STILL hasn't paid his bills even after me demanding he do so. But either way it's coming out of his security deposit, despite him saying we're not allowed to (that's a lie, he didn't read over the lease correctly).
But, I'm afraid of him trashing the place, or making a copy of his key then coming back over summer to trash the place. We're planning on having the locks changed as soon as he's gone.
Still, I'm worried about him doing something drastic. We had a heated argument Thursday night/Friday morning (after bars) where he told me he can file all sorts of lawsuits against us (after looking into it, we're convinced he's full of hot air because the lease has us well protected).
It's taken everything in me not to throw a punch at him, which I'm convinced is what he wants me to do with the way he's agged me on and has refused to pay his bills. "I don't feel that I have to because you guys screwed me." (only way we screwed him was because he was late on his payment and we gave him the latest final date to get it in before the apartment managing company would take us all to court, we never charged him the late fee even though we have every right to, but he blames us for his inability to schedule classes on time because he couldn't pay tuition).
This doesn't even get into the unbelievably offensive, deplorable stuff he has done in front of me and the other roommates and their friends, and why we never have people over here, because of him.
Anyway, any advice on helping me rid myself of this lowlife for good?

A guy like that, let him leave, and then just leave him alone. He may rattle a cage or two from time to time, but just ignore him if you can. Hopefully, he'll just go away. If you keep bringing him back into your life, he'll just keep driving you crazy.
JMHO. Good luck.

Stay strong, don't take any crap and tell him to go away. However, find a balance to let him leave without feeling the need to get back at you. No reason to make it more uncomfortable than it has to be. If it's a few dollars here and there, fine...just get out of your life. If it's hundreds or thousands, get the money at all costs. Try to be as nice as possible (notice I didn't say be nice....be as nice as possible). Stuff like this blows over quickly. Roommates are a drag.

It's hundreds of dollars worth, almost the entire $300 security deposit.
He hasn't paid cable since March and electric since February.
It's not like I'm an angry bill collector either, one of my other roommates is late but I understand, and I trust that he won't screw me over because I've known him for years.
This other guy? Tries to screw over everyone he can.

Just say good bye with a smile on your face. I know what it is like to have someone try and provoke you into a fight. You will lose. You might get short term satisfaction by punching him in the mouth, but the assult charge is forever.

1. If you don't change the locks, you need to get your head checked.
2. You're talking about how you had a discussion after the bars.... get your damn head checked.
Advice? Man up and stop whining about something you should have already dealt with by now. The solution to your problem is NOT here on a message board or anywhere else on the internet, it is in dealing with the problem instead of complaining about it. Stop being a drama queen and deal with it.

No...I could handle him quite easily actually.
it's more about the fact that I don't want him filing a lawsuit, I swear he's looking for any reason to file one.
PPE...trust me on this...there's no other way to deal with it than how we're dealing with it now. The locks will certainly be changed tomorrow.

What the hell is your problem Ammo? Your posting your issues on this message board? WHO DOES SOMETHING LIKE THAT? You're the only one here who wastes there whole day COMPLAINING. You're one of a kind kid, you need to get a grip and take some tips from fellow posters and just stop complaining all the time.

So let me get this straight...
I come here asking for advice...the advice I get is "deal with it."
How does one go about dealing with it? I swear I've tried everything except writing a note in blood and posting it on his door.
We couldn't just throw him out because all our names were tied to one lease, we already established this.
But I want my money back, and I'm pretty sure I'll get it from his deposit...it's just frustrating that he won't be an honorable man and pay me.

The security depost check, who will it be made out to? How can you make sure it doesn't go directly to him?
Are you cancelling your old lease and starting a new lease without his name on it?
Change the lock, if the complex won't do it for you, then you might have to pay to have it done.. this one is a no-brainer.
You may end up in small claims court trying to get your money back so I hope you have all of the bills, cancelled checks, etc... and I hope you didn't have any side deals like, "Well you pay this and I'll pay that and we'll call it even." That's going to be hard to prove...
In short, you have 2 options, 1 is to beat it out of him but like you said, you could find yourself in jail if you did that... and 2 is you can be prepared to sue him for it....

Well just deal with having to deal with it. There some crabby people today I guess.
I think your best bet is to just write it off as a loss and be happy you are done with the guy.

The deposit check is made out to my parents, since they own the unit.
It says in the lease that tenants are responsible for utilities...
"Landlord shall provide water, sewer and garbage removal for the leased unit. Tenant shall pay for electricity during the Lease term for the leased unit. Tenant shall also be responsible for telephone service hookup and costs and cable television service hookup and costs should Tenant desire those services.
..Tenant further agrees that Landlord has made no promises with respect to the condition of the leased premises other than those in this Lease. If Tenant fails to complete the check-in sheet (he never did a check-in sheet with front desk) Tenant agrees that the unit is in good and acceptable repair. Tenant shall be liable for the condition of the premises upon vacating the leased premises….
…Tenant agrees to the following minimum chares for such damages --- $20.00 for each key not returned to the Landlord….Tenant will PERSONALLY notify Landlord of the date Tenant vacates the leased premises and will provide Landlord with a forwarding address and telephone number….Tenant shall forfeit any amount of the security deposit that Landlord is otherwise obligated to refund if Tenant fails to provide a correct forwarding address."
So, since he failed to do his duties as a tenant to pay electricity and cable, he should forfeit his deposit, right?

No. The security deposit has nothing to do with Electricity and cable. That was an agreement made amongst the tenants on how you were going to pay for the utilities. How do you not know this and rent?

Ok but that is a agreement that you have no proof of. Some states will recognize a verbal agreement as legally binding but they are tough to prove. Do you really think $300 is worth all the hassle? You also should realize that if you do not give him his security back within 30 days without legal proof to show why you have not give it back to him you can be required to pay double the security deposit?

We checked with student legal services and the apartment managers and said we absolutely can hold his deposit and that no lawyer would ever represent him in court over this matter.

Well yeah, because it's $300 bucks. Anything under $1000 usually goes to small claims court ... so if you think you can hold up under the pressure of Judge Judy, you'll be fine.
My wife had a similar situation but over a lot more money. She just ate the cash loss and called it good because getting her satan-like roomate out of her hair was worth it.

I'll bet there are very few people on this board who haven't been stiffed by a roommate. And they didn't take the person to court over a few hundred bucks. Go get a part-time job for a month or so and make up the difference. Learn a lesson and move on.

As Fletch pointed out, neither the lessee nor the utility company has any stake in HOW your utility bills get divided up and the security deposit probably cannot be held to cover portions of utility bills. If you have a signed deal with your roommates, then tell us what it says... otherwise as I stated before, if you want your money, you are likely going to have to sue him for it..
And we agreed to split it 4 ways.
