US deports hundreds of Venezuelans despite court order

Actually you make an interesting point. It was in international airspace over international waters when the order was given. And no U.S official has any jurisdiction over international waters. He certainly did break the order but whether a judge has the authority to rule over anything in international waters is a valid point.

According to a Reuters timeline, Boasberg's oral ruling that "any plane containing these folks ... needs to be returned to the United States" was issued between 6:45 p.m. and 6:48 p.m Eastern Time. At that hour, two flights were in the air.

A third flight took off at 7:37 p.m., or 12 minutes after the judge's written order was published. The Trump team has said the third flight carried deportees processed under other immigration authorities and not the Alien Enemies Act and therefore was not subject to the order.

In any event, all three flights, which each made a preliminary stop in Honduras, landed in El Salvador late Saturday night or Sunday morning Eastern Time, hours after the judge's oral and written rulings.

The Judge asked the govt for some information by noon today as he is reviewing a contempt order.

Chief Justice Roberts Publicly Rebukes Trump’s Call to Impeach Federal Judge

Chief Justice John G. Roberts Jr. has publicly rebuked President Donald Trump’s calls for the impeachment of a federal judge who tried to block the administration’s deportation flights.

Trump made the demand in a social media post on Tuesday morning, hours before the Justice Department was supposed to respond to Chief Judge James Boasberg of the U.S. District Court for the District of Columbia, who had asked for more information about the administration’s harried deportations of about 250 people to El Salvador last weekend.

Without naming him, Trump called the judge a “Radical Left Lunatic,” and a “troublemaker and agitator,” and saying he “should be IMPEACHED!!!”

In a statement Tuesday, Roberts said that was not an appropriate response. “For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision,” he said. “The normal appellate review process exists for that purpose.”

Boasberg had ordered the Trump administration to provide more information about the flights by noon Tuesday. In a filing, the Justice Department said there was no justification for providing more information, but that if required to do so, they would do it in private.

The escalating drama, pitting the Trump administration against the federal court system, began Friday with a Trump executive order invoking the 18th century Alien Enemies Act as justification to deport alleged members of a Venezuelan street gang called Tren de Aragua.

The American Civil Liberties Union and Democracy Forward filed a lawsuit on behalf of five Venezuelans being held by immigration officials on Saturday.

Boasberg later that day ordered a halt to two deportation flights of other people covered under Trump’s order, saying that “This is something that you need to make sure is complied with immediately,” the Washington Post reported. But instead of complying with the judge’s order that the planes turn around, they landed in El Salvador.

The Alien Enemies Act of 1798 allows the president to apprehend, restrain, and remove citizens of a foreign country that is at war with or engaged in an “invasion or predatory incursion” against the U.S.

Lee Gelernt, deputy director of the ACLU’s Immigrants’ Rights Project and lead counsel, called the Trump administration’s use of a wartime authority for immigration enforcement “as unprecedented as it is lawless.”

Skye Perryman, president and CEO of Democracy Forward, said that the U.S. “is not at war, nor has it been invaded,” calling the invocation of wartime authority “the latest step in an accelerating authoritarian playbook,” and unnecessary for lawful immigration enforcement operations.

Trump’s Justice Department tried on Monday to have Boasberg removed from the case, accusing him of “judicial micromanagement” and asking the U.S. Court of Appeals for the District of Columbia to freeze the case before they had to divulge national security information.

Boasberg had a hearing late Monday to examine whether the administration violated his order about the flights, but lawyers for the government wouldn’t answer his questions except to say the government didn’t violate the order.

The administration has said that because the flights were over international waters, they were outside the court’s jurisdiction. White House press secretary Karoline Leavitt said on Monday that all the flights that were subject to the judge’s written order “departed before the written order.”

Trump’s border czar Tom Homan told Fox News on Monday that because the two flights were above international waters, they did not need to turn around.

The Alien Enemies Act was last used during World War II to help justify the rounding up and incarceration of more than 120,000 Americans of Japanese descent, for which President Ronald Reagan formally apologized in 1988.
