This is the $100 question.

I researched what I could find out on the world-wide-web about this case.

From the court of rockyhilldawg, I've speculated (key word) that:

The dissenting/unconvinced jurors felt murder or voluntary manslaughter wasn't proven.

I think these charges need "intent", "intent to kill".

That seems reasonably questionable - that Officer Tensing intended (or knew his actions were likely to) kill DuBose.

Where's BardDawg when you need him? (he's probably a patent attorney anyways)

This is getting ridiculous. A lot of these crooked ass cops continue to get off.

Seems like the law works perfectly fine when it's going after us, yet when it comes to cops, rarely anything happens.

And yet people say I should have trust in law enforcement and the justice system.

There isn't a single reason why I should.

That seems to me like a trend I see in these cases, the public demands or overzealous Prosecutors go for Murder or Voluntary Manslaughter and can not prove their case to that level.

It seems to me that the police have a catch all phrase that excuses pretty much anything and everything they do.

The vast majority of cops do serve and protect. But just like any other profession, there are bad apples. I am however tired of seeing them get away with murder.

They could still at least got him with assault with a deadly weapon. Or something less than murder.

People go to prison for long stretches for less.

I didn't want to start a new topic for this, and to change the subject a little bit:

I was talking to a guy at work and he was telling me about how him and another guy caught a few kids breaking windows at their Church and they held them for the Police. I guess when the Cops arrived they took the kids away but one of the Cops told him that he could arrest him if he wanted to, and the guy says What?? He said that since he touched the kids that he could arrest him....Does anybody know if this is true? It happened in Ohio and I've never heard anything like it. Do some of our legal dawgs know anything about this?

Edit: I guess I should add that these kids were minors and the Cop told him that adults are not allowed to touch monors, I think this stinks...

As far as the mistrial, it does seem, as the jury split evenly, that the case was over-charged. (as others have suggested) I don't know all of the details, but when cases constantly hang, maybe it's time to charge a slightly lower crime, and get some part of the punishment you feel the defendant deserves.

why would conservatives watch trevor noah? you should know by now that the last people *most* conservatives are gonna listen to is a black liberal dude on TV.

It's pretty freaking telling when the most afforded groups of the country can't get off of all charges. That shows some serious misdoings. I mean, could you imagine any other group who is privileged enough in court and charging? If you shoot someone, you're probably in your own jurisdiction, which means your coworkers will now be investing the case. These coworkers who form societies, unions and fraternities with. Then the DA, whom you have some relationship with via court procedures, decides how to charge you. Then you're prosecuted by a fellow city employee who works closely with the police department? Our system is such a joke in this regard. It wouldn't be a problem, but it seems like many can't stop shooting black people threats based on their own paranoia.

A New Jersey college professor who appeared on “Tucker Carlson Tonight” to defend a black-only Black Lives Matter event has been fired after the college's president said she made racially insensitive comments on the show, according to reports.

It is a part of the problem. That said,vI agree, not sure how it ties in other than some others saying we should watch some guy I have never heard of and comments how conservatives don't listen, as it has been proven over and over, accoring to some.

I'm talking about how you constantly throw around the terms Conservatives [as if they are godlike] and Liberals [as if they are the devils] and refuse to acknowledge the topic at hand.

What do you think about the case, 40? Was it murder? Should he be convicted? Should he get off? Was the victim the aggressor? What do you think about the mistrials? We all get that you blame the "libs" for everything. Try something new and actually dig deeper into an issue rather than assigning you stupid-ass labels!

Okay, you wondered why the first mistrial occurred and then you said the prosecution was overzealous. That's progress.

What do you think of the shooting? Did the victim deserve to be shot? Was the shooter justified in shooting his victim? Are you concerned w/the results of most of these trials?

I'm probably more on your side in this than you realize, but talking about liberals and conservatives in this situation is pretty freaking lame. Your one answer fits all is absurd.

I think you're giving an overly rosy picture of what an officer goes through after a shooting. My understanding is internal affairs is brought in and investigations are usually done by people who are not acquainted with the officer. Maybe Devil or somebody else can give more details.

Also think about what officers have to go through in some of these cities, dealing with the dredges of society on a daily basis and all the lying, incompetence, and danger that goes along with it. You get these guys (and women) who are so overworked, so overstressed, constantly being filmed by people who are just waiting for the officer to make that one mistake so they can plaster it all over social media. It's crazy.

When I watched the Ray Tensing video the other day, I did not see evil. I did not see intent to kill. I saw an officer who became fed up with the driver's lies and behavior and when Ray Tensing started the car and began to drive off (or was about to drive off? It's hard to tell from the video), the officer panicked and shot when he probably should have just disengaged and ran back to his cruiser.

If I were on the jury, would I have voted guilty on a murder charge? Absolutely not. A voluntary manslaughter charge? No, I just don't see the bad faith or malice aforethought from the officer's side. Some lesser charge? Perhaps, like I said, I do not believe he had to shoot and a man is dead as a result, but the driver was not without fault in the incident either. Any motorist who would turn on the ignition and attempt to drive away while an officer has his hand on the window is asking for trouble and forces the officer to make a split-second decision that may not turn out well. Everybody know this... that is common sense, right?

That link is interesting. 54 cases of Police shooting and killing suspects and almost all of them say "Not Convicted".

The ones who were convicted were NOT convicted of Murder.

I'm totally convinced a cop in any city in the U.S. could stop an unarmed black man for a routine traffic stop and shoot him straight in the head dead live on TV and not be convicted of Murder.

i'm struggling to find when Haus 40, and others have ever stood up and defended blacks when it comes to these shootings.

at this point...well, it's been like that for a while, i don't have any faith that you two actually like black people. it's why discussing these things with you guys, or the majority of people on this board ends up being nothing more than a complete waste of time.

Before Trevor Noah, when Jon Stewart did the Daily Show, anytime he would say something "out there", liberals would say he was just a comedian and not a journalist.. then when he would say something insightful, they would quote him... IIRC at one point he was ranked in the Top 5 of most influential liberals in the US by Forbes magazine.. yet everything he said was still cloaked in the "Well he's a comedian" mode...

So is Trevor Noah a comedian or a journalist or is he a comedian with insight.. help me out here..

And as far as watching him.. there is only so much time in the day and with Samantha B., and Colbert, and Noah, The View, and all of the late night show hosts... there is only so much "news delivered as comedy" that a guy has time for in one day.
