Teen Charged With Sending Nude Pics of Herself Girl Faces Felony Charges After Allegedly Sending Photos of Herself to Classmantes By SCOTT MICHELS Oct. 10, 2008 A 15-year-old Ohio girl faces felony charges and may have to register as a sex offender for allegedly taking nude photos of herself and sending them to her high school classmates. Teen is now under house arrest and her cellular phone has been confiscated.The girl, whose name has not been released, was arrested last week and charged in juvenile court with possessing criminal tools and the illegal use of a minor in nudity-oriented material, said Licking County, Ohio, prosecutor Ken Oswalt. Her alleged actions are part of what some in law enforcement say is a growing problem around the country. During a court appearance this week, the teen denied the charges, according to Oswalt. The girl attends Licking Valley High School in the town of Newark. Her lawyer declined to comment. "There's a totally false perception among juveniles that there is no risk to this," Oswalt told ABCNews.com. "That picture, once taken and sent, gives anyone who receives it the ability to do anything with it, forever. If a picture of you found its way onto the Internet, that's going to haunt you, potentially forever." If convicted, the girl could face a sentence of anywhere from probation to several years in a juvenile detention center. A judge also has the discretion to make the girl register as a sex offender under Ohio law. Oswalt said other teens who received the photographs, which are considered child pornography under state law, may also be charged. Law enforcement agencies and schools across the country say they are struggling to deal with a relatively new phenomenon -- teens who send nude photos to friends and classmates. A 17-year-old in Wisconsin was charged in May with child pornography for allegedly posting naked pictures of his ex-girlfriend on the Internet. The girl had sent him the pictures. He told the La Crosse County Sheriff's Department he was just "venting" after she broke up with him. Earlier this year, another teenager in Ohio reportedly made a sexual cell phone video of himself and sent it to female classmates. One of the girls forwarded the video to at least 30 other people. Similar incidents have been reported in Wyoming, New York and Pennsylvania. Oswalt said his office got several such cases a week earlier this year before he started giving presentations at high schools warning of the potential consequences of sending nude photos. One of those presentations, he said, was delivered at Licking Valley, the same high school attended by the 15-year-old. Oswalt said the girl had already been warned by school administrators about what he called "inappropriate cell phone behavior." In Pittsburgh, Pa., police Detective Mike Overholt told ABC News he encounters similar problems at least once a week. "It's ballooned here," he said. "My sense is they look at it as if there's nothing wrong with it," said Overholt. "It's being a star." But there can be serious consequences in many states that make child pornography illegal to send or possess. A teen field hockey player in upstate New York testified earlier this year that she took a photograph of herself in panties and bra and sent it to her coach at his request. "It made me feel special and important," she told a jury, according to Binghamton Press Sun Bulletin. "He would say I was beautiful, that I had a good body and was really athletic." The coach was convicted of child pornography and other charges. Candice Kelsey, author of "Generation MySpace: Helping Your Teen Survive Online Adolescence," said online culture encourages exhibitionism. "It's a means of getting attention, of becoming more popular," she said. I disagree, i think it is a legal issue. She sent these pics to her classmates, most likely without their knowledge, and by them having it on their computer or cell phone if found out they can be charged with child pornography.

I'm calling everyone that disagrees with the chief fan out right now. If you ever looked at porn before you were 18, then I would have to say no need in trying to act like you are morally awesome. The charges are way out of line as she sent them too friends. Especially you guys in here, don't act like when you were 15 you wouldnt accept a naked picture of a friend, and I know you didn't actually feel like you were comitting a crime.
Oh I can't wait to see how many Morally great people, excuse me I mean liars, say she comitted a crime. It may not have been right, but not a crime. Sorry for those that disagree on the surface. We all know inside that I'm right though.

You have to take into account intent and damages.
It isn't like she is some sicko distributing child porn to some pediphiles, it was a picture of herself to who she chose to send it to.

I agree with rkf.
I don't post much, but I do read a lot. There are many many people on here who seem to judge people on a regular basis as if they are better than the topic at hand. Than in the next thread they are admitting to crap they did 2, 3, and sometimes 15 years ago. Plenty of hyprocrits on here.

Morals have nothing to do with it. If she's found guilty, then the law says she committed a crime. Also, I'm pretty sure a lot of people have different opinions about right and wrong at 15 or 18 than they do when they get older - it's often called maturing.
Do I have a problem with what she did? No, but in my opinion she has no right to complain if those pictures of her end up on the internet. I have a problem charging those who received the pictures. I mean is it their fault if they open a photo and it's someone nude?
By the way, you could have waited for some responses before climbing up on your soap box.
There may be people who have more talent than you, but there's no excuse for anyone to work harder than you do.

Since you really seem concerned, I been reading the board since it was at the original Clevelandbrowns.com. And I followed it over here to its new site. So I guess you can say since the return. No sorry I can't prove it with some extravagant post count. I'm more of a reader than a poster. Thank god hu, cause I seem very good at getting peoples panties all bunched up.

I'm old enough. I also know that teenagers will be teenagers. They will live and make mistakes like us, yet all these "wise adults" want to crucify teenager as if we didnt do the same things. I'm not talking things like robbing or killing people, those people deserve no rights. But petty things like send a nudy to some friends, hey let them make mistakes. Stupid mistakes when I was a teenager are some of the funnest memories. You may think I'm not old enough, but I think it might be your to far removed from reality to remember what it was like being a teenager.

It is hypocritical when you judge others though for the same experience. Just because someone has matured and learned from their mistake don't give them the right to judge another for the same mistake.

I really think it depends on who she sent them to. If these are close friends or her boyfriend, and these people are trustworthy and cool with it, then really i dont see much of a problem with it. Its dumb, stupid and immature but then again so are most 15 tear old girls.
Now if she just sent them to a lot of classmates who wouldn't be cool with it or aren't familiar then your treading on dangerous ground. If someone gets sent an image like that, they could sned it to someone else, and so on and so on, until it reaches the internet and you've got thousands of men looking up child pornography and looking at this picture.
On a second note, when they say the people who recieved it will be charged, I'm the only ones that would be considered are those who resent the picture, saved it, or showed it off to a ton of people. I can't see how you could justify someone being sent the photo without knowing its content, and immediately deleting it.
The only reason people get lost in thought is because it's unfamiliar territory.
