Student wants suspension for Facebook page removed - Updated: 12 minutes ago PEMBROKE PINES, Fla. (AP): A former Broward County high school student suspended for criticizing a teacher online now wants to have that removed from her record.
The American Civil Liberties Union filed the federal lawsuit Monday on behalf of former Pembroke Pines Charter High School student Katherine Evans.
Evans wrote that her teacher was "the worst" on a web page she created on Facebook, a social networking site. She was a senior at the time and suspended for three days.
Principal Peter Bayer called it cyber-bullying harassment toward a staff member and disruptive behavior.
The lawsuit alleges Bayer violated her first-amendment rights.
Charles Dodge, superintendent of the Pembroke Pines charter school system, said he was unaware of the suit.

Cyber bullying is a very serious problem, I'm not sure this rises to that level though..

Yet another example of what American society has come to: "I have a right...........", and "I don't have to deal with any consequences of excersising my right".
Our society is being degraded daily by idiots like this.........no rules for me, only for you. I should be able to do what I want, when I want, with no reprecussions, but YOU must pay".
I'm starting to hate where this country is headed. I used to just dislike it, but now I'm starting to hate it.

I stated just yesterday that I used to just be frustrated with it, but now I'm starting to fear it...
Same premise I think.

Yeah, same premise. Problem is, it's looking bad for this country. Very bad. I won't go on here, but I have many thoughts about this.

Problem being, there's actually rules in place that a kid can be kicked out school for saying.............. " My teacher is the worst"? Pretty stupid rule. Has our society stooped to the level of censoring our youth 24/7 for displaying ANY discourse even on a civil level? Pretty sickenning if you ask me............... Kind of sounds like we're raising them to be drones who are afraid to question anything or speak their minds. Sort of like sheep being led away to slaughter. discourse = punishment You know, I've read about such type of societies in history books. Most were communist or dictatorships.

What are you even talking about? You don't think she has a right to have an opinion about her teacher? You think she deserves to be suspended for 3 days for disliking her teacher? Please...

She can dislike her teacher all she wants. She can hate her teacher. She has that right. However, if she uses that right, she is obligated to accept the punishment the school gives out for doing so.
Look at the hockey player from dallas I think it is. That guy had every right in the world to talk about his ex the way he did. But, he also, being a member of the nhl, should be more than willing to accept the punsihment the nhl gave for saying what he said.
He had the right to say it, according to the constituion. He's not going to jail for it. But, by being a member of the nhl, he needs to abide by their rules as well. If he wishes not to, then fine, he's out of the league. His choice.
Ever hear of a non compete agreement, or clause? If you agree to one, sign one, you still have your constitutional right to do or say as you please, BUT, if you break the non compete agreement/clause, you get nailed, even though you were right according to your constitutinal right.
Please note: we are talking about a charter school here, not a public school.

This girl should not be suspended. She should be able to give her opinion without being reprimanded---especially if that opinion is not obscene in nature---and the opinion is given in a way that does not interfere with the school day---which it was not. I believe that with the example that you used with the hockey player----he used opinions that could be widely accepted as offensive.
Saying that a teacher is "the worst" is neither obscene, nor offensive. Therefore, the school has no business suspending this girl.
I wish to wash my Irish wristwatch......

I think you guys are taking this a little too far...no need to be fearful that our country is doomed because this has happened, or anything related to this has happened.
It's a stupid fight, the school claiming that they had the right to suspend her and the girl claiming her first amendment rights were violated. This type of argument has probably happened a thousand times since the 80's alone, so I don't know why your all concerned with the direction the country is heading into now...it's not like this is exactly a new storyline, just different people and a slightly different situation.
I like what someone else said before; the charter school made the call. Be angry at the direction of the charter, not the nation.

Agreed. She's allowed a personal opinion. Since when can schools harass students for their personal opinions ? Schools need to stick to educating and not so much policing students personal lives. That's not their job.

Okay Arch, Lets say you had season tickets then you came on this board and said Savage/Romeo needs to fired because they are terrible. Then the Browns took away your season tickets cause you were "cyber bullying" . How would you react...from you answer you would just accept it cause those are the consequences... Actually I hope the school loses their lawsuit....and since when is facebook a domain that a High school has to right to enforce? I mean come on that's like your work firing you for saying your boss sucks to your friend.
Go Browns!!

Why do it on a public forum?? that's the problem I have. then it becomes personal. If she has a problem with the teacher she should be mature enough to air her concerns privately with the teacher. doing it on the internet is the cowards way. maybe her parents should teach her the proper way next time, instead of handling the way she did. I'd like to see if the teacher called one of the students"the worst".

that's totally different. the teacher and student share the same classroom each day. no one here I bet gets a chance to speak to mr.savage on a regualr basis. we don't work for the browns. the players do, that's why if they said that, they would get fined/suspended like winslow did.

It's facebook, it wasn't a website names 'mrssmithsux.com', it wasn't much different than hanging out at the mall chatting with your friends saying, you think this person is stupid, or this teacher sucks, or your boss is a moron.
And it's not like she made threatening remarks like 'Mrs Smith sucks, I wish she was dead' or something. Look what gets printed and published about the President hundreds of times a day. Why aren't all those people being reprimanded?

Then I think it's safe to say that every single person in this discussion is an immature coward.. we may not have had the internet when I was in high school but we grumbled and complained about teachers at lunch, after practice, on the weekends just amongst us kids... as I'm sure everybody else did. I seriously doubt that any of us ever scheduled a meeting with a teacher when we were 16 to discuss their teaching methods and why we disagreed with them.. I think your expectations are totally unrealistic.

What the article doesn't mention: Was the student on a computer at school when she wrote that, or was she on her personal computer, at home? It makes a difference.
If she was at school, first off, what's she doing on FB during school hours. Second, while she's on school time (and dime) she must abide by their rules.
If she was at home, then there should be no punishment. Her time, her parent's dime.

That's true, but I would hope the school would have sense enough to have myspace and facebook, itunes, youtube, etc blocked.

Heck they fight blocking porn and violent sites for fear that a few legit sites might get blocked in the process..
