Danny Reid argued Jemison had merely defended herself after Jones initiated the fight. "Let’s not lose sight that the unborn baby is the victim here,’’ he said, according to the publication. “She had no choice in being brought unnecessarily into a fight where she was relying on her mother for protection." The indictment comes shortly after a restrictive anti-abortion law passed in Alabama put a national spotlight on the state, although Jones was not charged under the law, which does not take effect until November.

I find this one interesting.
If I am concealing a gun while instigating a fight, and the other guy, in a fit of rage pulls out a knife, if I then draw my gun and kill him, I am guilty of at least manslaughter in most states. It is my responsibility by law to attempt to diffuse the situation because I am of the knowledge I have the power to kill the opponent.
I do however feel for this woman. She is caught up in state law.

Nobody should’ve been charged with manslaughter in this case. I actually agree with Diam. Unless they were on some “meet me at high noon” stuff, this was assault and self defense that just went terribly wrong.

But I think I remember cases of a drunk driver hitting another car, killing the pregnant mother in that car and being charged with manslaughter of the mother and a second charge of manslaughter of the child.
Many states are holding someone responsible for the life or death of the unborn child.

Mainly because of the drunk driving angle though. Getting charged for manslaughter because the prosecutors described it as a miscarriage is some dangerous precedent.

In this case ... if they charged the shooter with manslaughter it would make sense ... charging the mother ...  ... Well I guess they feel the mother started the assault that lead to her child's death. The shooter was defending herself from the mother. The Law is holding someone responsible for the death of the unborn child, the shooter shot the mother, not the child.

That person is held responsible in both cases.
The woman who knew she was pregnant started the attack and escalated the attack until she was shot.
The concealed carrier knew he had the power to kill someone yet escalated, if not started the fight.
The woman is therefore responsible for her child's death. The concealed carrier is therefore responsible for allowing the situation to escalate to the point of his having to shoot to defend his life.
The woman should have walked away. The carrier should have walked away.
To me, that Law is why she was charged.

If they won't put her in jail for abortion then they shouldn't put her in jail causing her babies death. Of course then they also shouldn't put her in jail for smothering her kid 30 min. after it was born.

Swish, I agree that this just doesn't feel right. The woman screwed up badly by starting the fight and lost her baby as a result, that seems like punishment enough to me (well, maybe a minor assault charge).... but according to the law, if the other woman was at fault and the lady lost the child as a result, the other woman could/would be charged with manslaughter.... so in the eyes of the law do we change the value of the unborn child based on who started the fight?
