Court rules woman, unaware of husband's pot, can keep half of home BRANFORD, Conn. - A woman who claimed she was unaware that her husband was growing pot in the basement will get to keep her half of their house, while the government can seize her husband's share, a federal appeals court has ruled. The 2nd Circuit U.S. Court of Appeals said in a ruling Wednesday that Harold Von Hofe must forfeit his interest in the home to the federal government. However, his wife, Kathleen, does not have to because she wasn't actively involved in her husband's marijuana cultivation. "The record is devoid of any evidence indicating her use of drugs or her involvement in any criminal activity whatsoever," the appeals court wrote. Von Hofe, who was a teacher at Branford High School, and his wife were charged in 2001 after police raided their home and found 65 marijuana plants, glass smoking pipes and other items associated with growing marijuana. Harold Von Hofe pleaded guilty to manufacture or distribution of a controlled substance while Kathleen Von Hofe pleaded guilty to possession of a controlled substance. Both avoided prison time and received probation. The Von Hofes' attorney, Jonathan J. Einhorn, said Kathleen Von Hofe could get a mortgage for the government's half-interest in her home. As of Wednesday, the couple remained in the house, valued at $248,000. They have lived in the home since 1979 and don't have a mortgage. Only a women could get away with this bold face lie. If this is true, she has to be the dumbest women on the planet, and if a man were in her shoes he would be doing some jail time or at least be on probation as well.
As for marijuana, only losers would smoke this crap, why someone would destroy their body is beyond me, but if you smoke pot get help now, it's nothing more then a gateway drug for other illegal substances.

Do you have any proof that it's a gateway drug? Most people I know who smoke pot do just that..smoke pot. They're not mustache-twirlling evil Columbian drug lords with cocaine piles the size of watermelons.

The man did grow it and was convicted for that with...................no jail time.  It's all about the money baby. It has nothing to do with "jail time".

Yep it really is all about the money. I knwo some people who ahve come out of jail saying exactly that. "I wouldn't have even went to jail and got probation, but the state made like $40,000 off of me".
People who think there is no money being made from people going to prison are naive.

I don't need proof for my opinion. As for the people you know, I don't care, but it's funny you say MOST, that tells me some of them moved onto other drugs, which basically made it a gateway drug for them. Thanks for proving my point, though it might not be a gateway drug for everyone, it is to alot.

I am far from hating on people, I just gave my opinion. I will say this though, if I can change one persons thoughts about how bad drugs are, then that will make my day. To be honest though, I never surrounded myself around people who abuse themselves using drugs, so I can easily see if some see my views as being one-sided, but I would rather have my one-sided then to be a junkie. Pot is against the law and anyone who uses it is a criminal, and until the law changes (which it won't) my views won't change either.

I think Chunk brings a lot of this on himself with his abrasive attitude, but, really, there's no need to say things like 'I'll bet you're the life of the party'...I know guys who don't touch anything that, in fact, often are the life of the party...making statements like those are no different than him calling people who smoke pot 'junkies'.

The law has never really influenced my decisions on doing something illegal. If I'm going to do something illegal, my first thought isn't that my actions are against the law and I could get arrested or fined for them, but simply that maybe it isn't a good idea. I follow my common sense more than a white sheet of paper with black ink on it.
