The indictment against the president's son comes after a plea agreement on tax and gun charges fell apart in July and amid a probe of his finances by House Republicans.
Federal prosecutors have indicted Hunter Biden, son of President Joe Biden, on gun charges, court documents show.
Biden was indicted in Delaware federal court on three counts tied to the possession of a gun while using narcotics.
Two counts are tied to Biden allegedly filing a form claiming that he was not using illegal drugs at the time he purchased a Colt Cobra revolver in October 2018. The third count alleges that he possessed a firearm while using a narcotic.
The historic indictment against the son of a sitting president comes after a plea deal that might have ended a years-long probe into Hunter Biden fell apart and just as House Republicans have launched an impeachment inquiry in an effort to seek bank records and other documents from the president and his son.
The case is being overseen by special counsel David Weiss, who also headed the investigation. Weiss is a Trump appointee who was kept on as U.S. attorney for Delaware because of the sensitive and unique nature of the investigation into a president's son by the Justice Department, a part of the executive branch headed by the president. U.S. Attorney General Merrick Garland named Weiss special counsel in August, as negotiations over the tax and gun charges collapsed.
Weiss’s investigation was opened in 2018, the year before Joe Biden announced his candidacy for president, according to a source familiar with the inquiry, and focused on the younger Biden’s finances.
The two sides reached a plea agreement in July which called for Hunter Biden to plead guilty in Delaware federal court to two misdemeanor counts of failing to pay his taxes in return for prosecutors recommending a sentence of probation. A separate felony gun charge for illegally owning a Colt Cobra .38 Special handgun would have been dropped in two years if Biden honored the terms of what’s known as a diversion agreement.
The agreement started to fall apart at the court appearance where it was expected to be finalized after the judge presiding over the case raised questions about some details. “The agreements are not straightforward and they contain some atypical provisions,” U.S. District Judge Maryellen Noreika noted, including one that could theoretically protect Biden from other tax-related crimes in the same time period.
Prosecutors said the provision in the diversion agreement would not protect him from different charges, while attorneys for Hunter Biden said it would. Noreika, a Trump-appointed judge, asked both sides for more information, and the agreement — which Republicans were already blasting as a “sweetheart deal” — subsequently fell apart.
In subsequent court filings, Weiss’s office noted that without the plea agreement in place, there were venue issues and the case would most likely have to go to trial in California or Washington, D.C. Prosecutors also suggested that they might bring different charges in the new case.
Hunter Biden attorney Abbe Lowell, meanwhile, argued the diversion agreement is still in effect because it had already been signed by his client and prosecutors and said it “prevents any additional charges from being filed against Mr. Biden.”
“We expect a fair resolution of the sprawling, 5-year investigation into Mr. Biden that was based on the evidence and the law, not outside political pressure, and we’ll do what is necessary on behalf of Mr. Biden to achieve that,” he said last week.
Prosecutors dispute that the agreement is in effect, arguing it lacks a necessary signature from the probation department.
Attachments to the plea agreement and the diversion agreement that were filed in court blamed Biden’s conduct in the tax and gun cases on his drug and alcohol addiction. The documents say that he got sober in May of 2019, and with the help of a third-party paid off about $2 million in back taxes and penalties by October of 2021.
The White House has been largely silent on the investigation, but the president defended his son in an interview with MSNBC’s Stephanie Ruhle on May 5.
“First of all, my son has done nothing wrong,” the president said. “I trust him. I have faith in him.”
Asked by Ruhle how charges against his son would impact his presidency, Biden said, “It impacts my presidency by making me feel proud of him.”
Hunter Biden told CBS News in a 2021 interview that he was “cooperating completely” with the federal probe. “And I’m absolutely certain, 100 percent certain,” he said, “that at the end of the investigation, I will be cleared of any wrongdoing.”

In a PR stunt gone terribly wrong, former President Donald Trump went gun shopping on Monday with Congresswoman Marjorie Taylor Greene and asked to buy a Glock pistol on camera—which would have brazenly violated the very same law that recently landed Hunter Biden criminal charges.
Federal law prohibits anyone under indictment from attempting to buy a firearm. Trump has been criminally indicted four times in as many jurisdictions—Atlanta, Miami, New York, and Washington—facing dozens of felony charges that could land him in prison for decades.
“I wanna buy one,” Trump said while taking a tour of Palmetto State Armory, a federally licensed gun dealer in South Carolina that's widely revered by firearm enthusiasts.
“Sir, if you want one, this one’s yours,” a person on the tour said, seeming to divert the president away from making an actual purchase.
“No, I wanna buy one,” Trump insisted.
It only added to the fiasco when those present pulled South Carolina Attorney General Alan Wilson into the photo op—as well as his brother, Julian Wilson, an executive at the private equity company that owns the gun dealer. They are both Republican Congressman Joe Wilson’s sons.
The disaster started when Trump's campaign spokesperson, Steven Cheung, tweeted that his boss actually went through with the sale.
"President Trump purchases a @GLOCKInc in South Carolina!" he posted Monday afternoon.
But the campaign went into damage control mode as soon as firearms journalist Stephen Gutowski and others pointed out that the entire transaction would be blatantly illegal.
“Did he actually go through with the purchase?” Gutowski asked openly in tweet.
Cheung later claimed to CNN that Trump never actually went through with the purchase—and deleted his original statement. The Daily Beast could not immediately independently confirm whether Trump finalized the deal.
The irony is that the federal law Trump appeared to almost violate is the very same one that the feds used to indict President Joe Biden’s son, Hunter.
The federal law that restricts how someone may buy or sell firearms is 18 U.S. Code § 922, the go-to statute for prosecutors seeking to imprison felons who manage to acquire guns after serving time in prison, straw purchasers who buy a gun with the specific intent to sell it to another person, and other people who aren’t allowed to acquire them. That law is why anyone buying a gun from a licensed dealer must fill out what's called an ATF Form 4473, which asks: “Are you under indictment or information in any court for a felony, or any other crime for which the judge could imprison you for more than one year, or are you a current member of the military who has been charged with violation(s) of the Uniform Code of Military?”
Answer “yes,” and no gun shop can legally sell you a gun. Trump, who is facing criminal charges across the eastern seaboard, would have to answer in the affirmative.
Republicans—and Trump in particular—have been calling on the Department of Justice to hold Hunter Biden accountable for violating the same statute, in his case, for lying about drug use on that form.

House GOP denies Hunter Biden demand on impeachment inquiry testimony
The Oversight Committee has subpoenaed the president's son to appear for a private deposition on Dec. 13.
Hunter Biden’s legal team demanded that he be allowed to testify publicly in response to a House GOP subpoena. James Comer quickly shot it down.
A Biden lawyer sent a letter to the House Oversight Chair Tuesday morning, saying the president’s son would appear publicly before the committee on Dec. 13. That ran counter to a stipulation of the subpoena, which called for a private deposition with lawmakers and aides.
“A public proceeding would prevent selective leaks, manipulated transcripts, doctored exhibits, or one-sided press statements,” Abbe Lowell, Hunter Biden’s attorney, wrote in the letter. He added that they were also amenable to any other date next month the two sides could agree on.
Comer denied the request in a statement Tuesday, saying it “won’t stand with House Republicans.”
“Our lawfully issued subpoena to Hunter Biden requires him to appear for a deposition on December 13,” Comer continued. “We expect full cooperation with our subpoena for a deposition but also agree that Hunter Biden should have the opportunity to testify in a public setting at a future date.”
Typically, House panels insist on a private deposition before allowing a public appearance. The Jan. 6 select committee denied several requests to testify publicly, including one from Rudy Giuliani.
The demand from Biden’s lawyers to testify publicly marks the latest salvo in an increasingly public back-and-forth between the president’s son and House Republicans, who view him as their top witness in a sprawling impeachment investigation focused on President Joe Biden. It has primarily focused on the business deals of Hunter Biden and other family members.
Lowell had initially indicated, in the immediate wake of Comer’s subpoena last month, that Hunter Biden was willing to speak with the committee “in a public forum and at the right time.”
The president’s son is just one of several targets of House GOP impeachment inquiry subpoenas or interview requests made in the last month. Comer also subpoenaed James Biden, Joe Biden’s brother, to appear for a deposition next month and Rob Walker, a Hunter Biden business associate, to appear for a deposition on Wednesday. Several other Biden family members received requests to voluntarily appear before the panel for questioning.
House Republicans are months deep into their multi-pronged investigation, with Republicans looking to make a decision early next year on whether or not to pursue impeachment articles against Joe Biden.
And while Republicans have found examples of Hunter Biden involving his father to try to boost his own profile and poked holes in some of Joe Biden’s and the White House’s previous statements, they’ve struggled to find a direct link that shows Joe Biden took official actions as president or vice president to benefit his family’s business deals.
At the same time, impeachment advocates are still facing skepticism from a coalition of centrists and old-school conservatives who support the investigations but don’t believe they’ve met the bar for impeachment, at least not yet. Given that no House Democrats are likely to back impeaching Biden, Republicans will need almost near unity in their conference.
In addition to Biden family business deals, Republicans are probing other avenues, including the years-long federal investigation into Hunter Biden and Joe Biden’s handling of classified documents, which is also the subject of a special counsel investigation.

I'm not sure how familiar you are with Comer, but I have really followed him a lot since the Transdigm hearings in 2021. If you watch those - which you probably won't - he was among - no, not among - THE absolute worst when it came to obfuscation of the facts, gaslighting, deflection, etc. It was truly a remarkable standout for something that should have absolutely been a bipartisan, apolitical problem. He has not deviated from that style in any setting in which I have seen him speak since. Gerry Connolly was by far the most pragmatic in that hearing and some on the right were fine, as well, but he embodied the mockery of what a stereotypical politician is, and continued to do so.
His conduct at that hearing - and since - has almost made people like Jim Jordan and Virginia Foxx look like moderates. Even those two, in the 2019 Transdigm hearings (yes, there were two because the company is THAT corrupt), spoke with some (read minimal) level of decorum.
Comer is horrendous. He is the Republican Tlaib.

James Comer Seems to Forget He Said Hunter Biden Could ‘Choose’ Public Hearing
While Comer rejected Hunter Biden’s offer to publicly testify, last month he declared it Biden’s choice to testify in public or private.
House Oversight Committee Chairman James Comer (R-KY) flat-out rejected Hunter Biden’s offer on Tuesday to testify in a public hearing, claiming the president’s son “is trying to play by his own rules instead of following the rules required of everyone else.”
However, just a few weeks ago Comer insisted that those subpoenaed in the Biden impeachment inquiry could “choose” between appearing for a deposition or a committee hearing.
Responding to House Republicans’ recent subpoena of Hunter Biden, the first son’s lawyer Abbe Lowell countered Comer’s offer to meet behind closed doors. In a three-page letter, Lowell flagged several instances in which the chairman had basically dared the presidential scion to testify before Congress.
“Mr. Chairman, we take you up on your offer,” Lowell wrote in the letter. “Accordingly, our client will get right to it by agreeing to answer any pertinent and relevant question you or your colleagues might have, but — rather than subscribing to your cloaked, one-sided process — he will appear at a public Oversight and Accountability Committee hearing.”
He added: “A public proceeding would prevent selective leaks, manipulated transcripts, doctored exhibits, or one-sided press statements.”
Comer, meanwhile, declined the request on the grounds that the hearing would be “chaotic” due to Democrats’ behavior, notably taking issue with “little” Rep. Jared Moskowitz (D-FL). Earlier this month, Comer blew up at Moskowitz during a committee hearing, shouting profanities and calling the Florida congressman a “smurf” after the Democrat mentioned a Daily Beast report contrasting Comer’s payments to his brother with that of the Biden family’s loan repayments.
During an interview with serial plagiarist Benny Johnson last month, though, Comer indicated that the impeachment probe was in its “downhill phase” and that he was looking to “wrap it up as soon as possible.” Additionally, he stated that anyone who was subpoenaed in the inquiry could be deposed or appear publicly.
“We know not only there were crimes, we know there are cover-ups,” he declared. “We have mountains of evidence and now we’re ready to bring ‘em in. We’re in the downhill phase of this investigation now because we have so many documents and we can bring these people in for depositions or committee hearings, whichever they choose, and we can ask these questions with evidence.”
Asked how the congressman could square his previous stance with his rejection of Hunter Biden’s offer to appear in a public hearing, an Oversight Committee spokesman told The Daily Beast that Comer’s subpoena was strictly for a behind-the-scenes deposition.
“The subpoena served to Hunter Biden specifically directed the President’s son to appear for a deposition on December 13,” the spokesman said. “Hunter Biden does not have the luxury to now dictate the terms of a lawful subpoena. Chairman Comer expects Hunter Biden to comply and is open to holding a hearing at a future date.”
Meanwhile, House Oversight Committee Ranking Member Jamie Raskin (D-MD) blasted Comer’s refusal to take up the president’s son on his offer, claiming it shows Republicans have no confidence in their own investigation.
“Let me get this straight,” the Democrat said in a statement. “After wailing and moaning for ten months about Hunter Biden and alluding to some vast unproven family conspiracy, after sending Hunter Biden a subpoena to appear and testify, Chairman Comer and the Oversight Republicans now reject his offer to appear before the full Committee and the eyes of the world and to answer any questions that they pose?”
Elsewhere in Lowell’s letter, the attorney accused Comer of using “closed-door sessions to manipulate, even distort the facts and misinform the public,” adding that the “empty investigation has gone on too long wasting too many better-used resources” and “should come to an end.”
While the House probe into the Biden family’s business dealings has been going on for months and investigators have obtained thousands of pages of financial records, the committee still has not found evidence that the president benefited from his son’s deals or was involved in a foreign influence peddling scheme. Additionally, Comer hasn’t been able to provide any proof of wrongdoing on the president’s part in the criminal probes of Hunter Biden.

Do they think him ending up in an orange jumpsuit somehow would convince me to wish I would have voted for donny? I’d currently vote for the orange jumpsuit itself before voting for donny. Biden’s Bookkeeper Is Latest GOP Witness to Blow Up Impeachment Claims
Eric Schwerin, who was also a longtime business partner to Hunter Biden, told a House committee he never saw the president benefit from his son’s business deals.
A former bookkeeper for the Biden family touted by Republicans as a whistleblower failed to blow the lid off the GOP-led impeachment inquiry on Tuesday, telling members of the House Oversight Committee a closed-door hearing that he’d never seen any evidence that the president had enriched himself through his son’s international business deals.
The witness, Eric Schwerin, also a longtime business partner to Hunter Biden, acted as a financial adviser to Joe Biden from 2009 to 2017, performing various administrative and bookkeeping tasks for the then-vice president. Schwerin also helped Biden prepare his taxes and annual financial disclosure statements, and had access to his bank records.
“Based on that insight,” Schwerin said in his opening statement to the committee, “I am not aware of any financial transactions or compensation that Vice President Biden received related to business conducted by any of his family members or their associates nor any involvement by him in their businesses.”
“In fact,” he added shortly after, “I am not aware of any role that Vice President Biden, as a public official or a private citizen, had in any of Hunter’s business activities. None.”
Schwerin called Republican claims of Biden’s corruption “preposterous,” saying that Biden had “always” been “crystal clear” in private discussions that he wanted to take the most transparent, ethical approach to his personal finances.
Schwerin was previously interviewed by Oversight Committee staff last March, when he told them much the same, according to Rep. Jamie Raskin (D-MD), the ranking member of the committee.
“House Republicans are about to begin the 14th month of this Trump-demanded fishing expedition,” Raskin added in a statement. “They have uncovered a mountain of evidence discrediting their own allegations, and they have failed to uncover any evidence of wrongdoing by President Biden whatsoever, much less an impeachable offense. Republicans have repeatedly accused President Biden of wielding political power to help his son in his dealings overseas, including in Ukraine, where—as the debunked conspiracy theory goes—he allegedly leaned on the government to prevent a corruption investigation into the Burisma gas company and protect Hunter, who sat on its board.
In speaking with the committee on Tuesday, Schwerin specified that Biden never took any action related to Ukraine to help Hunter’s work. Still, House Republicans spent hours questioning him about Burisma, according to a congressional source with direct knowledge of the interview.
Biden has repeatedly denied any wrongdoing in the matter.
Despite having interviewed Biden’s former executive assistant and at least two other associates of Hunter’s, Republican lawmakers have yet to produce any evidence of his supposed corruption and influence peddling.
Hunter himself is scheduled to answer questions in an Oversight hearing in late February, an interview he agreed to after resisting an initial subpoena and being threatened with a contempt vote.

Special counsel charges FBI informant with lying to the bureau about Hunter and Joe Biden Alexander Smirnov, 43, disliked President Joe Biden, according to the Justice Department. He was arrested in Las Vegas after returning from a trip overseas.

Comer takes aim at FBI after informant’s arrest: ‘Very suspicious’
House Oversight and Accountability Chair James Comer (R-Ky.) went after the FBI on Tuesday, in the wake of the arrest and charging of an informant central to the GOP’s allegations against the president.
Comer said that everything that he’s had “to do with the FBI has been very suspicious” throughout House Republicans’ probe into President Biden.
“The trust level that I have with the FBI is zero, Maria,” Comer said in an interview on “Mornings with Maria” on Fox Business with anchor Maria Bartiromo.
Comer also said all he and House Judiciary Committee Chair Jim Jordan (R-Ohio) knew about the informant was that FBI Director Christopher Wray had said the informant “was one of their most trusted, highest paid, in the bureau.“
“They had successfully used this informant to prosecute criminals in the past, and that he had been with the bureau over a decade,” Comer continued.
The informant, Alexander Smirnov, has been important in House Republicans’ allegations that Biden accepted a bribe. Republican lawmakers have often noted conversations that Smirnov had with the FBI about the head of the Ukrainian energy company Burisma telling him that he paid both Biden and his son, Hunter Biden, $5 million.
“As alleged in the indictment, the events that Smirnov first reported to the FBI Agent in June 2020 were fabrications,” the Justice Department said in a press release on the grand jury indictment.
“The indictment alleges that the defendant transformed his routine and unextraordinary business contacts with Burisma in 2017 and later into bribery allegations against Public Official 1 after expressing bias against Public Official 1 and his presidential candidacy,” it added, referring to President Biden.
Smirnov was arrested a little under two weeks ago at the Las Vegas airport. He faces up to 25 years in prison if convicted.

Jim Jordan defends Kushner after Hunter Biden raises Saudi deals
House Judiciary Committee Chair Jim Jordan (R-Ohio) defended former President Trump’s son-in-law Jared Kushner on Thursday after Hunter Biden, during testimony with House lawmakers, raised questions about his foreign dealings.
Jordan said the scrutiny of Kushner, who was also an adviser to Trump, was “ridiculous.”
“The idea that Jared Kushner did something wrong is ridiculous,” Jordan told Newsmax’s Eric Bolling during a Wednesday night appearance on “The Balance.”
“I mean, the Trump family has been investigated more than any family on the planet, and what they’ve attempted to do to President Trump and been doing to President Trump over the last seven years is unbelievable,” Jordan said.
Hunter Biden appeared for a closed-door deposition Wednesday, where he was grilled by Republicans about his foreign business deals. During the process, the president’s son flipped the question back on the GOP interrogators.
“He drew the distinction between what he has done in a business world with independent businessmen, versus foreign governments, which he did not do any business with — unlike Jared Kushner,” Rep. Dan Goldman (D-N.Y.) said Wednesday during a break in the testimony.
During his time in the Trump White House, Kushner oversaw Middle East policy. He secured a $2 billion investment from Saudi Arabia six months after leaving his Oval Office post, a deal that raised questions.
The scrutiny intensified after a 2022 New York Times report detailed how the Saudi sovereign’s advisory panel was not supportive of investing in Kushner’s private equity firm, pointing to “the inexperience of the … management.” The doubts were quashed by a bigger advisory board led by Saudi Crown Prince Mohammed bin Salman, an ally of the Trump administration.
House Oversight Committee Chair James Comer (R-Ky.), the other House Republican spearheading the probe into Hunter Biden, said in August that Kushner “crossed the line of ethics” by accepting a $2 billion investment.
However, Comer drew a distinction at the time between the two cases, saying Kushner secured the funds after leaving office, while Hunter Biden’s deals came through while his father was the vice president.
Democrats opened a probe into Kushner when they held the majority in the lower chamber. The investigation was dropped when the GOP took back the majority.
