's office had any interest in running an investigation." He says he does not know why the feds suddenly swooped in and did a search without Surry County. He questiosn whether it could be racially motivated, or if the feds are targeting the celebrity in Michael Vick. "I just can't believe that they would've been here if it were not Michael Vick's property," Poindexter said. He also said he and Surry Sheriff Harold Brown were preparing to file a search warrant of their own but will likely abandon those plans. "What's the point in going back now?" Poindexter said. He said the USDA will likely share the results of their search with Surry investigators, who are still moving forward with their own investigation. Federal investigators from the USDA obtained a sealed search warrant in Richmond before going to the property after informants said the remains of many dogs were buried on the property behind the two-story home. Poindexter wonders if the fed's search was racially motivated. That's a good question and should be examined. But when we're looking for answers lets also ask if the lack of any search by Poindexter and Sheriff Harold Brown wasn't also racial? If they had a problem with the wording of their search warrant (that warrant expired yesterday) what steps were being taken to correct the problems other than sitting on their butts waiting for it to expire?

i like this new commisioner...
just last february, someone brought a puppy into the police station, it was running around the streets, apparently someone had just let her go, we kept the dog, and it was the first time i've ever had a dog for a pet, and after hearing about michael vick and what he does, it makes it that much worse, i didn't realize how much of a part of your family a dog is...
it sickens me that he would be involved with something like this, or at least is involved with people who are involved with this (which is almost as bad)
if i'm the atlanta falcons, i cut this guy right now, because the only publicity the falcons are getting is bad pub... and really they aren't that bad of a team, they shot themselves in the foot by getting rid of schaub, but i'd make a trade, maybe for a daunte culpepper, or someone to fill in, and next year, i draft a qb, maybe they go after brian brohm with the whole bobby petrino connection...

My family being from the south,I pretty much know how "local law" works in the south in many cases. I'm pretty sure the Feds do to.

Ummmmmm .... I believe the main part here should be the 36 or so DEAD DOG CARCUSSES and not WHY it was done ... and guys .... i am sure soup and rage will be here soon to straighten it all out and let us know how wrong we are on many levels and to let us know boxing is MUCH MUCH WORSE .  this guys GUILTY AS SIN ... and I didnt need 36 or so dog carcusses to prove it .. but like Barroid he will never be charged and if he somewho is like OJ he wont be convicted ... but thats OK .. hes a DUMB ASS that has to live with himself everyday ...

I don't think this was racially motivated.....but I do think the Fed's would not be there if not for the celebrity status of Michael Vick. Because Michael Vick is a celebrity, this is all over the news everywhere so this has become high profile and they get involved.
I hope the nail guy.....I saw interviews where they claim Vick is the "Big Roller" at these things....there is no way on God's Green Earth that he did not know what was going on there....And I while I cannot prove it in any way, I would not be suprised by any means if it comes to light that he did participate....Goodell would then be the least of his worries....
I thought I was wrong once....but I was mistaken...
What's the use of wearing your lucky rocketship underpants if nobody wants to see them????

That was my thinking too Pit... The sherriff's office and the DA down there have struck me as crooked as hell from the reports we've gotten. Nice to see the Feds stepping in.

Well PPE,my dad dated a woman from a small town in Kentucky. I won't mention the town for obvious reasons. But one of her brothers was the preacher and the other the town law. Let's just say they knew where the moonshine,marijuana,bootleg joints,prositites and every other major illegal activities around that area were. And they lived pretty good for what they were making. Everybody knew everybody. And I know for a FACT that in some Kentucky counties,they play HELL getting a "jury of their piers" to convict them of growing pot even today. And as you mentioned,there's been some,what I percieve to be "red flags" on this thing. So I think the Feds stepping in may just be "something for this local law" to be worried about. Never know if they're "just investigating Vick" or not while they're there.

I have only one question.. Did Vick know dog fighting was happening on his property?
If they answer is yes, Fry him... If the answer is no, then what are you gonna do, hang a man for something he had no knowledge of? I think not!

Well, this is the end of the road for Mr. Vick.. first off, dog fighting is illegal in Surry. I'm sure dog murder is higher up the ladder.. SICK VICK, JUST SICK

Vick will get what he deserves if proven to be guilty of anything...and it doesn't look good...but looks and facts are two different deals..but he won't fry as some want......he won't get 15 years either.....not for dogfighting
The key right now is the Federal involvement..they must have some evidence this operation was big.....mostly the gambling aspect....now if RICO charges apply, Vick could be looking at some serious challenges in the court that could have charges that are measured in decades rather than dollars and days.

It's just an expression Peen, I certainly don't expect him to be electrocuted for sponsoring, allowing or instigating Dog Fights on his property..
But my question remains, did he or did he not know of the Dog Fighting on land that he owns or owned?
Is Dog Fighting illegal in Georgia? If it is, and if he knew and did nothing about it or if he promoted it in any way, he's guilty and should be punished to the extent the law allows. But that's JMO,

That's the whole thing here Peen. Now God knows (and you do too)  that I'm no legal expert.And I'm not making "assumptions" here,but since the Feds seemed to have jumped in with both feet,that they're not simply looking at dog fighting and animal cruelty. IMO- Be it real or just suspected,that they're looking deeper than that. Which could include,but not limited to,racqueteering,income tax evasion and a "syndacite/organized crime" type of operation. And it may not be limited to Vick. It could also include the Surry law enforcement and DA that are being investigated as well. Let's face it,the only way they really managed to get many of the Mofia ( even though there really is no such thing )  bosses and families prosecuted,were by and through such laws. And I'm glad the Feds are starting to realise just how much money and just how terrible this practice really is. It's a shame that the threat of "decade long sentences" is what it takes to stop this mass animal cruelty based on greed. But whatever it takes,I'm all for it. JMHO

I read that the person on ESPN Radio told Dan Patrick that they "suspected" and that they "thought" up to three dozen carcasses COULD be found on the property. I station out of Jacksonville reported that 30 carcasses HAD been found, but retracted that statement after misinterpreting Patrick's comments. Will carcasses be found? Probably, but alot of these reports have been misinterpreted/retracted.

VICK HAD "DOG YARD" IN SOUTH CAROLINA
The Atlanta Journal-Constitution reports that Falcons quarterback Mike Vick had a "dog yard" in South Carolina, and that a former South Carolina prosecutor assumed that the animals were "fighting dogs."
William Frick was the lead prosecutor in the David Ray Tant dog fighting case. Tant pleaded guilty, and he was sentenced to 40 years in jail.
Coincidentally, a South Carolina prison inmate recently contacted officials in Surry County, Virginia regarding Vick's involvement in dog fighting. Could the guy in question be Tant?

I've said this a couple of times when this "dogfighting" thing came out from Vick and the Falcons traded Schuab..... $10 says Pitrino drafts Brohm in next year's draft.

Yeah, right now all anyone is saying is that they SUSPECT things.. It's not been proven and it hasn't been argued in a court,, So, what do we really know,,, NOTHING!
It may be the old "smoking gun" thing. Then again, It may be nothing at all.. What's the saying, "Much ado about nothing"!
All I will ever say is this, if there WAS dog fighting going on, and if it was indeed on property owned by Vick and he indeed did know about it, then yeah, hang him high (an expression only).
But until that time, he's got to be presumed innocent! Too often we are ready to convict someone without proper investigation....

Virginia Law says that
Animal fight, gambling - is a 3rd degree Misdemeanor Animal fight, dog fighting - is a 6th degree felony Dead dog, failure to dispose of - 4th degree misdemeanor Dogfighting, permit on premises, aid and abet - 6th degree felony Dog offense, maiming, killing or poisoning - 1st degree misdemeanor
Sentences & Penalties: 6th dg. Felony: A term of imprisonment of not less than one year nor more than five years, or in the discretion of the jury or the court trying the case without a jury, confinement in jail for not more than twelve months and a fine of not more than $2,500, either or both.
4th dg. Misdemeanor - A fine of not more than $250. 3rd dg. Misdemeanor - A fine of not more than $500. 1st dg. Misdemeanor - Confinement in jail for not more than twelve months and a fine of not more than $2,500, either or both.
So, at first glance it doesn't amount to much.... unless it is a separate charge for each animal... then it adds up quick (which is probably how that Tant guy got 40 years).

There WAS dog fighting going on. IMO that's not even debateable. There was enough evidence taken from the property to KNOW that much was happening.
As to Vick's involvement,that's where the question is. And much like you,I felt it was a "smoking gun" and am waiting for the results. But when the DA there pretty much "refused" to execute a warrant signed by a judge because he "didn't like the wording" and the local law has started making accusations against the Feds in regards to "celebrity status and racism"???????
From my point of view it's gone from "smoking gun" to "If it walks like a duck and talks like a duck,it's probably a duck."
Not saying Vick IS guilty,but when the local law started dragging their feet and the Feds stepped in? The likelihood and probability of it being more than a "smoking gun" raised signifigantly in my mind.
