New York Man Pleads Guilty to Conspiracy and Obstruction Charges Related to Jan. 6 Capitol Breach

Defendant Planned Activities as Member of Proud Boys Chapter in Central New York

WASHINGTON – A New York man pleaded guilty today to crimes related to the breach of the U.S. Capitol on Jan. 6, which disrupted a joint session of the U.S. Congress that was in the process of ascertaining and counting the electoral votes related to the presidential election.

According to court documents, Matthew Greene, 34, of Syracuse, conspired with fellow members of the Proud Boys, a self-described “pro-Western fraternal organization for men who refuse to apologize for creating the modern world; aka Western Chauvinists.” Greene pleaded guilty to one count of conspiracy and one count of obstruction of an official proceeding this afternoon in the U.S. District Court for the District of Columbia.

Greene was arrested on April 21, 2021, following his indictment along with two other individuals in this case, Dominic Pezzola, 44, of Rochester, New York, and William Pepe, 32, of Beacon, New York; they have pleaded not guilty to charges.

According to court documents, Greene officially joined the Central New York Proud Boys chapter in December 2020. In advance of Jan. 6, he and other members of the Proud Boys planned to come to Washington and coordinate their activities through various communication methods they had previously obtained, including programmable radios. On Jan. 6, they met up at the Washington Monument, intentionally dressed in clothing that concealed their membership as Proud Boys.

Greene and other Proud Boys members then marched from the Washington Monument to the Capitol, where Greene witnessed the tearing down of barricades and advanced with others into the restricted area. Greene was among the first wave to cross a downed police line and advance into the West Plaza. He later advanced to a set of stairs that ran from the West Plaza to the Upper West Terrace. He witnessed rioters assault the police and overrun them. Greene followed others up the stairs moments after the police line was breached. Finally, after exiting the stairs, he participated with other rioters, including members of the Proud Boys, in moving additional police barricades.

Greene remains detained pending sentencing, which was set for March 10, 2022. He faces up to five years in prison on the conspiracy charge and up to 20 years in prison on the obstruction charge, along with potential financial penalties. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

The case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney’s Office for the Northern District of New York.

The case is being investigated by the FBI’s Washington Field Office and the Syracuse Resident Agency of the FBI’s Albany Field Office, with assistance from the New York State Police.

In the 11 months since Jan. 6, more than 700 individuals have been arrested in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including over 220 individuals charged with assaulting or impeding law enforcement. The investigation remains ongoing.

Honestly - unlike any of the other "politics" of the last 6+ years where peoples views on Hilary's emails or Trump's Campaign interaction with Russia / Coercing Foreign powers to investigate political opponents etc etc was to some extent largely influenced by personal politics .... You would hope that everyone in the country is interested in getting to the bottom of the Jan 6th attempt to prevent the peaceful transition of power and the certification of the will of the people ... Right? I mean that should be as a matter of course. What happened was an attack on the process of democracy and those involved and active in the day and facilitated or organized those events need to be held accountable. Hopefully no argument so far?

At some point there will be a subjective divide - unless there is concrete proof that materializes - was there politicians/people in office etc, involved and whose actions and rhetoric that preceded the Capital Riot cross a legal threshold prosecutable by law. We might all have opinions, but a bit like the Rittenhouse trial, opinions don't mean chit. The only thing that does and should matter is the letter of the law. At some point being an enabler and instigator crosses a legal threshold - and if true/proven - needs to be held accountable.

Drawing parallels to political impeachment trials and proceedings is asinine at best... In reality just a spoon fed reaction from people plugged into Fox and other right wing media. The same media already exposed as frauds and hypocrites regards to the events of Jan 6th.

Personally I could do without the daily sensationalism from the trial. Just investigate and then lets review the conclusions/facts that are discovered.

Actually, when you read it in its entirety, it shows it's less likely than it is likely to be true.

Trump Adviser Peter Navarro Lays Out How He and Bannon Planned to Overturn Biden’s Electoral Win

EXCLUSIVE

A former Trump White House official says he and right-wing provocateur Steve Bannon were actually behind the last-ditch coordinated effort by rogue Republicans in Congress to halt certification of the 2020 election results and keep President Donald Trump in power earlier this year, in a plan dubbed the “Green Bay Sweep.”

In his recently published memoir, Peter Navarro, then-President Donald Trump’s trade adviser, details how he stayed in close contact with Bannon as they put the Green Bay Sweep in motion with help from members of Congress loyal to the cause.

But in an interview last week with The Daily Beast, Navarro shed additional light on his role in the operation and their coordination with politicians like Rep. Paul Gosar (R-AZ) and Senator Ted Cruz (R-TX).

“We spent a lot of time lining up over 100 congressmen, including some senators. It started out perfectly. At 1 p.m., Gosar and Cruz did exactly what was expected of them,” Navarro told The Daily Beast. “It was a perfect plan. And it all predicated on peace and calm on Capitol Hill. We didn’t even need any protestors, because we had over 100 congressmen committed to it.”

That commitment appeared as Congress was certifying the 2020 Electoral College votes reflecting that Joe Biden beat Trump. Sen. Cruz signed off on Gosar’s official objection to counting Arizona’s electoral ballots, an effort that was supported by dozens of other Trump loyalists.

Staffers for Cruz and Gosar did not respond to requests for comment. There’s no public indication whether the Jan. 6 Committee has sought testimony or documents from Sen. Cruz or Rep. Gosar. But the committee has only recently begun to seek evidence from fellow members of Congress who were involved in the general effort to keep Trump in the White House, such as Rep. Jim Jordan (R-OH) and Rep. Scott Perry (R-PA).

This last-minute maneuvering never had any chance of actually decertifying the election results on its own, a point that Navarro quickly acknowledges. But their hope was to run the clock as long as possible to increase public pressure on then-Vice President Mike Pence to send the electoral votes back to six contested states, where Republican-led legislatures could try to overturn the results. And in their mind, ramping up pressure on Pence would require media coverage. While most respected news organizations refused to regurgitate unproven conspiracy theories about widespread election fraud, this plan hoped to force journalists to cover the allegations by creating a historic delay to the certification process.

“The Green Bay Sweep was very well thought out. It was designed to get us 24 hours of televised hearings,” he said. “But we thought that we could bypass the corporate media by getting this stuff televised.”

Navarro’s part in this ploy was to provide the raw materials, he said in an interview on Thursday. That came in the form of a three-part White House report he put together during his final weeks in the Trump administration with volume titles like, “The Immaculate Deception” and “The Art of the Steal.”

“My role was to provide the receipts for the 100 congressmen or so who would make their cases… who could rely in part on the body of evidence I'd collected,” he told The Daily Beast. “To lay the legal predicate for the actions to be taken.” (Ultimately, states have not found any evidence of electoral fraud above the norm, which is exceedingly small.)

The next phase of the plan was up to Bannon, Navarro describes in his memoir, In Trump Time.

“Steve Bannon’s role was to figure out how to use this information—what he called ‘receipts’—to overturn the election result. That’s how Steve had come up with the Green Bay Sweep idea,” he wrote.

“The political and legal beauty of the strategy was this: by law, both the House of Representatives and the Senate must spend up to two hours of debate per state on each requested challenge. For the six battleground states, that would add up to as much as twenty-four hours of nationally televised hearings across the two chambers of Congress.”

His book also notes that Bannon was the first person he communicated with when he woke up at dawn on Jan. 6, writing, “I check my messages and am pleased to see Steve Bannon has us fully ready to implement our Green Bay Sweep on Capitol Hill. Call the play. Run the play.”

Navarro told The Daily Beast he felt fortunate that someone cancelled his scheduled appearance to speak to Trump supporters that morning at the Ellipse, a park south of the White House that would serve as a staging area before the violent assault on the U.S. Capitol building.

“It was better for me to spend that morning working on the Green Bay Sweep. Just checking to see that everything was in line, that congressmen were on board,” he said during the interview. “It was a pretty mellow morning for me. I was convinced everything was set in place.”

Later that day, Bannon made several references to the football-themed strategy on his daily podcast, War Room Pandemic.

"We are right on the cusp of victory,” Bannon said on the show. “It’s quite simple. Play’s been called. Mike Pence, run the play. Take the football. Take the handoff from the quarterback. You’ve got guards in front of you. You’ve got big, strong people in front of you. Just do your duty."

This idea was weeks in the making. Although Navarro told The Daily Beast he doesn’t remember when “Brother Bannon” came up with the plan, he said it started taking shape as Trump’s “Stop the Steal” legal challenges to election results in Arizona, Georgia, Pennsylvania, and Wisconsin fizzled out. Courts wouldn’t side with Trump, thanks to what Navarro describes in his book as “the highly counterproductive antics” of Sydney Powell and her Kraken lawsuits. So instead, they came up with a never-before-seen scheme through the legislative branch.

Navarro starts off his book’s chapter about the strategy by mentioning how “Stephen K. Bannon, myself, and President Donald John Trump” were “the last three people on God’s good Earth who want to see violence erupt on Capitol Hill,” as it would disrupt their plans.

When asked if Trump himself was involved in the strategy, Navarro said, “I never spoke directly to him about it. But he was certainly on board with the strategy. Just listen to his speech that day. He’d been briefed on the law, and how Mike [Pence] had the authority to it.”

Indeed, Trump legal adviser John Eastman had penned a memo (first revealed by journalists Robert Costa and Bob Woodward in their book, Peril) outlining how Trump could stage a coup. And Trump clearly referenced the plan during his Jan. 6 speech, when he said, “I hope Mike is going to do the right thing. I hope so. I hope so… all Vice President Pence has to do is send it back to the states to recertify and we become president and you are the happiest people.”

When Pence certified the electoral votes instead, he became what Navarro’s book described as “the Brutus most responsible… for the final betrayal of President Trump.”

Although the bipartisan House committee investigating the violence on Jan. 6 has demanded testimony and records from dozens of Trump allies and rally organizers believed to be involved in the attack on the nation’s democracy, Navarro said he hasn’t heard from them yet. The committee did not respond to our questions about whether it intends to dig into Navarro’s activities.

And while he has text messages, phone calls, and memos that could show how closely an active White House official was involved in the effort to keep Trump in power, he says investigators won’t find anything that shows the Green Bay Sweep plan involved violence. Instead, Navarro said, the investigative committee would find that the mob’s attack on the U.S. Capitol building actually foiled their plans, because it incentivized Pence and other Republicans to follow through with certification.

“They don’t want any part of me. I exonerate Trump and Bannon,” he said.

The committee is, however, engaged in a bitter battle with Bannon. The former Trump White House chief strategist refused to show up for a deposition or turn over documents, and he’s now being prosecuted by the Justice Department for criminal contempt of Congress.

Navarro said he’s still surprised that people at the Trump rally turned violent, given the impression he got when he went to see them in person during an exercise run that morning.

“I’m telling you man, it was just so peaceful. I saw no anger. None. Zero,” he said.

I would never have dreamed that something like that would take place in the United States. I thought we were better than that.

The craftsmanship of that gallows in the photo is shameful. The hangman’s knot isn’t even a knot. It’s like a tin can wrapped with rope or something. There’s a random nail/screw sticking out of the top on the right side of the header beam. The header beam is cut short and is barely able to span the width of the vertical posts. Shoddy all around…. And people wonder why we don’t buy American made products?

Those that made it should be hung from a gallows made as shoddily. If it takes longer to ‘work’ I’m okay with it.

Jan 6th was bad enough. At this point I think it is just as shameful and just as tragic that there is a hard core of Trump Lackey still touting a giant, disproven lie that the election was stolen, that voter reform is needed to protect the sanctity of future elections. It's mind boggling and nauseating. Truly cannot believe how brain dead and stupid the people that believe this politicians and the fake narrative.

Identify them, Investigate them, and if you find firm evidence, press charges and prove it in a court.. if you prove it, there are penalties on the books,, apply them..

If it were up to me, you wanna overthrow the government, I'd want hangings... If for no other reason than that's what THEY wanted... They've set the penalty for those actions.

Good for Florida. I would like to see other states including here in Ohio do the same. What went on in 2020 was just ridiculous. It was wrong. The same with January 6th. It was wrong. If someone wants to protest. Do it peacefully. Don't block roads, don't damage property, don't burn buildings, don't assault people. That is the difference between peaceful protest and riots. If we want a civilized society we have to have peaceful protests and they should never turn into a riot.

So just "plow them over with my car!" if they block a road instead of arresting them? Yes, vehicular homicide sounds like the proper punishment for blocking a road. I mean that is obviously more serious than what a convicted rapist would be sentenced in a court of law. For rape they might get a 10 or 15 year sentence. Blocking a road? Death by car! The perfect example of the difference between Justice and Just Us.

You have got to love GOPer states that make laws targeting political enemies… That's why Handmaid's tale is such a hit. They actually want that kind of country where they (GOPers) control everything, dragging us all back to the dark ages with them. Guys like muni, not him but people like him, sit around fantasizing about things like enslaving libs and rounding us up like cattle. These laws go after “protestors” like they are less than animals. The term protestors has of course become GOPer code for anyone not in 100% lockstep with dear leader. In that world, anyone who doesn't submit is just legal road kill to them.

As far as I am concerned once peaceful protest becomes threatening "Stand your ground" laws should apply. There were people eating dinner being threatened by these rioters. People were dragged out of their cars. Chased down streets. Beaten, robbed, etc... Once it is no longer peaceful people should have the right to defend themselves any way they seem fit.

So Ashli Babbitt absolutely got what she deserved - right? Just so you are being consistent and all. And all these looney GOPer's with this fake rhetoric that she was somehow some sort of victim - they should all stfu. Just so we are clear.

Let me get this straight. I never want to see anyone get killed. But, if she was not rioting and not breaking the law she would not have gotten shot and killed. I also, do not feel sorry for those Jan 6 rioters that get convicted. My only thing about Jan 6th and what happened in 2020 was it is all evil and should have been treated the same. The same people that cry Jan 6th in Washington condoned what was happening on the streets in 2020. Heck, the so called Vice President even paid for rioters bail to get released. That should be a crime.

My position has not changed. It is the same. Evil. January 6th tried to over turn an election and people got injured. In 2020 American citizens got killed by rioters, their businesses got burned and demolished, many many more were threatened. I will not change my decision. Wrong is wrong.

I think if you remember correctly their was a riot in Washington DC that attempted to enter the White House. Same riot that defaced Lincoln Memorial and burnt an old church down. If the guards did not physicallt restrain the rioters they would have entered the white house. That was just as much an insurrection as January 6th. Both were riots that spiraled out of control and the rioters should have been put down by force.

Blocking a roadway isn't a threat. It's annoying, it can make you late, all of which are wrong but none of that is a license to impose the death penalty. There's no "stand your ground" that applies here. If they attack your vehicle trying to get to you in order to do you bodily harm that's a different matter. All you're doing is trying to make excuses that would make vehicular homicide legal. Now all of a sudden killing your political opponents for a common misdemeanor seems to be what is becoming popular. And people wonder why I suggest liberals arm themselves.

Just wait until some Proud Boy or Oath Keeper gets killed due to such a stupid law and watch how fast they overturn it.

I think the only point in time anyone's life is threatened in such a situation that applies to stand your ground is when someone tries to run them over with a car for just standing there. Then the person they're trying to run over is actually having their life threatened and have every right to use a firearm in self defense.

You are trying to determine if the driver of the car feel threatened or not. If they feel unsafe. I side with them because they are not breaking the law.

I do not side with Proud Boys or Oath Keepers if they condone violence. Protecting yourself comes first and foremost. Causing the problem by going outside the bounds of legal peaceful protests is another. Right or left everyone deserves the right to peaceful protest. No one deserves the right to infringe on someone else. If someone feels threatened they should have the right to defend their selves. If you do not want to get run over by a car, shot, or anything else do not go out of the bounds of peaceful protest.

But that wasn't what we were talking about nor what the law states that we're talking about. Any time someone puts their hands on you, you have every right to defend yourself. That has nothing to do with it being legal for someone to run over another person simply because they're blocking a roadway. Surely you can see those are two very different things. You have to have a level of proof to show a reasonable person would have "felt threatened". Someone just standing there blocking the road? That would be a ridiculous claim.

Stand your ground laws aren't just about "your feelings".

Protests should be civil. Should be peaceful. Don't be threatening. You only want the law to go one way. I say both have rights. The protester has rights to peaceful protest but when they go out of bounds and become a threat by standers should have rights. That is called being a citizen and not a statistic.

No, I don't want the law to go one way. Nothing has been civil in this country about politics for a very long time now. Being "civil" has nothing to do with giving you a right to kill someone. Making a verbal threat alone has never given anyone the right to kill someone either. Once they cross the line to put their hands on you that's a different matter.

Let me give you an example.....

In Trump's campaign rallies, he turned his wrath on reporters covering the rallies. He has his hard core supporters believing they're fake news and even went so far as to call them "the enemy of the people". Now this was an angry crowd Trump already had worked into a frenzy. People in the crowds were threatening them. So just how threatened do you think they felt and what "right to defend themselves" did they have?

You see, for me to feel it should all be a one way street as you pt it, I would have to suggest there are two different standards for different groups of people. I don't. What I will not condone from either side is when they say you can kill someone for committing a misdemeanor which isn't a direct threat to anyone's safety no matter what "their feelings" are.
