I certainly don't think incompetence can be claimed except by those not paying attention. They realized there was no copyright on the name and dealt with that legally by copyrighting the name back in early April.
And yes it may be seen by some as steamrolling the little guy but then when you're talking about a roller derby team almost nobody has ever heard of, how many people are really going to care?

yeah, that's not how trademarks work. A domain name means nothing. They need a ™ or ℠ to let people know they are attempting to trademark something. If anything, the Wayback machine will strengthen the Indian's case as they can prove they didn't have those symbols anywhere. Basically, the roller derby team is SOL lol I have 7 trademarks. 3 of them were fairly easy to get. 2 were challenging and took 1.5 years to get, 1 I had to negotiate with one company to get it approved 1 I have been battling with for 2 years and still don't have it registered. 1 I lost and didn't get it registered.

I wasn't saying they had a trademark, was referring to how the name was out there and obviously in use.
So either they didn't care, and as Pit said, are just planning to steamroll to get their way, or they were just stupid and didn't do any research.
Either way, it's a stupid name to begin with, and that's the best they could come up with. Did they even get any fan reaction before settling on it?

How many people even knew there was a freaking roller derby team in Cleveland, much less what their name was? I live here and I never heard of them.

Just clicking
I guess I'm just confused It's ok to have the Apache helicopter, Black Hawk Helicopter, Lekota Helicopter, Chinook Helicopter and tomahawk Cruise Missles, but somehow, it's not ok to have the Cleveland Indians.

The term Indians is looked at as a negative I suppose. If we had been named after a Tribe of Indians, or weapons that Indians used, we would have been OK. Seems dumb, I agree.

Neither have I, but if I want to name my team the Cleveland Guardians, one of the FIRST things I do is google ClevelandGuardians.com Marketing/Business 101 in 2021 I would say they did. I'm guessing that's why they made the legal moves they did to insure they retain the trademark for the name. Because they knew nobody else had....... CLEVELAND, Ohio (WOIO) - There’s a trademark battle for the name Cleveland Guardians. The local roller derby team filed a trademark application July 27 for rights to “Cleveland Guardians.” The baseball team filed their own application July 23 with the United States Patent and Trademark Office. That’s the same day the team announced “Cleveland Guardians” as their new name. However, according to trademark attorney Josh Gerben, the Cleveland Indians first submitted a trademark filing on April 8 in the Republic of Mauritius, a small island nation near Africa. That means the Indians can claim April 8 as their “priority” filing date in the United States, according to a tweet posted by Gerben. Both groups are seeking to use the name on clothing, accessories and more. https://www.cleveland19.com/2021/07/31/c...rk-application/While they're trying to present it as a "trademark fight", the reality is that the Indians not only applied for the trademark first, they applied for it twice before the roller derby team did. I am guessing the preemptive move they made back in April is evidence they had a pretty good idea of what they were doing.

A New Lease On Life For Cleveland Baseball ZACH SHAFRON25 MINUTES AGO https://www.si.com/mlb/indians/news/a-new-lease-on-life-for-cleveland-baseballGood news arose in Cleveland Thursday as the team announced a new lease for the ballpark, Progressive Field. The contract is worth $435 million and it is with the City of Cleveland, Cuyahoga County and additionally, the State of Ohio. Thus, we will have baseball in Cleveland for the next decade and a half at least. Additionally, the team will use this money in various renovations for the ballpark. These include focusing on the Terrance Club, upper concourse amongst other parts of the park that was built in 1994, 27 years ago. Moreover, simply having a baseball team in Cleveland is crucial. Yes, there is obviously the aspect of fandom and having a team to cheer on. Everyone in Cleveland knows what it is like to lose a beloved team… However, there is another aspect to this that is also big. The fact that there will be at least 81 home games a year improves the Downtown Cleveland economy ten-fold. Restaurants, hotels, casinos and the various entities within the ballpark itself. All of these will help make for a better area moving forward. The Indians are currently 52-53, which is 9.5 games behind the Chicago White Sox for first place in the AL Center. Additionally, the team is seven games back in the Wild Card Race. Obviously, chances for success are looking extremely break for the Indians this year. However, one can only hope that there will be plenty of excitement and contention throughout these next 15 years moving forward. That will make this lease well worth it. Fans were worried a name change from Indians to Guardians could signify that the team was subsequently moving locations. Well, that will not be the case. Enjoy many more years of Cleveland Baseball with this new lease.
You know my love will Not Fade Away.........

Just goes to show how far it is from the "Jake" being a brand new sparkler in MLB to middle age dull. Give it another 27 years and their better be a new ballpark. Talks will begin around year 10 of the new lease.
Unless they become iconic, stadiums now seem to have about a 40-50 year shelf life. Cities can't get away with having a 70 year old piece of crap like the Muni.

Well for the price of games these days, people don't want broken seats, flooded bathrooms, leaky midways, and giant posts in their view. In reality, technology is changing the experience. Simply going to watch the game is not enough, with many people with 70+ inch 4k TVs, the stadium needs to offer something to draw people in. Yes I know there is nothing like watching live, but for many the negatives outweigh the positives.

I think it's hilarious that the folks running major sports don't understand that it's the hassle of attending games that's the real culprit here. TV and home entertainment equipment has gotten to the point where watching the game at home is easy. Large HDTVs and 'good enough' sound equipment have become extremely accessible for the masses. 'Good enough' watching at home makes the hassle (not to mention the expense) of going to the game just not worth it for many.
There is no level of sucking we haven't seen; in fact, I'm pretty sure we hold the patents on a few levels of sucking NOBODY had seen until the past few years.

It depends on the stadium if it's a hassle or not.
Getting into Mercedes Benz Stadium is easy peasy. I can take the train straight there and there are two stadium stops, so pick whichever is more convenient for you (different gates). It takes me about an hour to get from my house in the suburbs to my seat at the stadium. (for soccer, I haven't been to a Falcons game). I love that I don't have to deal with parking at the stadium and all that headache.
I would 100% rather be at the game, then watching on tv. And I try to go to a lot of games, but covid makes it difficult/not fun.
