I asked this question on here awhile ago, however i don't think I explained the situation thoroughly and people were confused with what I was saying, so hopefully this comes across a little more clear.
I don't know where to turn, and we are both begging anyone who has an idea for how to point us in the right direction to please help.
My girlfriend works as a Publicist in the music industry, her company is a well known, international company. She works in the domestic only department. November of last year, the international PR department had a mix-up and no one was able to attend an important function (press junkets) in Toronto that were taking place the next day, so they frantically tried to find someone in publicity to cover the function, which is when they called my girlfriend. Though she's not a part of their department, they are all the same company and all in publicity and she was their only option to cover the mix-up. After getting called she then quickly got on a plane to Toronto from New York to attend.
A week later when she was ready to return, they informed her that she needed a passport to get on a plane back to the USA, which she did not have. To an admitted fault of her own, she also never took her birth certificate with her, which of course you need your birth certificate to obtain a passport from the US Embassy in Canada. Though she grew up in Connecticut, she was born in New York state so she purchased her birth certificate online, however by law they will only mail it to your home address which is her parents house in East Haven, Connecticut.
This is where the story becomes a major problem because she and her parents have a strained relationship. They have not been on speaking terms since before she even left for Canada. As despicable as it is, her parents have not helped in any way by mailing the birth certificate to her in Canada, calls have gone unanswered for the past year.
Fortunately, her company has her in a 5-star hotel and she has a company card which she can use for food, so her living conditions as very good, but obviously she's still miserable and wants desperately to come home. She has spent Thanksgiving, Christmas, and her birthday alone the last year.
Her boss owns minority shares of a private plane and has slowly but steadily been trying to work on getting the plane to come to Canada to take her home. Through this process, he has requested her to go from Toronto to Montreal, then to Quebec City, then as of two months ago to Halifax. Still however, he has been unable to successfully get her and his private plan in the same location. This seems to be her only hope to get her home to the USA.
This is where we are at with this whole thing, and we don't know where to go from here. I'm not asking for any illegal advice, she is an American trying to come home. We want to get her home fast and legally. Who can we talk to or what can we do to end this nightmare?

I'd have her contact the Embassy again and have her explain about her birth certificate.

Can she not change her home address to yours and then have another birth certificate sent to your address?

I was able to get an Ohio birth certificate online and overnighted to Tuscaloosa back in February. She will need to know what hospital she was born in. It was a very easy process, though cost a bit more than usual.

oh and the border crossings from small town Maine to New Brunswick are very lax compared to most others. Ive crossed them before with a friend without a passport, he was a moron to have lost it but he jsut slept in the back of the jeep and we answered all the questions.

OK, Here is what you do. Find out what hospital she was born at and have her call the Health department for that county. If she explains the situation she should be able to have you pick up a copy of the birth certificate in person at the health board.
Then, you drive to Canada and hand her the copy of the birth certificate and that's should be about it. She can actually get back with out the passport if she has a US Driver's licence and a copy of her birth certificate, they will just make her go through "Extra" security. Which envolves a pat down and they rub some pads on your shoe's and other personal effects and test them in a machine for chemical traces.

BTW when you drive to Canada, make sure YOU have a passport.  Another thing you can try is your local new station. They may make it into a story and pay for and use their influence to get her home very quickly. A legaly born US citizen not being able to come home from Canada because they don't have a passport could be a fun little story on the news.

ok ,there a couple things that I think need to be cleared up, im not even sure myself but 1 You do NOT need a passport to go to and from canada, all you need is a photo ID and birth certificate? Is this true, im pretty sure it is. 2 Im pretty sure you cant even get into canada now if you have a DUI in the past 5 years or so, (dont believe me  ) 3 How did they let her into canada without the proper paperwork?

I think you need a Passport to leave the country since 2005. Mexico and Canada got an extention till January 1st 2007.
But, I'm pretty sure they won't let you leave with out a passport either, so I don't know how that was missed when she left. Of coarse, I'm speaking of other countries, I havn't been to Canada since 1998 so I'm not sure if they check when you leave for Canada.

That's not true. We took my son to a Tae Kwondo tournament in Toronto in March and didn't need a passport either way.

Dang man - she spent Thanksgiving up there, last year? We're talking almost a year. Staying at a 5 star hotel, WITH a company credit card?
Seems to me the company would be doing more to get her out of there.
Seems to me your state (well, her state) senator or rep would be able to pull some strings.
Have you gone to her parents and personally asked for the birth certificate? I cannot believe the relationship is that strained.
Heck, go get a certified copy for yourself. It's a public record. I'm sure you can do that.
Heck, call a U.S. embassy, explain what's up. If the story is accurate, it will be taken care of.
I am amazed that a legal u.s. citizen would be held captive in Canada, for nearly a year. With the company paying the bills no less.
How'd she get into Canada again?
Something is strange in this story.

Mail her some of her tax returns, then have her show up at the border with her Drivers License and tax forms.

The US Embassy tells him that he can try crossing on land but its to the border patrols disgression whether or not they let him in, and they recommend having your passport.
So my question is, if he goes to the border.. do they have judges there to decide if American citizens get accross? At the end of the day, he is American and is in Canada illegally so Canada shouldn't want him. How can he get himself deported?
It's a horrible situation and im looking for ideas. Thanks guys.

Has she tried driving across the border?
I mean the border guards are going to be more lax about it, if they look at here and her drivers license. It's completely different than airport security.
Other than that, I just don't know about this....You say she spent Thanksgiving and Christmas there last year? A whoel year and she can't get this resolved?

Something about this story stinks. He/she's been up there since February? We drove back from Toronto in March and didn't need a passport. What aren't you telling us?

Woof, Since my wife is from Toronto, I know for a fact that if you drive, you can still cross with a drivers license. If you fly, you need the passport. Hell, she could take a bus to the border and come over that way. You must not be telling something because its not that hard.

Something is not right! One time last year driving back, I made the mistake of crossing the border when the Bills had a home game. The border crossing was FULL or Canadians going to the game in every form on transportation. And that is the only time I have seen the duty-free shop basically run out of beer!!!

Call the State dept.
It's not easy, as you found out, to get anywhere without a passport these days. In 1974 I was on South American cruise and was called home on emergency. Problem was we didn't have A Status of Forces Agreement with Brazil. Which allows millitary to use their ID cards as passports. Took 2 days for the US Embassy to get me out. That was long before 9-11. While home I got a passport for the return trip.

Sorry, getting into Canada or out is not that tough. I think this is a "joke" thread. A pile of lies. Maybe I'm wrong. If I am, I'd like to work for this company.

So, to break this down.....His girlfriend who used to be a man is illegally detained in Toronto in a 5 star hotel because he/she doesn't have a passport that's not required. Her company is trying to illegally get her on a private jet by having her go to different Canadian cities, but they've been unable to connect yet. Sounds like a Seinfeld episode.

Well, throw in the parents that hate their kid and won't forward the passport, and the fact that said lady is living high on the hog on the companies money, and yeah, you pretty much have it.

I can't help thinking there is more to this than you are explaining..
All you would have had to do is go to NBC, CBS or ABC... Nightline, Dateline NBC or one fo those, tell them the story and they would have jumped all over it.. I have to believe that they would have been able to bring enough pressure to bare on those in charge of birth certs in NY that they would have gotten one and then paid to fly her home if she agreed to an intervew..
That's why I think there is more to this...
