WASHINGTON — The Supreme Court ruled Monday that a Lakewood baker who refused to make a wedding cake for a same-sex couple because of religious beliefs did not violate Colorado’s anti-discrimination law.

The case pitted Jack Phillips, the owner of Masterpiece Cakeshop in Lakewood, and the couple, Charlie Craig and David Mullins.

The court ruled that the Colorado Civil Rights Commission’s actions violated the free exercise clause.

In arguments before the court in December, Justine Anthony Kennedy, the author of all the court’s major gay-rights cases, worried that a ruling in favor of Phillips might allow shop owners to put up signs saying “We do not bake cakes for gay weddings.”

But later, Kennedy said the Colorado Civil Rights Commission seemed “neither tolerant nor respectful of Mr. Phillips’ religious beliefs” when it found his refusal to bake a cake for the gay couple violated the state’s anti-discrimination law.

The case pitted Phillips’ First Amendment claims of artistic freedom against the anti-discrimination arguments of the Colorado commission, and the two men Phillips turned away in 2012.

I wonder if they will wind up suing the state for damages? Based on the SC ruling, it would seem that they have a case.

Isn't it just as plausible that signs will go up saying "We DO bake cakes for gay weddings"?

I have to admit that I think they got this right but I am concerned about the broader precedent it sets in the times in which we live...

Put up the bigotry signs and they'll all avoid the law suits and they'll lose customers doing it. Yep, it's the times we live in. Murica!

If they lose customers, then isn't that the market dictating what it wants? I mean it worked so well when they tried to paint Chick-fil-A as a bunch of bigots...

Nice couple.

I wonder if they are treated for "Gay Bowel Syndrome". (A stretching of the inelastic sphincter muscle to the point of difficulty controlling defecation)

7-2 ruling.......seems pretty cut and dry what the law dictates on this issue. The state court ought to be ashamed.

Just got back from my walk and was thinking about signage.

I think you are more likely to see a small sign in the window that states, "Christian Bakers" other than a sign saying we do or don't bake Gay cakes.

If a businessman is serious about his Christian beliefs, he will be willing to state those beliefs and not have to bake Gay cakes.
The businessman who will bake Gay cakes and hangs a sign stating, "We bake Gay cakes", will put off Christians as they head for the Christian baker.

If your business is in a high Christian area or in a high Gay area will determine the success of your business.

If chik-fil-a put up signs refusing to serve a gay customers they'd loose customers nationwide bigtime.

so when people start using their religion to justify racism, does this ruling fall under that?

For a True Christian, abiding by God's Will and God's Law is important..
It is not bigoted to live by God's Law. Homosexuality is a sin and therefore the True Christian does not want to promote it in society. The government must not force him to sin.

I would have absolutely zero problem with that if a baker kept to those beliefs.. but I'm willing to bet they aren't turning away second marriages... or those who have had sex prior to marriage.. or those who have kids from other people... or those who are just downright nasty greedy bastards getting married.. or any of that.

If they want to claim Christianity as their reason for not baking a cake for a gay wedding, then go all in... I want to see the whole questionnaire asking about the nature of the couple's faith, their relationship and their previous relationships prior to approving them to have a cake baked.

God doesn't determine one sin to be worse than any other.. so how can these bakers?

Foolishness.
The Baker does not know any of these things about a customer who says, "Bake me one of your wonderful cakes".

The customer who walks in and says bake be a wonderful cake and decorate it with Gay, second marriage or adulterous themes is most likely going to be shown the door or told, "I will bake you the wonderful cake and you can decorate it yourself.

yea, something tells me he didn't bother turning away people on their 2nd or 3rd marriages.

honestly, the older i get, the more annoyed i am with your religious nutcases. yall hide behind your religion for anything, while rarely actually practicing it on a daily basis unless its convenient for you.

its time to start taxing churches. they need to put their fair share in just like everybody else.

Well they all know Trump has been married three times. I wonder if Christian bakers will turn him down with his next mail order bride?

I am kind of mixed on this one

On one I hate any form of discrimination, While I do consider myself Christian, and do believe homosexuality is a sin, I am very much against treating gay people differently for their sins. Because let thou who has not sinned cast the first stone.

But on the other hand I am a libertarian who believes in peoples right to make their own choices, including when it comes to religion. Would we make a Muslim shop owner serve bacon?

I dont know, its one of those things I see both sides and am not sure I really have a clear answer

I do believe this is something NFL players need to take a long look at. I mean if they started a religion with the belief that paying patronage to the flag was bowing to a symbol that puts love of country over the love of God, they could stand on religious grounds and be protected.

That or just claim they're Jehovah's Witness.

Gay people are fine and dandy, a good Christian hates no one.
Gay sex is a sin and a good Christian will not promote sin in our society.

Would you go to a Muslim butcher to buy Bacon?
A Jewish butcher to buy Pork?
A Christian baker to buy a Gay cake?

Not if they say no, it is against my religion to do such things.

Maybe they get someone who graduated from one of those, "pray the gay away" camps they have?

I’ve stated before in a previous thread on this topic that overall, if somebody doesn’t want to back you a cake or make a pizza, right a bad yelp review or something and find somebody who does.

Because the reality is that there are far more businesses who don’t give a crap about baking any sort of cake than those that do, as long as the check clears.

The flip side to this, however, is that this potentially opens pandora box.

Using your religion as a basis for discrimination, and now combined with this ruling, could have some nasty consequences for this country, and the last thing we need is another crapstom social issue.

As I’ve stated before, my biggest concern is that Christians push this religious freedom so hard that it ends up completely opening this country up to sharia law. Christians just simply don’t know when to stop, and by in large, most are completely oblivious to the fact that religious freedom means ALL religions. Not just Christianity.

Christians want to be able to have your Ten Commandments up on government property? Then when the Muslims want a statue of the prophet Muhammad on the doorsteps of the courthouse, they better not say a damn thing.

Christians want to be able to discriminate against gays? Don’t say a word when Hindu business ban Christians from entering. Shut your mouth and move on.

You can tear down whatever you want.

Just don’t get upset when people start tearing down the Ten Commandments.

Hell, your president’s rips that up everyday. So much for being a Christian. No one is a bigger Christian than him. Believe me.

No, I have never eaten baked cases.
