From The Neighborhood News June 13, 2007 edition front page

Several customers of the Wal*Mart at City View Center reported thefts of their credit and debit cards when they used them to make purchases at the store recently, Garfield Heights police said.

Apparently, one or more employees at the Transportation Blvd. store did not give the cards back after completing the transactions for customers, then used the stolen cards to make unauthorized purchases, which could end up totaling in the thousands of dollars, according to the reports.

A Wal*Mart loss prevention agent spoke with police on Friday, June 8, stating that an employee had been ringing up merchandise for customers, taking their credit cards to swipe them and pay for the merchandise.

The employee would then place the customers' cards to the side and wait for them to leave, place the cards under the cash register, and return a short time later to retrieve the card, the agent told police. The thefts were recorded on surveillance video, which was shown to the officers.

The thefts of the cards occurred between Friday, June 1 and Thursday June 7, and a total of five cards were taken. The store had received calls from at least two customers, stating that they did not get their cards back after paying for their merchandise.

One customer told police the employee asked her for her driver's license along with the credit card, put the credit card to the side, and gave the driver's license back along with what she thought was her credit card wrapped in the receipt.

When the customer got home, she noticed the card was missing and waited until the next day to contact the store. However, when she called her bank to report the theft, she learned that almost $400 in purchases wree made on her account.

Other customers who had visited the Wal*Mart between Wednesday, May 30 and Friday, June 8, called police to report similar accounts of thefts against them, and numerous unauthorized purchases, including at Ruby Tuesday, Taco Bell, a Wal*Mart in North Olmsted, Ohio, Uniek Creations, International House of Pancakes, Discount Beauty Supply, several gas stations, and several other unknown locations.

The incidents were referred to the detective bureau for further investigation.

I would think they could be since the people were actually working for Wal-mart at the time... if they did this off hours on their own then of course Wal-mart isn't responsible... but since they were working the register... yea, Wal-mart could be liable...

And if it's only in the low thousands, Wal-mart would be well served to just stroke a check to these people to cover their losses so this doesn't get out of hand...

One may argue that it is the customers duty to assure they receive their property returned to them at the time of the transaction, but I say the object of the felon running the register was deceit, and to obtain the cards by deceit, and being employed by Wal*Mart at the time of the act makes the store just as responsible as the felon who committed the act.

I agree. The guy was playing the shell game with them, it sounds like he would put the credit card down so if they asked, he could easily grab it and not look suspicious, but he didn't make it obvious and hoped they wouldn't ask... I wouldn't say Wal-mart is equally responsible but since he was working at the time, I think they would be accountable for something.

That store at City View Center is a new store, just opening about a year ago. I went there once, and I had a problem, but the sales associate was more interested in a personal coversation she was having with a customer about how nice the Drakkar made her skin, and who sold it in the area (not Wal*Mart) and was not in the least wanting to assist me at the self scan register (it was buzzing for an associate) I decided to leave my $180+ worth of merchandise on top of the register check out and walk out of the store, and I swore that I would never return to that store ever again, and now I see that I made the correct decision.

Perhaps. I do agree, the employee doing this was an employee of wal mart, so I would think wal mart is/should be responsible for the "fraudulent" charges, however, wal mart is not as guilty as the person doing it. The person that did it should be in court for card fraud, theft, theft by decption - etc.

I guess what I'm saying is wal mart probably is "guilty" of having a bad employee and will probably pay the charges. However, the company is not guilty of the "crime", the employee is, and should be held accountable in a court of law. But that is my opinion, and nothing more.

And if you do that, you TOO can sue!

Personal responsibility - that's what's lacking here. But, wal mart will pony up, the employee will be fired, but probably nothing else will happen to them, as wal mart will be sued, and most juries are going to look at the person that got defrauded and say "yes, you deserve something", and then they'll look at the clerk that did it and say "golly, it's tough getting by these days", and then they'll look at wal mart and say "you pay".

This might surprise you, but a lot of people don't carry a lot of cash (or any) with them.

There is some personal responsibility here that lies with the people that didn't get their card back, but with the woman that got what she thought was her card and her driver license wrapped up in a receipt, that is deceit, and she shouldn't be liable for any fraudelent charges to her account, and should get punitive damages awarded to her.

I know many people don't carry cash, I get stuck behind those idiots at Wal-mart every other week, while they fumble thru purses for credit cards, or worse yet check books

If the punitive damages come from the employee that did it, fine. If the punitive damages are expected to come from wal mart, I don't agree.

They were all deceit and this woman deserves the same treatment as the others.. Heck if one of them got their card back and dropped it on the floor while attempting to put it in their purse, that still doesn't give the schmuck at Wal-mart the right to use it...

No offense friend, but if you've ever been shopping with 2 or 3 little kids who are pulling candy off the rack.. you've got a full cart load of crap... trying to pay attention to make sure they don't sit the milk on top of the eggs... forgetting to get your credit card back isn't that unrealistic... and doesn't make a person an idiot... it happens.

And no, it's nothing like leaving your kid in the cart...

I know this is hard for some people on here to understand.. not necessarily you, but some... even responsible adults can make a mistake. It does happen from time to time.. In reading some peoples posts, maybe it doesn't happen to everybody, but I can only speak from my own experience. Sometimes I get caught up in things and forget something simple or I make a stupid mistake... Unfortunately I'm not part cyborg like some of our posters who process information at warp speed and with pinpoint precision which renders them incapable of making mistakes...... Me being human and all, I make mistakes.... But the jist of my point was quite simple... given the choice of losing track of my kids and risking forgetting my credit card.... I'll forget the credit card.....

I use my debit card, which is run through the small keypad BY ME before they are done scanning my items, and then, BAM, they hand me my receipt and off I go.

Who the heck still hands a card to the clerk anymore? And who goes to WalMart, I quit going there years ago because the service sucked, I don't know Spanish, the isles are narrow, the client el are selfish bastards, and the parking lot is a disaster.

So unless it 2am and I need something right now, I avoid WalMArt at all costs.

AHH the advantages of small town life I still get a good parking space, the store is clean, they all speak english, and the isles are wider than the local small groc. stores. But many people still hand the cashier their credit/debit card and write checks

People make mistakes?

I know I've left my card in the drive up ATM more than once when I had 4 clients all talking to me at once while I was trying to get cash.

In this case I wouldnt be surprised if the crooks involved did a lot to distract the customers to "assist" them in making a mistake.

Or the thief may have been very selective and chosen people who were already highly distracted. ie.......Like DC said with three kids,on their cell phone,couples argueing,etc.....

If the victim is quite preoccupied to begin with,it would make for a much easier target IMO
