Ohio father of 4 bids farewell before deportation to Mexico

An Ohio father of four had an emotional farewell with his family this morning before returning to Mexico.

Jesus Lara Lopez, who worked at a Pepperidge Farm facility in Willard, Ohio, was seen off by family and about a dozen supporters at Cleveland Hopkins International Airport this morning, according to The Cleveland Plain Dealer.

When Lopez checked in with immigration officials in March, he was told he was being deported under "an illegal immigration crackdown," his lawyer David Leopold told the press this morning.

Lopez has been in the country for 16 years, and his children were born in the U.S., the Plain Dealer reported.

A federal immigration judge first ordered Lopez removed in 2011, Khaalid Walls, the Northeast communications director for Immigration and Customs Enforcement, told ABC News.

In 2014 the agency granted Lopez a stay of removal, Walls said, adding that "in a further exercise of discretion, the agency has allowed him to remain free from custody to finalize his departure plans."

"The agency will continue to closely monitor his case to ensure compliance," Walls said.

He said that ICE could not confirm for ABC News whether Lopez complied with its request until after he is "successfully repatriated," for operational and security reasons, but would try to provide an update on his status later today.

Trump's 'deportation force' begins to take shape

ABC affiliate WEWS-TV in Cleveland reported that Lopez had never been charged with a crime during his 16 years in the U.S., has paid taxes and did not receive food stamps.

Walls noted in response that the lack of a criminal record does not necessarily exempt an unauthorized immigrant from deportation.

"As Secretary [John] Kelly and Acting Director [Thomas D.] Homan have stated repeatedly, ICE prioritizes the arrest and removal of national security and public safety threats; however, no class or category of alien in the United States is exempt from arrest or removal," Walls told ABC News.

Leopold told WEWS-TV that his client had a valid work permit. The New York Times reported in June that Lopez worked "the graveyard shift packing Milano cookies and Goldfish crackers" at Pepperidge Farm.

ABC News reached out to Pepperidge Farm for a comment about Lopez's work permit, and the company said he was hired by a third-party company, Spherion, which manages packaging workers at the facility. Spherion confirmed for ABC News that Lopez had a valid work permit and it hired him in October 2016.

"These are the darkest times I've ever seen as an attorney. When the best and the brightest that we have to offer are taken from their homes and sent away," Leopold told reporters. "The law is so broken."

America's Voice, an immigration rights advocacy group, posted a statement on its website criticizing the deportation of Lopez from John Sandweg, a former acting director of ICE and a former acting general counsel of the Department of Homeland Security.

"Cases like this are an incredible waste of ICE resources that only make it harder for the agency to identify and remove dangerous criminals," he wrote. He added that he believes enforcement resources should be focused on finding criminals and public safety threats instead.

Sandweg has been a vocal critic of President Trump's broad promise of reducing illegal immigration to the U.S. a central part of his 2016 campaign.

The U.S. was already focused on enforcing immigration rules during the presidency of Barack Obama, who oversaw the removal of more than 2.5 million people through immigration orders, earning him the nickname deporter in chief.

"The [Trump] administration's focus on the low-hanging fruit of the enforcement system only allows the bad guys to remain at large, weakening our public safety," Sandweg added.

WASHINGTON ― Rep. Greg Gianforte, the Montana Republican who pleaded guilty to assaulting a reporter the day before his election, does not want to be treated like a common criminal ― for more than a month, he has been quietly fighting a court order requiring him to get fingerprinted and photographed at a local jail.

The lawmaker was charged with misdemeanor assault for “body-slamming” The Guardian’s Ben Jacobs after the reporter asked a routine policy question. Gianforte was not arrested for the May 24 assault ― law enforcement officials cited him for it a few hours later. Montanans the next day elected the wealthy tech entrepreneur to the House seat Republican Ryan Zinke had vacated to become President Donald Trump’s Interior Department secretary.

Gianforte entered his guilty plea on June 12 and was fined $300 and ordered to pay $85 in court costs. He also was given a 6-month deferred sentence and ordered to perform community service, attend anger management counseling and appear at the Gallatin County Detention Center to be photographed and fingerprinted.

But Gianforte demurred from the latter part of his punishment. Just a few days later, his legal team filed a motion arguing that the county’s Justice Court does not have the authority to force him to be fingerprinted or photographed because, among other things, he was neither arrested nor charged with a felony.

Gallatin County Attorney Marty Lambert plans to file a response to Gianforte’s motion on or before Friday, he told HuffPost.

Gianforte, 56, was silent at the U.S. Capitol on Tuesday when HuffPost asked why he was fighting the court order. When asked whether he believed other Montanans cited for misdemeanor assault also shouldn’t be fingerprinted and photographed, he walked into his office without comment.

Gianforte’s spokesman declined to comment, and his attorneys did not respond to requests for comment. Jacobs also declined to comment.

The motion filed by Gianforte’s lawyers appears to hinge on a “really narrow section of the law,” said Andrew King-Ries, a professor who teaches criminal law at the University of Montana. Whether the court has the authority to order Gianforte submit to fingerprinting and photographs is an “open question,” King-Ries said, but requiring such actions for convicted defendants is “probably fairly standard operating procedure.”

The debate over the scope of the government’s power to collect personal information raises “really interesting public policy questions,” King-Ries added. But “that debate is not part of the motion,” and Gianforte doesn’t appear to be making a broad philosophical argument, the professor said.

The fact that Gianforte wasn’t detained or arrested after Jacobs immediately reported the assault isn’t necessarily unusual. There was “no existing circumstance that required immediate arrest,” Gallatin County Sheriff Brian Gootkin said at the time, and Gianforte was not a threat to public safety or flight risk. (Gootkin donated $250 to Gianforte’s campaign, but denied his contribution had any impact on the investigation.)

Gallatin County Justice Court Judge Rick West said in June that he thought “some jail time here would be appropriate” for Gianforte, according to the Missoulian newspaper. The judge wanted to sentence him to four days in jail, which would be converted to two days in a work program that could include tasks like picking up trash on highways. But after West realized that the work program was not available to people who commit violent crimes, he settled on community service and anger management counseling, instead.

Gianforte in early June sent a letter of apology to Jacobs—after initially blaming him for the fight—and donated $50,000 to the Committee to Protect Journalists as part of an agreement in which the reporter agreed to forgo any civil claims. The people of Montana “want us to move on,” Gianforte said.

His critics, though, find his effort to avoid being fingerprinted and photographed at odds with that comment.

“Greg Gianforte claims he has ‘taken responsibility’ for assaulting a reporter who asked him about health care, but he continues to do everything in his power to fight a routine criminal procedure resulting from his conviction,” Nancy Keenan, executive director of the Montana Democratic Party, told HuffPost in an email. “No matter what he says, it’s clear to Montanans that Congressman Gianforte has not taken responsibility at all. He’s hidden from it.”

I was not trying to make this about Trump's policies. I was trying to get people to understand that there are human beings behind these stories.

Americans commit a ton of crimes and get away w/them. Then, all of a sudden, someone who looks different from us and speaks another language comes into the country in search of better opportunities [just like our ancestors did] and we start talking about the "law." LOL

I am going to tell you something and I want y'all to listen real close: I was appalled when I first had to deal w/teaching illegals, but after teaching many of them over the years and getting to know many of their families, I can unequivocally say that they are some of the most polite, humble, soft-spoken, respectful, law-abiding [yeah, I know what's coming, but I'm talking about once they are here] people I have ever, ever met!

I will also add this..........I live in the south now. A lot of people in the neighborhoods that I live in [upscale] do not want to do their own work, such as yard work, house cleaning, painting, minor repairs, etc. These illegals provide a service that other people in this country generally don't want to do.

I really feel that this issue comes down to prejudice and bigotry. Perhaps even racism. Many of the past targets are now off limits in public forums, but there are a couple that allow bigots to feel safe in expressing their true feelings.

As always, my message is to judge each individual as a separate entity rather than assigning generic labels to entire groups of people.
