In Giboney v. Empire Storage & Ice Co. (1949), the Supreme Court held the First Amendment affords no protection to “speech or writing used as an integral part of conduct in violation of a valid criminal statute.” A robber’s demand at gunpoint that you hand over your money is not protected speech. Nor is extortion, criminal conspiracy, or solicitation to commit a specific crime. Abstract advocacy of lawbreaking remains protected speech.
If the prosecution can prove that trump committed crimes and that his speech was a part of helping or aiding in perpetrating those crimes, the speech he used in the commission of those crimes is not protected

Now that special counsel Jack Smith has indicted Donald Trump in both of the prosecutor’s investigations, it’s tempting to think the focus will now shift to a new stage. Instead of learning about incremental developments in the respective probes, we should expect to see defense counsel and federal prosecutors begin preparing for upcoming trials.
But in this instance, it’s not quite that simple. For example, as NBC News reported, we learned new information today about Smith’s investigation into Trump’s post-election wrongdoing.
Special counsel Jack Smith’s office executed a search warrant on former President Donald Trump’s Twitter account earlier this year, searching for “evidence of criminal offenses,” according to a court ruling made public on Wednesday.
According to the latest reporting, as prosecutors executed a search warrant — a step the former president described today as an “attack“ — Twitter was slow to cooperate, leading to court-imposed sanctions.
A Washington Post report added that a newly unsealed appellate court ruling also revealed that District Court Judge Beryl Howell “found reason to believe that should the search warrant be made public, Trump might engage in obstructive conduct or flee prosecution.”
It’s an important detail: When the Justice Department sought information from Twitter, investigators reminded the social media company that it could not alert the former president to the search. As a New York Times report summarized, prosecutors feared that if the Republican learned about the warrant, it “would seriously jeopardize the ongoing investigation” by giving him “an opportunity to destroy evidence, change patterns of behavior, [or] notify confederates.”
Trump apparently sees this as a civil rights violation, but a federal judge understandably concluded that if the Republican was made aware of the warrant, he might try to obstruct the process — as he appears to have done before.
As for what the special counsel’s office was looking for, there’s plenty of interesting speculation, but we don’t yet know.
That’s not, however, the only revelation of note. Indeed, we also learned this week that a grand jury weighing evidence in the Trump election case returned to work yesterday — news that coincided with reports Smith and his team continue to scrutinize the Save America PAC’s finances.
Indeed, none other than Bernie Kerik, a highly controversial former New York City police commissioner, spoke with investigators this week, and said soon after that the lines of inquiry related to Team Trump’s fundraising efforts — an angle no doubt familiar to regular readers.
In case this weren’t quite enough, the New York Times also reported overnight on an internal campaign memo on the fake electors scheme from a Trump lawyer.
The existence of the Dec. 6, 2020, memo came to light in last week’s indictment of Mr. Trump, though its details remained unclear. But a copy obtained by The New York Times shows for the first time that the lawyer, Kenneth Chesebro, acknowledged from the start that he was proposing “a bold, controversial strategy” that the Supreme Court “likely” would reject in the end. But even if the plan did not ultimately pass legal muster at the highest level, Mr. Chesebro argued that it would achieve two goals. It would focus attention on claims of voter fraud and “buy the Trump campaign more time to win litigation that would deprive Biden of electoral votes and/or add to Trump’s column.”
Taken together, it’s a timely reminder: There’s still plenty more to learn about the investigation and the underlying scandal.
Hours after the release of a grand jury indictment charging former President Donald Trump with “using dishonesty, fraud, and deceit to impair, obstruct, and defeat the lawful federal government function by which the results of the presidential election are collected, counted, and certified,” the former president’s amen corner responded with a familiar refrain.
House Speaker Kevin McCarthy denounced the Biden Administration’s “distraction from the news” and “two-tiered system of justice.” “When you drain the swamp, the swamp fights back,” declared Rep. Jim Jordan. “President Trump did nothing wrong.” Florida Gov. Ron DeSantis promised, if elected president, to end “the politicization of the rule of law” and “the weaponization of the federal government.”
DeSantis admitted he had not read the indictment. It’s a safe bet he is not the only MAGA Republican who prefers to keep his mind unsullied by facts.
That said, every American should read the 45 pages of the DOJ indictment. A primer on American law, the U.S. Constitution, and the Electoral College, the document presents detailed, credible and compelling evidence about the attempt by President Trump and six co-conspirators to overturn a free and fair election. Equally important, the indictment gives Americans an opportunity to judge for themselves whether or not prosecuting the former president is evidence of a witch hunt, two-tiered system of justice, or weaponized federal government.
To whet appetites, here’s a brief summary:
The indictment clearly states that President Trump “had a right, like every American, to speak publicly about the election, and even claim, falsely, that there had been outcome-determinative fraud during the election and he had won.” So the charges against him concern conduct — his unlawful attempt to disenfranchise legal voters and subvert election results — and not Trump’s First Amendment right to free speech.
The indictment demonstrates that Republican state legislators, election officials, and members of the Trump Administration repeatedly and unequivocally told the president he had lost the election and systematically debunked specific claims of widespread fraud. A partial list includes the Speaker of the House in Arizona; the Speaker of the House and Senate Majority Leader in Michigan; the Philadelphia City Commissioner; the Secretary of State in Georgia; leaders of the Department of Justice, including the Attorney General, Acting Attorney General and Assistant Attorney General; the Director of National Intelligence; the Director of the Cybersecurity and Infrastructure Security Agency; White House attorneys; and senior staff on Trump’s reelection campaign.
Virtually all claims of fraud, moreover, were dismissed or rejected in no fewer than sixty court proceedings, including more than a few presided over by judges who had been appointed by Trump himself.
Nonetheless, Trump continued to insist that voting machines in several states had been programmed to switch votes to Biden; 149,772 illegal votes were dumped in “corrupt” Detroit, Michigan; 10,000 out-of-state and dead individuals voted in Georgia; 30,000 non-citizens voted in Arizona; tens of thousands double-voted in Nevada; 205,000 more votes were recorded in Pennsylvania than the number of registered voters in the state.
These false claims provided the justification for a multifaceted campaign, directed by the president and in violation of multiple federal statutes, to overturn the 2020 election. Trump and his co-conspirators pressured state legislators and election officials to delay or reject certification of the results reported by Democratic counties and to find more Trump votes. The president directed Acting Attorney General Jeffrey A. Rosento send a letter to officials in battleground states indicating that the DOJ had identified “significant concerns” (later changed to “significant irregularities”) that may have affected the outcome. When Rosen demurred, Trump said, “Just say that the election was corrupt and leave the rest to me and the Republican congressmen.” And the president made plans to replace Rosen with a more pliable Acting Attorney General.
The plotters also attempted to supplant legitimate delegates to the Electoral College from battleground states with fraudulent slates of electors. Originally designed to be used only if litigation was successful, the scheme went forward even though the vote count had been certified by the appropriate officials and court challenges had failed. This scheme gave Trump’s allies in Congress a pretext to propose sending the allegedly disputed results back to the states on January 6. Trump also pressed Vice President Mike Pence again and again, privately and in public, to reject Electoral College votes for Biden. When Pence maintained he had no authority to do that, Trump replied, “You’re too honest.” Denounced by the president for failing to “do the right thing,” Pence narrowly escaped a mob determined to hang him on January 6, 2021.
The allegations against Trump involve an indispensable feature of American democracy, the peaceful transfer of power from one president to another. The allegations are serious and sobering. If they are true, Donald Trump’s conduct, at the very least, renders him unfit to serve as president.
But don’t take my word for it. Or the word of willfully uninformed Trump apologists in Congress, on cable TV, talk radio, and social media. Take an hour or two, read the 45-page indictment, and draw your own conclusions. The country you save may be your own.
So I was texting with a HS classmate the other day. He insists that Jack Smith is a liberal parrot. (his words) When I mentioned that he also prosecuted John Edwards years ago, HOLY SMOKES... He went ballistic telling me that he lost that case and that he sucked etc etc. And that the cases weren't even similar.. I agree, Trump broke federal laws, Edwards cheated on his dying wife. Geez, you'd have thought I killed his first born.... LOL
When I asked him why he felt that Smith was a liberal, OMG.. He went nuts again.... As long as there are those out there that think like that then Trump will always have an audience. I didn't pay that much attention to his answer as to why he believed that, but I assure you it wasn't making sense.

'Daring the judge': Donald Trump attacks judge in 2020 election case, despite her warnings
WASHINGTON — Former President Donald Trump launched a post-midnight attack Monday on the judge handling the case charging him with seeking to steal the 2020 election, despite a warning from the court late last week against "inflammatory statements."
U.S. District Judge Tanya Chutkan "obviously wants me behind bars. VERY BIASED & UNFAIR!" Trump said in a Truth Social post just after 1 a.m.
Trump, who also protested an expected indictment in Atlanta in statements over the weekend, cited Chutkan's comments during the sentencing of a person convicted for participating in the insurrection attempt of Jan. 6, 2021.
Noting that the people who mobbed the Capitol that day wore caps and carried flags with the name of one man, Trump, Chutkan said in October 2022: "It's blind loyalty to one person who, by the way, remains free to this day.”
'Inflammatory statements'
Chutkan, who has been assigned the case that accuses Trump of conspiring to steal the 2020 election from President Joe Biden, issued a protective order Friday restricting what Trump can say publicly about the evidence against him.
The federal judge is known for imposing stiff sentences on the individuals who participated in the Capitol riot, but veteran federal court watchers told USA TODAY that she is a consummate professional who will handle a sensitive case with the utmost care.
'Testing the judge'?
Trump's statements could lead to a speedier trial than the former president wants, the judge indicated.
"I intend to ensure the orderly administration of justice in this case as I would with any other case," Chutkan said during a hearing Friday. "The more a party makes inflammatory statements about this case which could taint the jury pool or intimidate potential witnesses, the greater the urgency will be that we proceed to trial to ensure a jury pool from which we can select an impartial jury."
Prosecutors have requested a trial date of Jan. 2; Trump and his attorneys said that would damage his 2024 presidential campaign. The Iowa caucuses are Jan. 15.
Legal analyst said it looks like Trump is testing Chutkan. "He is just daring the judge now," said national security attorney Bradley P. Moss.
Trump has said he might seek a recusal of Chutkan, but his attorneys have not filed anything formally.
Georgia investigation into Trump
During a weekend that included a visit to the Iowa State Fair, Trump also protested an investigation in Atlanta that appears headed toward a grand jury decision as soon as this week.
An Atlanta grand jury meets this week to discuss charges that Trump and his associates with conspiring to overturn his 2020 loss in Georgia to Biden.
In Truth Social posts, Trump attacked Fulton County District Attorney Fani Willis and said she "is using a potential Indictment of me." In a series of posts early Monday, Trump attacked Willis as well as one of this week's grand jury witnesses, former Georgia Lt. Gov. Geoff Duncan.
There isn't evidence state or federal officials handling cases against Trump are targeting his reelection bid.
Not that this is about J6, but the judge in the Fulton County case is saying he'll allow the trial to be Televised. We'll get to see him squirm.

Texas woman charged with threatening to kill judge overseeing Trump’s federal election interference case
A Texas woman has been charged with threatening in a voicemail to kill the federal judge overseeing former President Donald Trump’s criminal case in Washington, DC, over his attempts to overturn the 2020 election.
Abigail Jo Shry called the chambers of Judge Tanya Chutkan on August 5, and left a voicemail message threatening to “kill anyone who went after former President Trump,” according to a criminal complaint.
The death threats also allegedly included racist comment against Chutkan, who is Black. Prosecutors said in court filings that Shry called the judge a “stupid slave n***er” in the voicemail.
Shry is charged with Transmission in Interstate or Foreign Commerce of any Communication Containing a Threat to Injure the Person of Another. She is being held in detention pending trial, according to court documents, and a bond hearing has been set for September 13.
“If Trump doesn’t get elected in 2024, we are coming to kill you, so tread lightly, b*tch,” Shry said in the message, according to the complaint. “You are in our sights, we want to kill you.”
Investigators said in the complaint that Shry continued her threats in the recording, saying: “You will be targeted personally, publicly, your family, all of it.”
On August 8, Shry admitted to Department of Homeland Security special agents that she made the call to Chutkan’s chambers but that she “had no plans to travel to Washington, DC or Houston to carry out anything she stated,” the complaint said.
CNN has reached out to the public defender’s office in Houston that is representing Shry.
CNN has also reached out to a representative for Chutkan. As previously reported, security for the district judge had been increased in the federal courthouse in Washington, DC.
Shry, according to the complaint, also made “a direct threat to kill Congresswomen Sheila Jackson Lee, all democrats in Washington D.C. and all people in the LGBTQ community.”
CNN has reached out to the office of the Texas Democrat for comment.
I'm pretty convinced that these folks have been out there for a very long time. Long before Donald Trump came along. But I'm equally convinced that the reason they love him is because he's one of them.

Everyone knows that there's nothing about any of this that is normal. Much of it even criminal. I can say that to a person every poster they label as liberal on this board called out what happened during the BLM protests that turned into riots after dark. They called for them to be prosecuted and serve their time for their crimes. Now that the tables have turned, all we have heard is crickets.
I just wonder at what point and what's it going to take for sane Republicans to actually fight in order to try and take their party back? Existing on nothing but the fear of trump isn't helping them or their cause.

And actually, 95% of all of those protests were non violent. That didn't stop us from calling out those that were by showing how many weren't. Look, we get it. The truth is clear and there's not a ton left to debate. Those that would want to argue know they (for the most part) wont' have truth, justice, or in many cases decency, on their side.

It's often interesting to watch the selective outrage take place. Posters like you obviously follow a logical approach and apply that same sound logic to the issue regardless of whether it's a liberal or conservative issue.
Others, however, will only chime in on a thread if it is convenient to where their outrage lies. Double standards are also rampant. For instance, and I'm making this up, you might have someone who wants to take more of a wait and see what the evidence and outcome is for the various Trump criminal cases while also knee-jerk reacting that Biden is a criminal because of the Hunter situation. That's not atypical in the greater public dynamic though, either. Chris Rock actually had a pretty good spiel on selective outrage during his most recent standup special.
