Nope, 40 is right. The left does crazy things trying to help people, to right wrongs, and end injustices... Damanshot is correct saying the right is not very humane in that way, they are more about preserving their own and prospering at others expense regardless if that expense is a little or a lot. You are also right DC, they are just legal issues when you strip out the inhumanity and or morality.

Everyone serving also swore an oath to protect the constitution. If the law violates the constitution it is effectively null and void. I don't care what your state says. I'd rather die defending the constitution and holding up some of the principles the nation was founded on than obey some random governor. Remember, the national guard's oath is to the Constitution of the United States not to the local government, just an FYI.

Gun grabbing politicians are issuing threats, while the people rush to protect their 2nd Amendment rights by creating gun sanctuaries.

Here’s a little bit of background on the proposed weapons ban from my last article.


After the most recent election, the state’s House and Senate are both Democrat majorities and they haven’t wasted a moment in attempting to gut the gun laws in what has historically been a permissive state.

The so-called “assault weapon ban” is SB16 and has that perilously vague wording we all know to be incredibly dangerous. In some interpretations, this law, if it passes, could make illegal the ownership or transportation of any semi-automatic gun because extendable magazines are available for it – and you don’t even have to have the extendable mags. Unsurprisingly, a lot of Virginians are outraged by the idea of this and discussion of a “grandfather clause” that allows you to keep your semi-autos as long as you register them has done nothing to assuage the ire of gun owners.

Then to really stir the pot, State Representative Donald MacEachin had the bright idea of calling up the National Guard to squelch the rebellion.

McEachin also noted that Democratic Virginia Gov. Ralph Northam could call the National Guard, if necessary.

“And ultimately, I’m not the governor, but the governor may have to nationalize the National Guard to enforce the law,” he said. “That’s his call, because I don’t know how serious these counties are and how severe the violations of law will be. But that’s obviously an option he has.” (source)

As you can imagine, that didn’t go over well.

The National Guard’s Response
Maj. Gen. Timothy P. Williams, the Adjutant General of Virginia’s National Guard responded rather vaguely via Twitter.

We have received multiple questions regarding proposed legislation for the 2020 General Assembly session and the authority of the Governor of Virginia to employ the Virginia National Guard in a law enforcement role.

We understand and respect the passion people feel for the U.S. Constitution and 2nd Amendment rights. We will not speculate about the possible use of the Virginia National Guard.

Based on the responses in the Twitter thread, folks found Maj. Gen. Williams’ lackluster response less than comforting.

So now, a militia is forming in Virginia
Tazewell County is taking this threat to the Second Amendment very seriously. Not only did they pass a Second Amendment Sanctuary resolution, but they’ve also officially begun to form a militia. Law Enforcement Today reports:

Just this past Tuesday, on December 10th, the Board of Supervisors from Tazewell County passed two different resolutions in light of controversy circling those who are pro-gun. The first resolution declared the county to be a second amendment sanctuary. This is not at all surprising to see, as 76 out of 95 counties, 9 out of 38 independent cities, and 13 towns have adopted second amendment sanctuary resolutions.

The second item on the agenda was the proposition of establishing a militia in the county. When both of the resolutions passed, the crowd cheered loudly in support of the decisions. Also, the resolutions didn’t exactly pass by a small margin; the votes were unanimous, with more than 200 citizens standing by in support. (source)

County Administrator Eric Young explained why the county has opted to form a militia.

“Our position is that Article I, Section 13, of the Constitution of Virginia reserves the right to ‘order’ militia to the localities. Therefore, counties, not the state, determine what types of arms may be carried in their territory and by whom. So, we are ‘ordering’ the militia by making sure everyone can own a weapon.”

Thus, if anyone from the state tries to remove the Sheriff from their elected office because they refuse to enforce unjust laws, those state officials will be faced with a lawful militia composed of citizens within the state. (source)

More than 100 Virginia cities, counties declare gun sanctuaries as Dems prepare to take legislature

Dozens of Virginia counties and cities are declaring themselves Second Amendment sanctuaries in an apparent revolt against the legislature's proposals for new firearm restrictions.

The movement appeared to gain so much steam that Virginia Attorney General Mark Herring issued an advisory opinion reminding residents that "sanctuary" resolutions had no legal effect.

"It is my opinion that these resolutions have no legal effect," Herring said in a letter issued Friday. "It is my further opinion that localities and local constitutional officers cannot nullify state laws and must comply with gun violence prevention measures that the General Assembly may enact."

The Associated Press reports that more than 100 cities, towns and counties have passed such resolutions.

The controversy came just before Democrats are expected to take control of both the Virginia Senate and House of Delegates for the first time since 1996. Gov. Ralph Northam already pledged to pass "common sense gun safety legislation" after Democrats' election in November.

The new General Assembly could vote on two bills in particular -- SB 18 and SB 16 -- which, together, would ban assault weapons, raise the minimum age of purchase to 21 and require background checks for any firearm transfer.

"It's just the invasion of someone's personal rights," Jim Wood, owner of a Staunton gun shop, told WHSV.

Wood told the Harrisonburg outlet that the Second Amendment "plainly states that we're allowed to bear arms."

"When they start picking apart at it, then all of a sudden it becomes the anti-gun laws that they've had in other countries," he said.

The Virginia Citizens Defense League (VCDL), a gun rights group that provides a model resolution, claims that 85 of Virginia's 95 counties have already approved so-called sanctuary measures. At least nine cities and 17 towns have done the same, the group said.

The group is also planning a protest for Jan. 20 on the steps of the Capitol. VCDL has posted pictures purportedly showing packed crowds at board of supervisors meetings for more than a dozen localities.

The resistance could reach law enforcement. Culpeper County Sheriff Scott Jenkins has already vowed to deputize citizens if Democrats pass gun control.

On Wednesday, VCDL posted a video showing a rapid increase in sanctuary resolutions since in November, when Democrats won their majority in the state's General Assembly.

Localities across the United States -- including in Florida, California, New Mexico and Washington -- have passed or considered similar measures.

VCDL's model resolution refers to a number of Constitutional provisions and Supreme Court decisions before calling out the potential for gun restrictions in Virginia.

"Certain legislation that has or may be introduced in the Virginia General Assembly, and certain legislation which has or may be introduced in the United States Congress could have the effect of infringing on the rights of law abiding citizens to keep and bear arms, as guaranteed by the Second Amendment to the United States Constitution and Article I, Section 13 of the Constitution of Virginia."

Northam seemed unphased by potential backlash in November. “I don’t think there’s anything to be afraid of," he said, according to The Virginian-Pilot.

But according to VCDL president Phillip Van Cleave, Democrats have awakened a "sleeping giant." The governor himself "declared war on Virginia's gun owners," Van Cleave said.

New Mexico county becomes ‘Second Amendment Sanctuary’ in protest of gun control legislation

A small county in eastern New Mexico declared itself a “Second Amendment Sanctuary County” on Wednesday in protest of pending gun control legislation in the state.

The Quay County Commission voted unanimously to pass the resolution, Albuquerque's KRQE-TV reported.

The state’s House Republicans commended the move in a statement, saying they are proud of Quay County, with its population of about 10,000 citizens, for standing up for the rights of New Mexicans. Republican lawmakers represent the minority in both the state’s House and Senate.

Virginia Governor Northam Increases Corrections Budget In Anticipation Of Jailing Gun Owners

As if Virginia Gov. Ralph Northam’s wholesale attack on law-abiding gun owners wasn’t enough, the disgraced public official and his Michael Bloomberg-bought allies in the General Assembly now want the state’s hard-working taxpayers to foot the bill for their unconstitutional schemes. The budget bill (HB30) includes an appropriation of a quarter million dollars to carry out a host of gun control measures that Northam and his anti-gun allies hope to enact.

The $250,000 is appropriated to the Corrections Special Reserve Fund in order to provide for the “increase in the operating cost of adult correctional facilities resulting from the enactment” of Northam’s gun control measures.

Among the enumerated laws that this allocation is meant to fund is a ban on commonly-owned semi-automatic firearms, the criminalization of private firearms transfers, and gun confiscation orders issued without due process.

Aside from the insult of forcing law-abiding Virginia taxpayers to pay for the diminution of their rights, the gun control allocation is a severe waste of resources. Northam’s Bloomberg-backed gun control measures will not make Virginia safer.

In additional to being unconstitutional, a ban on commonly-owned semi-automatic firearms will not reduce violent crime.

Long guns of any description are rarely used in violent crime. FBI Uniform Crime Reporting data breaks down homicides by weapon type. In 2018, the FBI reported that there were five times as many individuals listed as killed with “knives or cutting instruments,” than with rifles of any kind. The data also showed that rifles were listed as being used in less homicides than “blunt objects (clubs, hammers, etc.)” or “personal weapons (hands, fists, feet, etc.).”

A 1997 Department of Justice-funded study of the 1994 federal “assault weapons” ban determined that “At best, the assault weapons ban can have only a limited effect on total gun murders, because the banned weapons and magazines were never involved in more than a modest fraction of all gun murders.” A 2004 follow-up Department of Justice-funded study came to a similar conclusion. The study determined that “AWs [assault weapons] and LCMs [large capacity magazines] were used in only a minority of gun crimes prior to the 1994 federal ban,” “relatively few attacks involve more than 10 shots fired,” and “the ban’s effects on gun violence are likely to be small at best and perhaps too small for reliable measurement.”

So-called “universal” background checks do not stop criminals from obtaining firearms.

Background checks don’t stop criminals from stealing firearms, getting them on the black market, or getting them from straw purchasers. According to the U.S. Department of Justice, 75 percent of criminals in state and federal state prison who had possessed a firearm during their offense acquired the firearm through theft, “Off the street/underground market,” or “from a family member or friend, or as a gift.” Less than one percent got firearms from dealers or non-dealers at gun shows. ATF has reported, “[t]he most frequent type of trafficking channel identified in ATF investigations is straw purchasing from federally licensed firearms dealers.”

This year, researchers at the Bloomberg School of Public Health and the UC Davis School of Medicine found that comprehensive background checks and prohibitions based on violent misdemeanors “were not associated with changes in firearm suicide or homicide.”

Aside from enabling the unacceptable deprivation of constitutional rights without due process, an Extreme Risk Protection Order (Red Flag) law is unnecessary in Virginia because the state already has strong and effective civil commitment laws.

Under Virginia law, a law enforcement officer may take an individual into emergency custody for a mental health evaluation without prior court approval. A person detained in this manner is then evaluated to determine whether they meet the criteria for a temporary detention. A person that was subject to a temporary detention order and subsequently agreed to voluntary admission to a mental health facility is prohibited from possessing firearms until their rights are restored by a court.

Tax-paying Virginians should not have to foot the bill for Northam and Bloomberg’s radical attack on their fundamental rights.

The right wing instigators are trying to turn Virginia into a powder keg with this continuous rhetorical assault on the duly elected government. Elections have consequences, get ready to lose more because the silent majority and their traitor-in-chief have set back fairness and understanding in politics by 150 years. These gun toting hicks want to take on the US Military Police state with what amounts to firecrackers by comparison... rolleyes

I don't want to see either side doing this. I want responsible gun owners to have all the guns they want, but I'm damn tired of seeing innocents kids killed in schools and malls. I'm sick of wackadoodle militias getting away with domestic terrorism too. So if you make me pick a side, it will be against those that choose to defend against any regulations on guns.

I still think the focus on guns with regards to school shootings is the wrong spot. Blaming guns is a cop out. Messed up circumstances, bullying, ostracism, poor parenting, mental illness, head in the sand school systems/communities not giving kids needed help and wanted attention. Extreme violence doesn't happen in a vacuum.

Maybe bimonthly mandatory counseling for all students would help. "Mental health days." "Make them" talk about their feelings, so they aren't bottled up until they explode. Teach strategies to address potential issues.

Start them early so that talking about feelings is normalized. It's hard to have stigma if everyone is doing it. Little issues could be detected before they festered into giant issues.

I hear a lot of complaining about school shootings.. even to the point that some wingnut radio host thinks we should just have a good ole fashion school shooting to take the heat off trump. (he got fired by the way)

But you know what I don't hear? Not one single constructive discussion on how to go about fixing the probem.. and make no mistake, it's a real problem.

All the Far Left wants to do is take all the guns.. That's never going to work and I'd never support such actions.. Never

All the far Right wants to do is make sure that even the insane can get a Semi Auto gun that can easily be converted to full auto. I can't support that either., Never

Unless and Until they both sit down and work it out, we'll continue to be at each others throats on the subject.. and kids (as well as others) will continue to be in danger.

I think this is far from true. I consider myself pretty far left and I don't know anyone personally that wants to take all guns. I would never agree to that because it would go against the heart of the constitution. But the fear mongering machine spreads that crap like fuel on a fire for the gun lobbies.

I think the left just wants safety of the kids or public in general to be a priority. But as long as we are stuck on stupid in this argument no progress is or ever will be made. The frustration that causes on the left is then turned into the fear mongering.

I think maybe the answer to this could be treating ammo like schedule 2 drugs. Track every single round manufactured rather professionally or at home. Make the individuals who create or purchase the rounds personally responsible for their use with extremely serious ramifications for illegal use. It would take a few decades but eventually this would tighten up gun use without bans.

I know a lot of gun owners, even some that are considered nuts, and I’m also well versed on the current market. I’ve maybe seen one video of a semi auto being converted into full auto happening. It simply doesn’t exist like that. It’s actually a joke amount gun enthusiasts that the people that don’t understand guns think this is a thing.

Even if it we’re a thing, those aren’t the guns being used in crimes. It’s like attacking the AR-15 when it represents such a small subset of gun violence. As said above, you’re 5 times as likely to get stabbed than shot with a rifle (which an ar-15 is a rifle).

Also, I’ve never met any gun nuts that want insane people to have access to guns. Most of them are law abiding citizens that aren’t hurting anyone, have kids in school and want to keep guns out of the hands of criminals and the insane.

I think where that comes from is that the left want to restrict everyone from buying X, then gun people pushback for themselves and it’s twisted to mean they want guns in dangerous people’s hands. Believe me, again, we don’t want mass shooters, street gangs or suicidal people getting access to guns. But when Bloomberg says all semi automatic guns are to be confiscated, that affects 99.99% of upstanding gun owners. The criminals won’t turn them in.

See, that’s funny, but most anti-gunners don’t get the joke. That’s my point. They don’t understand guns and think that’s legit.

Look, I live in a state and county with an “Assault Weapons Ban” and I follow it. However, the crap they’re pulling in Virginia is too far. Any semi-auto handgun that can accept more than 10 rounds...that’s like 75-80% of the handgun market. The other percent is subcompacts and revolvers. It’s a straight up ban on handguns for all intents and purposes. What happened to finding some common sense gun laws?

And again, the bad dudes you’re afraid of, they won’t turn in their guns. You’re only hurting the law abiding citizens that follow all rules and pay the fees and taxes for these guns. Why target the good guys? Unless this truly is about disarming us citizens for easier control.

Good post, but you forgot 1 thing about full auto guns: Without a FFL, it is illegal to even HAVE a full auto gun. Pretty sure it's a felony.

I hope to one day be able to afford one of those expensive Hi-Points with the 2000 round clip! That would be awesome. My cheapie Sig Sauer just can't stand up to the heat dissipated by those big clips.

Well, if the state is going to pass laws making law abiding citizens into automatic felons, the citizens may as well become full automatic felons.

Gun owner pressure seems to be working as the Democrats are backing off on some of the extremes of their coming legislation.

The Grandfather Clause looks to be back along with some other things.

Columnist and George Mason economics Professor Walter E. Williams is warning Virginia residents about Gov. Ralph Northam’s (D) gun registry plan.

Northam has been pushing an all-out ban on AR-15s and similar rifles for some time, but he recently changed the scope of the ban in the face of the growing Second Amendment Sanctuary movement.

On December 10, 2019, Breitbart News reported that Northam changed his position from supporting an across-the-board ban on possession of such weapons to supporting a ban only in a situation where a person refuses to register the firearm with the government. The Virginia Mercury quoted Northam spokeswoman Alena Yarmosky saying, “The governor’s assault weapons ban will include a grandfather clause for individuals who already own assault weapons, with the requirement they register their weapons before the end of a designated grace period.”

On December 27, 2019, Walter E. Williams used a Fox News op-ed to warn Virginians “not to fall for the registration trick.” He said, “Knowing who owns what weapons is the first step to confiscation.”

Williams added:

James Madison, in Federalist Paper No. 46 wrote that the Constitution preserves “the advantage of being armed, which the Americans possess over the people of almost every other nation … (where) the governments are afraid to trust the people with arms.”

Thomas Jefferson wrote: “What country can preserve its liberties if its rulers are not warned from time to time that their people preserve the spirit of resistance? Let them take arms.”

Too many Americans believe the Second Amendment grants Americans the right to own firearms only to go hunting and for self-protection. The framers of our Constitution had no such intent in mind.

Eighty-six of Virginia’s 95 counties have declared themselves Second Amendment Sanctuaries in which future gun controls passed by Northam and his Democrat colleagues will not be enforced.
