My guess is that it is declared, then two things happen:
1) Pelosi invokes the clause in the 1976 National Emergencies Act to seek to terminate the declaration which will trigger votes in Congress on it.
2) Several lawsuits are filed to stop it from happening

#1 will be fascinating to see how it plays out. Will they have enough votes to overturn it (I think 2/3)? Meaning, will Republicans stick with Trump on this knowing that in a couple years if he loses a Democrat could, for example, declare a National Emergency on guns or healthcare. As well, if the Rs do decide to not go with it, what does it do to the rest of his presidency.

What I find interesting is that I read the following quote from Trump (on AP or Reuters I believe). This is paraphrased because I didn't find it quickly :

"President Obama must not be allowed to subvert the constitution because he is unable to negotiate with Congress. He could certainly be impeached"

Again that was paraphrased from a couple days ago, not the actual quote. I'll try to find it this afternoon and reply to this post with the actual quote and source.

*Wondering to myself* If a hurricane, tornado, or earthquake destroy the wall will FEMA declare a State of Emergency for the National Emergency?

I think a lot of Republicans understand this will open the door for what a Democrat president can do.

A national emergency on gun violence killing our youth. Which can lead to major gun laws.

A national emergency on the environment which well over 90% of scientists agree on will become prominent. Watching Miami slowly going under water is evidence of that.

A national emergency on healthcare where we rank last among high income nations according to some studies.

Yes, Trump's national emergency may be the biggest gift he can give to the Democrats.

The more he rambles on stage right now, the more he’s making it easier for the Dems to completely roll this dude over in 2020.

It's odd that when statistics coming from his own government hit him right in the face, he calls it fake. I guess that's what he believes he's running now. A fake government. On some level I agree with that.

I loved how in his rambling, he went into detail about how much losing he will do when he issue goes to the courts.

Already setting up the excuses for his cult like base to use.

Also, he screwed himself by specifically saying he didn’t HAVE to declare a national emergency, but did to get the wall built faster. He also screwed himself by what you just stated: he basically called his own government statistics, that’s put together by his own hand picked appointees, fake.

And then the ultimate issue that screwed him: if it was a national emergency, why wasn’t it declared until after he Dems took back the house? Why wasn’t it an emergency when you had both chambers of Congress?

Here is something I think every court should listen to that came from his own mouth during this rambling.....

"I didn't really need to do this but I wanted to do it faster."

That certainly doesn't sound like it falls into the category of "emergency" to me.

Does it matter to you that the vast majority of illegal drugs come across legal points of entry and not smuggled across the border in other places? Does it matter that he himself said, "I didn't really need to do this but I wanted to do it faster."

Since he himself actually stated he didn't need to call for a national emergency yet is doing it anyway, you approve of that?

Just remember this when the next Democrat president calls for a national emergency on gun control, the environment or healthcare.

There are two points I want to make.

1. I do believe the border is an emergency and there are crisis every day there. I believe we need to secure them, but by a variety of means. I believe we need to do anything and everything we can to stop the flow of ILLEGAL IMMIGRANTS coming into this country.

2. I do not believe, it falls under a NATIONAL EMERGENCY, and it should be done through legislation - not this way.

I fear he may have opened up Pandora's box. As some have pointed out - whats to keep the next president, either D or R, from doing this all the time with other issues. It may benefit the R now, but sooner or later it will benefit the left. And then sooner or later it will go back to the right. That's what politicians do not understand - DEM or REP - sooner or later, the other side will be in power again.

I don't feel our views are that far off from each other.

I do think there are areas of the border that I would consider problem areas. They would be a prime target for extending a border fence.

I believe Trump is using far more propaganda than facts to use fear as weapon to work people up about it however.

By his own statement he pretty much admitted that it isn't a national emergency.

I also agree with you that it will come back to haunt Republicans later if he gets away with it.

To be clear I am not agreeing with him cause you may think its the dems, but actually I blame this square on the cons. in congress more that anybody cause they had 2 yrs. to solve this serious problem but, when I heard that the B.P. confiscated enough opioids that can kill 50 million americans this border craziness has to stop.

The problem with what's really happening instead of what you're told is happening is that the VAST majority of drugs are coming in through legal points of entries. They're coming smuggled on semi trucks. Paco isn't supplying the drug trade with his back pack.

According to U.S. Customs and Border Protection statistics, 90 percent of heroin seized along the border, 88 percent of cocaine, 87 percent of methamphetamine, and 80 percent of fentanyl in the first 11 months of the 2018 fiscal year was caught trying to be smuggled in at legal crossing points.

I always found the statistic that "most drugs are being caught at the ports of entries" misleading.

If they are getting through, either at a port or not at a port, you have no idea how much go through. The car that just drove through could have had 1lbs, or 100 lbs, you don't know because you didn't catch it.

Well let's break this down for just a minute.

National healthcare.

Raising the minimum wage/living wage.

I could go on, but let's look at history for just a minute. In the 1930's children were working 12-16 hour days in unsafe conditions. It took three or four people in one household to work in order to just get by.

Laws had to be enacted and unions were formed to protect workers and bring about wages where the middle class became strong and so did our economy. The 50's through the 70's were the strongest our nation and people have ever seen. People can't seem to grasp the concept that when most all of the people can afford to buy homes and goods, that's when our economy is robust. The fewer percentage of people that have expendable income, the less business sells and flourishes.

According to so many on this board, all of that change came about through socialism. Our elderly were dying, starving and in abject poverty until Social security came about. And while many Americans can barely get by on those benefits, it does serve as a minimum protection for the elderly.

I've even seen you make fun of people such as myself due to my chosen profession because you somehow felt it made me unable to form a rational opinion and that you were somehow above me or superior because of it.

You see, what you claim are socialist ideas are merely checks and balances on capitalism. Safeguards have to be used that keep capitalism from using and abusing the citizens of our nation for their own personal gain. History has proven this time and time again.

I'm not one who is against capitalism. But I'm also one who knows that the people need to be considered in that equation. People really need to stop making that sound like some evil thing. And they need to understand that it's the common man they need to give at least some slight amount of credit to.

I mean unless they feel that living in a tent and riding a horse is a better way of life.
