Ok guys, I have a problem here and I wanted to see if anyone here could shed some light on the situation..
My friend (who is American) has been stuck in Canada for 3 months now without a birth certificate or a passport. Due to keeping this post short, he has been unsucsessful 3 seperate times to get his certificate from the state, in turn not allowing him to apply for his passport.
The US Embassy tells him that he can try crossing on land but its to the border patrols disgression whether or not they let him in, and they recommend having your passport.
So my question is, if he goes to the border.. do they have judges there to decide if American citizens get accross? At the end of the day, he is American and is in Canada illegally so Canada shouldn't want him. How can he get himself deported?
It's a horrible situation and im looking for ideas. Thanks guys.

I don't know how it works from the other side, but if he were in the USA and wanted to get deported...the easiest way would be to get a job and report himself to INS.

Maybe I'm missing something here, something dosent seem right, If he's an American than they should let him back in, one dosent need a passport or birth certificate to croos the border just yet into Canada, just a drivers pictured licences, right. So there must be more to the story, if Canada goverment is holding him just due to not having a pass port or birth certificate than something wrong, also if he is being held just becuase he left them in the US, why hasent somebody gotten them and taken them to him in Canada to prove to the goverment he's a US citicen.
sorry but to me something is fishy here, did he do something illegal in Canada and is being held until trial or something and your trying to get him out beofre he can be put away in Canada for jail time, not pointing fingers just asking
something dosent add up in this story....

Not to pick apart your post, just to answer your questions and make it more clear. Nothing is fishy other then they way I explained it in short.. Quote:

He tried flying back originally, but they said the only way to cross without a passport is by land. They don't care if you are American or not. They said he could try by land but "good luck without a passport"
So the next day he tried going by bus, but they wouldnt even let him on without a passport, saying it was their company policy. That's the problem, every seperate place has their own policy, there isn't a clear cut rule.
So he has yet to get to the border, thats why I'd like to know how they treat you there if you are a US citizen. He has no car there (he flew) and knows nobody in Canada to take him to the border.
And just a quick FYI... an American drivers license isn't proof of American citizenship

He's not being "held." He flew there on business and is in a hotel which luckaly the company is paying for. He is just trying repeatedly to get back to the US. Also, nobody has brought the birth certificate to him because it is lost. He has tried 3 seperate times unsucsessfully to get a new one from the state.... if anything that's where the fishy thing is going on.....

nothing fishy here, just trying to get an American back home without a passport or birth certificate

The rules are different now.. much tighter. In the past whenever I've gone, all they did at International Falls was ask me what I was doing and for how long..
Fishing.. 9 days.. Ok, go right ahead. Passports needed now.. Drivers license doesn't mean diddly.

He flew before October 1st, before all the laws changed.

Ok thanks, I wasnt trying to be nasty i think you knew that, I guess i didnt realize the laws have changed that much over the last few years, but i guess they have, I guess i better get caught up on the new laws...LOL...We normally go into canada fishing and havent had any problems,

Tell him to take a cab to the border... cross it on foot and show his Driver's License as proof of citenship... take another cab from the U.S. side to a bus station.
.... or tell him to stay there and enjoy the free medical at the expense of their taxpayers, maybe get a job working under the table.

Sounds like someone is dropping the ball. This is also a good time to remind people to keep a birth certificate in a lockbox. You never know when you may need one.

Out of curiosity, what state was he born in?
My dad recently had to get his birth certificate (or is trying to), but he was born in the City of New York and they are such a pain in the ass. They want him to provide his driver's license as a photo ID, but that's why he's getting the Birth Cert. So he can get the DL. So he gave a copy of his military ID and SS card and they still rejected it. The process is extremely screwed up and it's taken over a month now just to try and we still haven't gotten it. So depending on the state, it may be easier or harder to get a replacement BC.

It's New York State... I believe they seperate from the city, correct?

In Ohio, you have to get a copy (in person) from the County Registrar...it has nothing to do with the state.

Michelle, it has everything to do with the state. In New York, you can order it online, by phone, by mail or in person. In New Mexico (where I was born) all I needed to do was provide a copy of my DL (or military ID) and SS card and pay the $10.

New York state is separate from the cities 5 boroughs. If he was born in any of the 5 boroughs, he needs to go to NYC Department of Health & Mental Hygiene-Office of Vital Records. If he was born in New York State, but not in one of the five boroughs of New York City, he can get a copy of his birth certificate from the New York State Department of Health. New York State route 5 boroughs route

Reminds me of the story of a couple going to Canada and the border agent asked them what they were going to do. They told him they were going to a wedding and would stay the weekend. The agent asked if they had any weapons and they told him "No, It's not that kind of wedding"

So, he's been trying to get home for 3 months but can't. And, as you stated, his company is paying the hotel bill.
Seems to me, if the embassy can't do anything about it, (which I doubt), I'd make a phone call to my state representative. Tell him to do that - be it the senator or the rep - they have ways of making things happen. I can't hardly believe an American is stuck in canada and can't get out - not for 3 months anyway.
Seriously, a call to his state senator or rep. will work wonders. (I can't hardly believe the business is putting up with this for this long - if he's been trying to get home for 3 months)
