As per usual, the trump team has tried to quash the case against him with yet another failed attempt in a frivolous and abusive court filing. I figured we may as well have a thread concerning yet another criminal case being launched against the trump crime family since it's the latest one grabbing the headlines........

Trump's bid to quash Georgia probe rejected by judge as charges loom

July 31 (Reuters) - The judge presiding over a Georgia grand jury investigation into Donald Trump on Monday rejected the former U.S. president's bid to disqualify the lead prosecutor and block any indictments stemming from the probe, which is expected to yield charges in the coming weeks.

Fulton County Superior Court Judge Robert McBurney also denied Trump's request to quash a special grand jury report that included recommendations on whom to charge in connection with a campaign to overturn Georgia's 2020 election results, when Democrat Joe Biden narrowly carried the state.

The report has remained sealed pending charges in the case.

Fulton County District Attorney Fani Willis has indicated she intends to ask a grand jury to approve charges sometime in the next three weeks, telling judges that her staff will mostly work remotely as a safety precaution.

Security barricades were erected outside the county courthouse last week.

Trump has denied any wrongdoing and accused Willis, an elected Democrat, of political motives. A spokesperson and his Georgia-based legal team did not immediately respond to requests for comment.

A spokesperson for Willis declined to comment.

Trump's lawyers have filed a separate long-shot bid to disqualify Willis that will be heard by another judge next week. That motion was assigned to a judge from another county because it names McBurney in addition to Willis; as a result, all Fulton County judges were recused from hearing it.

Willis has been investigating Trump's attempt to reverse the 2020 election outcome since January 2021, shortly after Trump was recorded on a phone call asking the state's top election official to "find" enough votes to overturn Biden's victory.

The wide-ranging probe has also examined the conduct of Trump's attorneys, including Rudy Giuliani, and a group of individuals who served as alternate electors in an unsuccessful effort to have the state's electoral votes awarded to Trump rather than Biden.

The special grand jury was convened at Willis's request to aid in her investigation. The jury, which had subpoena power but not the authority to issue charges, heard testimony from dozens of witnesses.

Trump has falsely claimed the election in Georgia and elsewhere was marred by widespread fraud, despite dozens of court rulings finding no evidence to support it.

In his nine-page decision, McBurney said Trump's bid to block the probe was premature, given that no charges had yet been filed, and that he would have ample opportunity to challenge the propriety of the investigation if and when he faces an indictment.

McBurney also said Trump had not shown Willis had acted in a biased fashion, despite granting press interviews and tweeting about the case.

"The drumbeat from the district attorney has been neither partisan (in the political sense) nor personal, in marked and refreshing contrast to the stream of personal invective flowing from one of the movants," he wrote.

Fulton County District Attorney Fani Willis (D) said she thinks the local sheriff is “doing something smart” by installing security barriers ahead of a charging decision in a case against former President Trump.

“Some people may not be happy with the decisions that I’m making, and sometimes, when people are unhappy, they act in a way that could create harm,” Willis told an 11Alive reporter in Sandy Springs, Ga.

“I think that the sheriff is doing something smart in making sure that the courthouse stays safe,” she continued. “I’m not willing to put any of the employees or the constituents that come to the courthouse in harm’s way.”

The increased security measure comes as Willis is expected to seek a grand jury indictment in her investigation into Trump and his Republican allies to overturn the 2020 election in the state.

Willis’s investigation into whether Trump violated the law has lasted more than two years. She has focused heavily on a call Trump made to Georgia Secretary of State Brad Raffensperger (R) in January 2021; during the call, Trump asked Raffensperger to “find” 11,780 votes to overturn President Biden’s win in the 2020 election.

The probe has also looked into phone calls made to other state officials, fake Republican electors, alleged efforts to pressure two election workers and unproven claims of election fraud.

Willis reaffirmed to 11Alive she plans on announcing charging decisions by Sept. 1.

In a letter in May, Willis asked judges in the Georgia County to clear the schedule of trials and in-person hearings for the weeks of Aug. 7 and Aug. 14, an indication of possible charges. She previously said around 70 percent of her staff will be working remotely.

One of the two grand juries sworn in earlier this month in Atlanta is expected to hear the case.

Trump has tried twice to quash the Georgia investigation, filing a motion in the state court and another court to prohibit the filing of any changes earlier this month. He also filed a motion in March.

An indictment in the case would mark the former president’s third criminal indictment this year. He faces 34 charges related to falsifying business records in New York and a new total of 40 criminal counts over his handling of classified documents at his home in Mar-a-Lago. He has pleaded not guilty in both of these cases.

Trump said earlier this month he was notified he is also a target in the Justice Department’s investigation into his efforts to remain in power after losing the 2020 election, an indication an indictment in that case could also come soon.

I was going to start this yesterday, but went outside to work in the yard before the rain came.

Willis said she is ready to go with charges.
I had heard at least 12 getting charged. There may be some that were the fake jurors that didn't take a plea deal, but it was on over the weekend that there "will be some names that you know"

Fulton County D.A. receives racist threats as charging decision against Trump looms

District Attorney Fani Willis warned Fulton County commissioners this weekend they should "stay alert" over the next month, according to emails obtained by CBS News.

She pointed to a threatening email she received last week with a subject line reading, "Fani Willis = Corrupt N*****." The body of the email said, "You are going to fail, you Jim Crow Democrat whore."

Willis said the message was "pretty typical" of what her office has been receiving and said she is aware of "equally ignorant voicemails" that have come into the county office and to her own office. She said she expects more over the next month. The Atlanta Journal-Constitution first reported Wills' warning to the county commissioners.

"I took an oath. No one other than the citizens of Fulton County put me in this seat. I have every intention of doing my job. Please make decisions that keep your staff safe," Willis wrote.

In response, the Fulton County solicitor general called the message "reprehensible" and said his office's investigative team is making modifications to "align us with other law enforcement partners within the county."

Over the weekend, Willis told NBC affiliate WXIA that security is being increased around the county courthouse and said she's "ready to go" following her 2 1/2-year investigation into alleged efforts by former President Donald Trump and his allies to upend President Joe Biden's 2020 presidential election victory in Georgia.

A special grand jury was convened in May 2022 to investigate those alleged efforts, and it issued a report earlier this year, with a unanimous finding that "no widespread fraud took place in the Georgia 2020 presidential election that could result in overturning that election." Portions of the report remain sealed.

Monday marks the opening day of the three-week window that Willis cited for a potential decision on whether to charge former President Donald Trump, members of his administration, allies or so-called "fake electors" who sought to overturn Georgia's presidential election results. Two regular grand juries were sworn in earlier this month, and one of them could eventually hear evidence presented by Willis. Orange barricades have been set up around part of the Fulton County courthouse.

A Georgia judge on Monday rejected Trump's request to quash a report by a special grand jury in Fulton County about his conduct after the 2020 election and to disqualify Willis from further involvement in the case.

After what happened on Jan. 6th I don't think they have any other choice but to be overly cautious. In terms of January 6th that rally was announced a full week before it was to occur. That gave people seven days to organize. With these indictments trump usually has to appear withing the next few days. It limits the time for these groups to organize and be there in huge numbers.

Now when the trials start, there will be advanced notices of the date the trial begins for a long period of time. It will give them even more time than they had to prepare for January 6th. That's when I think we will see chaos.

Former Georgia lieutenant governor says he received grand jury subpoena

Fulton County DA Fani Willis appears to be nearing the end of her probe.

As the Fulton County investigation into 2020 election interference in Georgia continues, the former lieutenant governor of the state has been subpoenaed to appear before a grand jury, he said in a post on X, formerly known as Twitter, on Monday night and confirmed to ABC News.

"I will continue to share the facts as I know them around this investigation in hopes of figuring out what really happened," former Lt. Gov. Geoff Duncan, a Republican, wrote.

Duncan served as president of the Georgia Senate in 2020, when Rudy Giuliani -- who has previously been notified that he is a target of the investigation in Georgia -- appeared during a hearing to push false 2020 election fraud claims.

The subpoena comes as Fulton County District Attorney Fani Willis -- who has been probing Donald Trump and his allies' efforts to overturn the 2020 election results in Georgia for over two and a half years -- appears to be nearing the end of her work.

She has previously said that her charging announcement would come by Sept. 1, and at the end of last month she said that her "work is accomplished."

"We've been working for two and a half years," she told the local outlet. "We're ready to go."

Duncan, who is a CNN contributor, said in an interview with Wolf Blitzer on Monday that "We can never repeat that in this country," according to an article from the outlet.

"Certainly I never want to see that happen in my home state of Georgia, a lot of good peoples' lives were uprooted, a lot of people's reputations have been soiled," Duncan said.

When reached by ABC News, Duncan confirmed he received a subpoena. Asked about the timing of his testimony, he said: "I do not have any additional details at this time."

Trump's legal team last week filed a notice of appeal signaling their intent to appeal a judge's orders denying their efforts to have DA Wallis removed from her probe into efforts to overturn the 2020 election results in Georgia.

Trump has publicly denounced the investigation and has denied all wrongdoing.

I believe she has the last of the witnesses coming in tomorrow. They could vote and announce the charges by Wed or Thursday this week.

A few fun facts about Georgia.

Cameras can be allowed in the court-so it may be televised.
a RICO state charge in Georgia is worse than a fed charge-5 years mandatory minimum.
You cannot be pardoned by the president-but you can be pardoned by the governor/state board-5 years after your complete sentence is done.
And I have also seen that depending on the charges you are convicted of, you are not allowed to run for public office in the state

I have seen the RICO act bandied about due to the way Georgia law is worded in their laws. Not sure how much validity there is to it but it will be interesting to see if such charges are brought forward. If so I'll look into it more.

The judge was asked to stay tonight and is still there. CNN is reporting that a vote is imminent or already ongoing. There was a docket this afternoon on Fulton Co website that has been taken down that showed 13 felonies against trump including rico

Trump and 18 allies charged in Georgia election meddling as former president faces 4th criminal case

ATLANTA (AP) — Donald Trump and 18 allies were indicted in Georgia on Monday over their efforts to overturn his 2020 election loss in the state, with prosecutors using a statute normally associated with mobsters to accuse the former president, lawyers and other aides of a “criminal enterprise” to keep him in power.

The nearly 100-page indictment details dozens of acts by Trump or his allies to undo his defeat, including beseeching Georgia’s Republican secretary of state to find enough votes for him to win the battleground state; harassing an election worker who faced false claims of fraud; and attempting to persuade Georgia lawmakers to ignore the will of voters and appoint a new slate of electoral college electors favorable to Trump.

In one particularly brazen episode, it also outlines a plot involving one of his lawyers to access voting machines in a rural Georgia county and steal data from a voting machine company.

“The indictment alleges that rather than abide by Georgia’s legal process for election challenges, the defendants engaged in a criminal racketeering enterprise to overturn Georgia’s presidential election result,” Fulton County District Attorney Fani Willis, whose office brought the case, said at a late-night news conference.

Other defendants include former White House chief of staff Mark Meadows; Trump attorney and former New York City Mayor Rudy Giuliani; and a Trump administration Justice Department official, Jeffrey Clark, who aided the then-president’s efforts to undo his election loss in Georgia. Other lawyers who advanced legally dubious ideas to overturn the results, including John Eastman, Sidney Powell and Kenneth Chesebro, were also charged.

Willis said the defendants would be permitted to voluntarily surrender by noon Aug. 25. She also said she plans to seek a trial date within six months and that she intends to try the defendants collectively.

The indictment bookends a remarkable crush of criminal cases — four in five months, each in a different city — that would be daunting for anyone, never mind someone like Trump who is simultaneously balancing the roles of criminal defendant and presidential candidate.

It comes just two weeks after the Justice Department special counsel charged him in a vast conspiracy to overturn the election, underscoring how prosecutors after lengthy investigations that followed the Jan. 6, 2021 riot at the U.S. Capitol have now, two-and-a-half years later, taken steps to hold Trump to account for an assault on the underpinnings of American democracy.

The Georgia case covers some of the same ground as Trump’s recent indictment in Washington, including attempts he and his allies made to disrupt the electoral vote count at the Capitol. But in its sprawling web of defendants — 19 in total — the indictment stands apart from the more tightly targeted case brought by special counsel Jack Smith, which so far only names Trump as a defendant.

In charging close Trump aides who were referenced by Smith only as unindicted co-conspirators, the Georgia indictment alleges a scale of criminal conduct extending far beyond just the ex-president.

The indictment, with charges under the state’s racketeering law and language conjuring the seedy underworld of mob bosses and gang leaders, accuses the former president, his former chief of staff, Trump’s attorneys and the ex-New York mayor of being members of a “criminal organization” and “enterprise” that operated in Georgia and other states.

The indictment capped a chaotic day at the courthouse caused by the brief but mysterious posting on a county website of a list of criminal charges that were to be brought against the former president. Reuters, which published a copy of the document, said the filing was taken down quickly.

A Willis spokesperson said in the afternoon that it was “inaccurate” to say that an indictment had already been returned but declined to comment further on a kerfuffle that the Trump legal team jumped on to attack the investigation’s integrity.

Trump and his allies, who have characterized the investigation as politically motivated, immediately seized on the apparent error to claim that the process was rigged. Trump’s campaign aimed to fundraise off it, sending out an email with the since-deleted document embedded.

In a statement after the indictment was issued, Trump’s legal team said “the events that have unfolded today have been shocking and absurd, starting with the leak of a presumed and premature indictment before the witnesses had testified or the grand jurors had deliberated and ending with the District Attorney being unable to offer any explanation.”

The lawyers said prosecutors presenting their case “relied on witnesses who harbor their own personal and political interests — some of whom ran campaigns touting their efforts against the accused.”

Trump responded to the indictment Tuesday by announcing a news conference for next week to present yet another “almost complete” report on the alleged fraud he has yet to prove nearly three years after the 2020 election.

Many of the 161 acts by Trump and his associates outlined in the Georgia indictment have already received widespread attention. That includes a Jan. 2, 2021, call in which Trump urged Secretary of State Brad Raffensperger to “find” the 11,780 votes needed to overturn his election loss. That call, prosecutors said, violated a Georgia law against soliciting a public official to violate their oath.

It also accuses Trump of making false statements and writings for a series of claims he made to Raffensperger and other state election officials, including that up to 300,000 ballots “were dropped mysteriously into the rolls” in the 2020 election, that more than 4,500 people voted who weren’t on registration lists and that a Fulton County election worker, Ruby Freeman, was a “professional vote scammer.”

Giuliani, meanwhile, is accused of making false statements for allegedly lying to lawmakers by claiming that more than 96,000 mail-in ballots were counted in Georgia despite there being no record of them having been returned to a county elections office, and that a voting machine in Michigan wrongly recorded 6,000 votes for Biden that were actually cast for Trump.

In a statement, Giuliani did not respond directly to the allegations but called the indictment an “affront to American democracy” and “just the next chapter in a book of lies.”

Also charged are individuals prosecutors say helped Trump and his allies on the ground in Georgia influence and intimidate election workers.

One man, Stephen Cliffgard Lee, was charged for allegedly traveling to Freeman’s home “with intent to influence her testimony.” Freeman and her daughter Shaye Moss testified to Congress last year about how Trump and his allies latched onto surveillance footage from November 2020 to accuse both women of committing voter fraud — allegations that were quickly debunked, yet spread widely across conservative media.

Both women, who are Black, faced death threats after the election.

The indictment also accuses Powell and several co-defendants of tampering with voting machines in Coffee County, Georgia, and stealing data belonging to Dominion Voting Systems, a producer of tabulation machines that has long been the focus of conspiracy theories. An attorney for Powell declined to comment.

According to evidence made public by the congressional committee investigating the Jan. 6 riot, Trump allies targeted Coffee County in search of evidence to back their theories of widespread voter fraud, allegedly copying data and software.

Besides the two election-related cases, Trump faces a separate federal indictment accusing him of illegally hoarding classified documents as well as a New York state case charging him with falsifying business records.

As indictments mount, Trump — the leading Republican candidate for president in 2024 — often invokes his distinction as the only former president to face criminal charges. He is campaigning and fundraising around these themes, portraying himself as the victim of Democratic prosecutors out to get him.

Republican allies once again quickly rallied to Trump’s defense. “Americans see through this desperate sham,” House Speaker Kevin McCarthy wrote on X, the platform formerly known as Twitter.

I would think the hardest part in proving these allegations would be tying these people all together as it pertains to the RICO act. There may be texts, emails and other communications shown that does that. We shall see. Making the connection that they were somehow linked as a criminal enterprise is something that may be very difficult to prove to a jury. Seeing the evidence she has to support that at trial will be very interesting.

So, that’s multiple grand jury’s - not jack smith - that have decided to indict Trump and his henchmen.

Also, Georgia is ran by Republican state legislators and governor.

Also, the co-defendants are people who worked for trump and some even flipped.

I don’t wanna hear crap about deep state, TDS, never-Trumpers, or any of that.

I’ll even be charitable and give the good ole boy line of “hey, he’s innocent until proven guilty.”

What to know about Scott McAfee, the judge overseeing Trump's Georgia case

Fulton County Superior Court judge Scott McAfee is set to oversee former President Trump's case regarding alleged efforts to overturn Georgia's 2020 election results.

Driving the news: McAfee is the newest judge on the Fulton County Superior Court, having joined in February.

McAfee was tapped for the position by Georgia Gov. Brian Kemp (R) in December.

Kemp himself became a Trump target in the wake of the 2020 election, after resisting his request to help overturn the 2020 election results.

McAfee's background

McAfee earned his law degree from the University of Georgia. He also studied music at Emory University, playing cello in the university symphony orchestra.

He most recently served as the Georgia inspector general.

"Scott McAfee is a strong addition to my administration," Kemp said in 2021 when he appointed McAfee to the role.

McAfee previously worked as a state and federal prosecutor, serving as assistant U.S. attorney in the Northern District of Georgia and as senior assistant district attorney in the Fulton County Atlanta Judicial Circuit.

Picking a trial date for Trump as he faces a busy courtroom calendar during an election year will be one of McAfee's earliest decisions.

Fulton County District Attorney Fani Willis said at a press conference late Monday while unveiling the indictment that she hopes to secure a trial date "within the next six months."

Those charged have until noon Friday, Aug. 25, to surrender.

Worth noting: McAfee's ruling against pro-Trump attorney Lin Wood in June offers insight into how he might approach public statements by Trump ahead of the trial, ABC News reported.

McAfee fined Wood $5,000 in contempt of court for making public disparaging comments about former associates, in violation of a non-disparagement clause.

The presumption is the defendant has the burden of rebutting, i.e. it is on the defendant to show that he will not commit crimes, that he is not a risk of flight. The exact words of statute to approve bail that the judge must find "the defendant poses no risk of intimidating witnesses or otherwise obstructing the administration of justice."

Trump campaign lashes out at Fani Willis after grand jury delivers indictment

The Trump campaign on Monday blasted Fulton County District Attorney Fani Willis and other prosecutors investigating former President Donald Trump as charges in Georgia over efforts to overturn the state’s 2020 election results appeared imminent.

In a statement that was not attributed to an individual spokesperson, the Trump campaign derided Willis as a “rabid partisan who is campaigning and fundraising on a platform of prosecuting President Trump through these bogus indictments.”

“Ripping a page from Crooked Joe Biden’s playbook, Willis has strategically stalled her investigation to try and maximally interfere with the 2024 presidential race and damage the dominant Trump campaign. All of these corrupt Democrat attempts will fail,” the campaign said in a statement.

The campaign recycled a common claim, that prosecutors could have brought charges against Trump shortly after he left office two-and-a-half years ago, even though Willis and others have spent months investigating the former president and his efforts to overturn the 2020 election results.

The former president and his allies have accused Willis and others of engaging in “election interference” intended to thwart his 2024 White House campaign, where he is leading in Republican primary polls by a wide margin.

“These activities by Democrat leaders constitute a grave threat to American democracy and are direct attempts to deprive the American people of their rightful choice to cast their vote for President,” the campaign statement said. “Call it election interference or election manipulation—it is a dangerous effort by the ruling class to suppress the choice of the people. It is un-American and wrong.”

The campaign vowed Trump “will never give up,” and suggested Trump has a right to free speech in claiming the 2020 election was rigged.

The statement was issued shortly after a grand jury returned an indictment in the investigation into efforts to subvert Georgia’s 2020 election results, where President Biden defeated Trump by roughly 11,000 votes.

The specifics of the indictment were not immediately clear, though they were expected to be unsealed late Monday.

Willis has been investigating the pressure campaign against elected officials, as well as a scheme to set up alternate electors who would back Trump despite multiple recounts certifying Biden’s victory in the state.

I don't think Trump will ever admit that he did wrong. All evidence shows he did but he won't admit it.

I'm not sure I 100% understand it, but I guess Georgia can remove what they term as under performing DA's. That rule or law goes into effect in about 7 weeks or so. A panel needs to be assembled and they decide. I don't know if this will effect Fani Willis or not.

What this indictment brought out was that Trump ran a crime family not Biden. Funny how it always seems that Trump and the Republicans tend to call Democrats and Biden out for everything they themselves do.
