Two conservative legal scholars, members of the Federalist Society in good standing, have just published an audacious argument: that Donald Trump is constitutionally prohibited from running for president, and that state election officials have not only the authority but the legal obligation to prevent his name from appearing on the ballot.

The legal paper, authored by University of Chicago professor William Baude and University of St. Thomas professor Michael Stokes Paulsen, centers on Section 3 of the 14th Amendment — a provision that limits people from returning to public office if they have since “engaged in insurrection or rebellion” or “given aid or comfort” to those who have. Baude and Paulsen argue that this clearly covers Trump’s behavior between November 2020 and January 2021.

Nope, never determined in a court of law. Trump would sue about the subject matter in an instant, and it winds up in a court of law, anyway.

Lawyers can offer opinions, but they are not a judge or a court.

Same way with a state legislature or attorney general of any state. The matter would wind up in a court.. but if a court agrees with the finding, it could cascade to other state on that basis.

These people are conservative constitutional scholars. Yale grads.

I don’t really care who they are or what their credentials or political leanings are.

They have no power to make a legislative or legal determination.

Only a court of law or perhaps a state legislature or attorney general can declare the Donald guilty of insurrection, so the 14th amendment could be applied. And that would be challenged by the Donald.

After the Civil war, a vote to succeed was the “act” by a person to apply the 14th amendment and it prevented those who voted to succeed from returning to Congress.

First and foremost, I would think he needs to be convicted of a crime covered by this. To date, he hasn't been.

Do I think he's guilty, yup. Sure do. But that's not enough.

I think what Woofer was trying to say is that if this is pushed, there will be a suit brought, or really a bunch of suits brought and we'll just have to see how it's interpreted by SCOTUS.

I don't trust this SCOTUS.. A few of them flat out lied to get on it. (JMO) But that aside, The best way to make sure that Trump is never president again is to NOT ELECT HIM..

While I understand the article covers it I think there's something that needs to be considered here. The only states I believe that could ever happen in would need a Democratic governor and a super majority in the legislature in order to ever pass. That would mean they would be heavily democratic states that trump had no chance to win anyway. Therfore I think it would make zero difference in the outcome of the election. Then there's that pesky detail that nobody involved in the Jan. 6th attack on the capital was ever convicted of insurrection.
