FBI official: No shots fired by rioters, no firearms recovered during siege on U.S. Capitol
Senators on Wednesday commenced a second joint oversight hearing on the breach of the Capitol building.

No firearms were recovered on the U.S. Capitol grounds on Jan. 6 during the riot, and no shots were fired by the demonstrators, an FBI official on Wednesday told Congress.
"To my knowledge we have not recovered any [firearms] on that day from any of the arrests at the scene at this point," said Jill Sanborn, assistant director of the FBI's Counterterrorism Division. "No one has been charged with a firearms violation."
Sanborn made her comments during a joint oversight hearing in the Senate to examine the breach of the U.S. Capitol. In addition to Sanborn, witnesses included the commander of the Washington, D.C. National Guard, and civilian officials from the Pentagon.
During testimony, Sanborn responded to questions from Wisconsin Republican Sen. Ron Johnson, who asked whether firearms were present or used during the siege.
"How many shots were fired that we know of?" Johnson asked.
"The only shots fired were the ones that resulted in the death of the one lady," Sanborn said, referencing Ashli Babbitt, a protester who was shot and killed by a Capitol Police officer during heightened tension inside the building.
Other testimony examined the timeline of when the National Guard was dispatched to help an overwhelmed civilian police force during the siege on the Capitol.
The National Guard was dispatched to the riot more than three hours after Capitol Police made a desperate call for help with a "dire emergency," a two-star general testified Wednesday before Congress.
Major Gen. William Walker, who commands the District of Columbia National Guard, told senators that the 1:49 p.m. call for help from the guard on Jan. 6 was approved in a message that reached him after 5 p.m. At that point, troops who were waiting on buses sped to the Capitol, and helped to secure a perimeter, Walker said.
Walker made his comments during a hearing to examine the breach of the U.S. Capitol. In addition to Walker, civilian officials from the Pentagon and the FBI are scheduled to testify.
Walker told senators he was "sickened by the physical and mental harm" that came to civilian police who responded to the riot.
The hearing comes one day after FBI Director Chris Wray appeared before members the Senate Judiciary Committee to address his agency's investigative efforts regarding the Jan. 6 incident.
The Wednesday session marks the second joint oversight hearing in the Senate between the Homeland Security and Governmental Affairs Committee and the Committee on Rules and Administration to examine security and intelligence failures that led to the breach.
"The committees are seeking testimony from federal national security and counterterrorism agencies on their roles in intelligence gathering, security preparations and the response to the attack on the U.S Capitol," committee officials wrote in a joint statement.
Other witnesses include Robert Salesses, from the Department of Defense; and Melissa Smislova, from the Department of Homeland Security.
The Washington, D.C. National Guard's commander, Maj. Gen. William Walker, was not on the original witness list, but was added on Monday to the roster.
Officials have said that the congressional investigation into the Jan. 6 breach could span more than a year. A previous joint hearing brought in current and former officials who were responsible Jan. 6 for securing the Capitol.

Police said they found a gun on Christopher Alberts while he was exiting the Capitol. The Maryland native tried to flee but was restrained by officers, who also found 25 rounds of ammunition, according to court documents. Alberts allegedly told police he had the gun for "personal protection," and he hasn't yet entered a plea, according to court records.

Let's go over this again. When someone tries to stop the certification of an election in order to keep the candidate that lost that election in power, it is an insurrection. It is an attempted coup. A weapon is anything you use as an instrument to assault and attack someone with which to do bodily harm. It can be a hammer, a fire extinguisher a flag pole or any other object.

It's the first known case to be brought against a Trump appointee in the Jan. 6 insurrection, which led to Trump's historic second impeachment.
Federico Klein, who also worked for Trump's 2016 campaign, was seen wearing a “Make America Great Again" hat amid the throng of people in a tunnel trying to force their way into the Capitol on Jan. 6, the papers say. Klein pushed his way toward the doors, where, authorities say, “he physically and verbally engaged" with officers trying to keep the mob back.
Klein was seen on camera violently shoving a riot shield into an officer and inciting the crowd as it tried to storm past the police line, shouting, “We need fresh people, we need fresh people,” according to the charging documents.
As the mob struggled with police in the tunnel, Klein pushed the riot shield, which had been stolen from an officer, in between the Capitol doors, preventing police from closing them, authorities say. Eventually, an officer used chemical spray, forcing Klein to move somewhere else, officials say.
Klein was arrested Thursday in Virginia and faces charges including obstructing Congress and assaulting officers using a dangerous weapon.
He was in custody on Friday and couldn’t be reached for comment. It was not immediately clear whether he had an attorney who could comment on his behalf. A Trump spokesman said he had no comment.
At least five people, including a Capitol Police officer, died as a result of the violence, and two other officers killed themselves after. More than 300 people have been charged with federal crimes.
Klein became a staff assistant in the State Department shortly after Trump's inauguration in 2017, according to a financial disclosure report. He held a top secret security clearance that was renewed in 2019, according to the court papers. He resigned from his position on Jan. 19, the day before Joe Biden was sworn in as president, authorities said.
One of Klein's State Department coworkers helped authorities identify him, officials said.
A Department of State diplomatic security special agent interviewed by an FBI agent said that Klein worked in the Office of Brazilian and Southern Cone Affairs, according to the court papers. The Department of State official identified Klein in photos and video shown by the FBI, officials said.

Zoe Lofgren has quietly posted a nearly 2,000-page report documenting social media posts by her Republican colleagues who voted against certifying results of the presidential election on January 6. The information compiled isn't secret, but the report is another sign of the deep distrust that has settled into the US Capitol in the weeks since the insurrection.
The report chronicles the social media activity of members on public forums immediately before the November election and right after the January 6 riot. The report has been online for a week. CNN reported earlier Thursday that federal investigators are examining records of communications between members of Congress and the pro-Trump mob that attacked the Capitol, as the investigation moves closer to exploring whether lawmakers wittingly or unwittingly helped the insurrectionists. In a preamble to the report, Lofgren -- the chair of the House Administration Committee -- wrote that she had asked her staff to pull the relevant social media posts and compile them in an effort to gather facts. "Any appropriate disciplinary action is a matter not only of the Constitution and law, but also of fact," the California Democrat wrote. "Many of former President Trump's false statements were made in very public settings. Had Members made similar public statements in the weeks and months before the January 6th attack? Statements which are readily available in the public arena may be part of any consideration of Congress' constitutional prerogatives and responsibilities." Lofgren continued, "Accordingly, I asked my staff to take a quick look at public social media posts of Members who voted to overturn the 2020 presidential election." Tensions have risen within the Capitol since the January attack. A House floor that once was deemed impenetrable has been surrounded by metal detectors, while Speaker of the House Nancy Pelosi, a California Democrat, has said that "the enemy is within" the House, referencing the rhetoric and behavior of some Republican members of Congress. "Like former President Trump, any elected Member of Congress who aided and abetted the insurrection or incited the attack seriously threatened our democratic government. They would have betrayed their oath of office and would be implicated in the same constitutional provision cited in the Article of Impeachment," Lofgren wrote in her foreword to the report. "That provision prohibits any person who has previously taken an oath as a member of Congress to support the Constitution but subsequently engaged in insurrection or rebellion from serving in Congress." The report features a collection of social media posts and tweets that span dozens of pages from Arizona Rep. Paul Gosar where he urges supporters to "hold the line," days before what would become the Capitol insurrection. In another social media post included in the report, Gosar wrote that "sedition and treason for stealing votes is appropriate." The report also captures numerous tweets where Gosar invoked @ali on Twitter, which was formerly the account used by Ali Alexander, a leader of the "Stop the Steal" group, who said in several Periscope livestream videos that he planned the rally that preceded the riot in conjunction with Gosar and two other congressional Republicans, Mo Brooks of Alabama and Andy Biggs of Arizona. Capitol Riot Evidence ‘Trending Towards’ Sedition Charges, Former Top DOJ Official Says

Evidence collected by investigators probing the Jan. 6 riot at the U.S. Capitol is “trending towards” sedition charges, a top federal prosecutor who led the Justice Department’s probe into the deadly insurrection said Sunday.
Hundreds of people have been arrested for their role in the riots on a range of charges, from trespassing to complex cases involving nationalist militia groups. Michael Sherwin, who until Friday served as the lead investigator in the DOJ’s investigation, was asked directly by “60 Minutes” host Scott Pelley if the public should expect sedition charges ― for conspiracy to overthrow the government ― against some suspects in the coming weeks as investigations continue.
“I personally believe the evidence is trending towards that, and probably meets those elements,” Sherwin said. “I believe the facts do support those charges. And I think that, as we go forward, more facts will support that.”
Sedition, called “seditious conspiracy” under the federal criminal code, is defined in part as an effort “to conspire to overthrow, put down, or to destroy by force the Government of the United States.” But federal prosecutors rarely levy such charges, which harken back to the Civil War-era. The New York Times notes the last time they did so, in 2010, against members of a Michigan militia group accused of plotting to enter into an armed conflict with the government, the accused were ultimately acquitted in 2012.
If convicted, the crime carries a fine or sentence of up to 20 years in prison.
Sherwin ― who served as the interim U.S. Attorney in Washington during the Biden transition before he ceded that post in early March ― added that more than 400 people had been charged for their roles in the Capitol attack, many who face serious federal felony charges that can carry 5, 10 or 20-year sentences. More than 100 people are charged with assaulting federal officers and local police, including Capitol Police Officer Brian Sicknick, who died after the attack.
A medical examiner has not yet determined how Sicknick died, but Sherwin said that should the evidence point to a chemical that was deployed by rioters, “that’s a murder case.”

The prosecutor also said former President Donald Trump, who helped inflame his supporters before the attack and has continued to reject the outcome of the 2020 election, was also under investigation for his role in the insurrection.
“It’s unequivocal that Trump was the magnet that brought the people to D.C. on the 6th,” Sherwin said. “Now the question is, is he criminally culpable for everything that happened during the siege, during the breach?”

Officer Cleared In The Shooting Death Of Ashli Babbitt During Capitol Riot
The Department of Justice announced Wednesday it will not pursue charges against the U.S. Capitol Police officer who fatally shot a rioter inside the Capitol building on Jan. 6. Officials determined there wasn't enough evidence to support a criminal prosecution.
Following the shooting, an investigation was launched by the U.S. Attorney's Office for the District of Columbia's Public Corruption and Civil Rights Section and the Civil Rights Division, with the Metropolitan Police Department's Internal Affairs Division. According to a Justice Department statement, the investigation failed to provide evidence that the officer violated 18 U.S.C. § 242, depriving Babbitt of her rights under color of law.
"In order to establish a violation of this statute, prosecutors must prove, beyond a reasonable doubt, that the officer acted willfully to deprive Ms. Babbitt of a right protected by the Constitution or other law, here the Fourth Amendment right not to be subjected to an unreasonable seizure," a DOJ statement read. "Prosecutors would have to prove not only that the officer used force that was constitutionally unreasonable, but that the officer did so 'willfully,' which the Supreme Court has interpreted to mean that the officer acted with a bad purpose to disregard the law."
The U.S. Attorney's Office and U.S. Department of Justice offered their condolences to Babbitt's family before closing the investigation.
Thirty-five-year-old Air Force veteran Ashli Babbitt was protesting against what she falsely considered to have been the illegitimate results of the 2020 presidential election results. A portion of the rioters, including Babbitt, forced their way into the Capitol building in an attempt to stop Congress from certifying the Electoral College votes.
Officers barricaded the doors of the Chamber of the House of Representatives as the mob tried to break into the room from multiple entrances. Babbitt was shot as she climbed through a broken door into the Speaker's Lobby. The bullet struck Babbitt in the left shoulder, and she later died from her wounds at Washington Hospital Center.
Five people died during or shortly after the Jan. 6 assault and hundreds of individuals are facing charges.
