This is the part that puzzles me. If he saw the guy why wouldn't he slam on the brakes, slow down, something other than nailing the guy? Unless he was going so fast that he couldn't. Or something slowed his reaction time enough that he tried too late.
As crass as this sounds it looks like we'll be drafting a WR this year, sooner rather than later.

The pedestrian could also have been at fault on this one. I'm sure Stallworth didn't drive up onto the curb to GTA this guy... If he is telling the truth and had his last drink at 7a.m. then his BAC should be well below .08. Who knows at this point.

If he gets locked up what happens with his bonus just paid, and his contract? Does it all just go away? Does he have to pay it back?

I would think that it would all depend on if there is a conduct clause.. I would think that if there is it could work in the teams favor.
But really the point of this is really, a man was killed and no matter who's fault, that's sad..

i know absolutely nothing about dante stallworth off the field, hell i don't even know anything about him on it, because he's never there.
but i think we can't just say "boom, guilty"
we don't know the situation, we don't know if he was impaired.
said he was driving to the beach at 7am? maybe he had gotten up and was going to run, a lot of athletes keep their routines up all year so that they aren't far removed from their playing shape.
i'm just sayin we don't know all the details. and even though i don't like the guy as a player, i say let's wait before we think he's a murderer.

The answer to your question is easy. Here in South Florida, the way the roads are built are different. Our freeways generally speaking are a bit smaller in curb cushion. With all the bridges, they can be much more narrow than you might think.
That and it seems EVERYONE down here drives much faster than anywhere up in Ohio. Driving on 95, sure the speed limit is 70, but if you're not doing 80 you can get rear ended. And many, many many people drive considerably faster than that even. It's not unheard of to be doing 90 - 100 mph on the turnpike or I75.
In the section of town this accident happened, it's got narrow lanes and I'm sure there was traffic that was impeding his ability to change lanes. Saturday's are a big change over day for hotels and tourists, and a lot of folks are heading out to the airport at that time. I'm sure all this had SOME impact on his ability.
If he is proven to have been impaired, on top of the crazy ass drivers down here, then yeah, it would be near impossible to miss him.

Whether or not the guy was drunk and this was murder, he's a nonfactor on the field....when he's is on it. Why we paid this guy a roster bonus, its beyond me. Anyway you look at it, this is his fault, and it could have been avoided, drunk or sober.
Hopefully this is good enough excuse to move on, get someone in here who can play, and be productive.
IF he was drunk, then he's gonna get nailed in court, and I would imagine suspended by commish.

So, if his BAC was over the limit, he's looking at a Felony 2 - at a minimum.
I would suspect that we could then count him out of our 2009 plans.

Just a horrible tragedy. My sympathy goes out to Stallworth and the family of the deceased.
I had a friend go through this last year. She was coming home from work on a st route going 55 in a 55. Came around a blind corner and hit something. She did not even see what it was, and initially thought it was a dear. Turned out it was a 3 grader who had got off the bus and had crossed the street to the mailbox who was killed instantly.
There was nothing that she could do. The kid walked out in front of her as she came around the turn. She wasn't cited and wasn't at fault. It was just a tragedy.
This could be a similar situation. There are way to many missing variables to be drawing any sort of conclusions about this incident, and I honestly don't know what to say about the people who are hoping that this could be grounds to cut Stallworth.

That's terrible. I too know someone who went through a similar situation.
Until a report comes back confirming Stallworth's BAC, I will give him the benefit of the doubt.
That said, even if the pedestrian was in the crosswalk, I fail to see how Donte could be at fault. Hitting a pedestrian in a crosswalk generally means that you either ran a light or the pedestrian crossed in front of you. Had he run a light, it would undoubtedly have been brought up.
Also, looking at that video, it did not appear that either the car or the site of impact was remotely near a crosswalk. It's also a divided highway with very little, if any, shoulder. If someone hopped a wall into the path of an incoming car, he'd likely be a goner.
I'm not quite ready to burn him at the stake yet...

I agree.
Couple of things here: first of all, it seems to be a 6 lane highway. I don't care where you live, they don't put crosswalks on 6 lane highways. 6 lane city streets, where there are stop lights, etc, yeah.......but not on a highway.
I don't care for stallworth. Based solely on his contribution to the Browns. With that said, sober or drunk, if you're cruising at 60 or 70 mph on a highway, you shouldn't have to be looking out for pedestrians crossing the street.
I hope stallworth was sober.

And on a different note: this is a perfect example of what can happen to you, me, or any of us if we drive after drinking. And I'm not saying stallworth was drunk or not.......this point is not about him.: You drive a car after drinking, even if you feel "fine", and someone walks out in front of you and you hit them through no fault of your own......well, when they find out you'd been drinking, it all becomes your fault, regardless. And you go to jail.
Hopefully, even if stallworth is found to not be at fault, people will keep this in mind. Like it or not, in todays society, if you have been drinking and are involved in an accident that is not your fault, the alcohol in your system automatically makes it your fault.
Look at stallworth.......he could be facing 15 yrs. in jail....IF he was over the limit. And actually, if his BAC was even .04 or .06, he'll be in trouble. You don't even have to be over the .08 limit for their to be problems when an accident occurs.

On the report I heard on the news tonight, it said the pedestrian was crossing the street trying to catch a bus. That might explain why he'd run across the path of oncoming traffic.

I read that too. But sorry, I don't run across that highway for anything other than saving my wife or kid. Look at it. That is not a road that is meant to be walked across.
I'm not excusing stallworth at all. As I said, if he had any alcohol in his system, he'll be hung out to dry. Maybe rightly so, maybe not. But let's not excuse someone for trying to walk across that road. It was not meant to be....walking across that road.

And again, I have NO idea if stallworth had ANY alcohol in his system, or if he was blitzed beyond belief. My main point is, if stallworth had a bac of .08 or higher, he's going to jail. If he had a bac of .04 or so, he's still spending a few weeks in the friendly confines. If he was sober as a stone he gets nothing, right?
Whether he did anything wrong or not depends entirely on his bac level, according to the law. And I don't like that. Yeah, if he was drunk, fine, the law is the law.
It's just a bad situation all around, and someone died as well.

I agree. Nothing good is going to come of this for anyone, regardless of what his BAC was.
On an ESPN forum, somebody familiar with the McArther Causeway mentioned that it is a 6-lane divided highway. It sounds to me like this is kind of like trying to cross I-90 near Dead Man's Curve.

Browns receiver Donte Stallworth hit and killed a pedestrian while driving his Bentley toward Miami Beach on Saturday morning, police said.
Stallworth, 28, struck 59-year-old Mario Reyes at 7:17 a.m. as he was crossing the street on a causeway between Miami and Miami Beach, said Detective Juan Sanchez, Miami Beach police spokesman. Reyes was pronounced dead at Jackson Memorial Hospital about 8 a.m.
Stallworth, who is believed to have earned his $4.75 million bonus from the Browns on Friday, was questioned by police and released. He has not yet been charged.
Stallworth, who identified himself to police as "NFL player Donte Stallworth," had blood drawn at the scene to determine if he had been drinking or taking drugs, Sanchez said. The blood test is required in Florida when a fatality or serious injury occurs. Results of the test may not be known for days -- or even weeks, Sanchez said.
"If the blood test shows any signs of impairment -- either drugs or alcohol -- we will take action at that point," Sanchez said.
He said he couldn't comment on Stallworth's demeanor at the site, because he didn't see him. He said Reyes was near a crosswalk, but it's not known if he was crossing legally. It's also not yet known if Stallworth was exceeding the speed limit. If Stallworth is charged, he'll be required to turn himself in.
Browns spokesman Bill Bonsiewicz did not comment directly, but the club e-mailed a non-attributed statement that said, "We understand the seriousness of this situation, but will not have any further comment at this time as this is an ongoing investigation."
Drew Rosenhaus, Stallworth's agent, did not return a phone message or e-mail seeking comment.
Witnesses told the Fort Lauderdale Sun-Sentinel that Reyes worked at a nearby shipping company as an overnight crane operator. They said he had just finished his shift and was crossing the street to catch a bus when he was killed.
If Stallworth is charged, the Browns could try to withhold the roster bonus he earned Friday until the matter is resolved. Large bonuses are normally paid in two installments, in April and January, meaning Stallworth may not have actually received the money yet. Most bonuses contain forfeiture language, and the Browns might be able to recoup the money, depending on the charges.
This isn't the first time Stallworth has been in trouble with police in Miami, according to the Miami Herald. In March 2006, he was arrested after resisting arrest during a traffic stop. According to the arrest report, he was pulled over in his Bentley for driving with an expired paper tag.
The report said Stallworth told the detectives that "this was going to cost us a lot of money and that he would have our jobs." He was charged, but not prosecuted. In 2002, according to the Sun-Sentinel, Stallworth was charged for allowing a passenger to ride on the exterior of his vehicle. He pleaded guilty in Miami-Dade County Circuit Court.
Stallworth was signed by the Browns as an unrestricted free agent last off-season to a seven-year, $35 million deal, including $10 million guaranteed. Hampered by a pulled quad muscle that caused him to miss five games in 2008, he's coming off the least productive season of his career, with 17 catches for 170 yards

I will say this....had the officers on the scene felt Stallworth was impaired, they wouldn't have released him...he would have been charged and booked then and there.
Unless the cops who made the on site or in precinct evaluation are totally incompetent, or Stallworth is very good at covering a impaired state, his blood levels is going to be well below .08. Even half of that would have probably been detected and booked.
If it comes back with some traces, that may influence how the charges are handled...it shouldn't..either he was at some fault in the tragic accident or he wasn't.....but in any judgment call, you know how that can go.

Many people on this board have decided to start posting in overreacting ways in a bunch of other threads/posts and when I seen the title I expected the same and wasn't wrong.
The story is still full of holes the investigation is ongoing, but people I guess who wanna say "I told you" are spouting off condeming something they have no clue about. I know many posters on this board consider themselves internet egomaniacs and like to use this forum to think they are impressive because of their idiotic comments but most of the stuff in this thread is ridiculous and people need to check themselves.

In my late-night boredom, I did some armchair detective work. From what I could tell, looking at the video and overhead satellite images of the causeway, the accident happened just east of the the intersection of the causeway and Fisher's Island Ferry Drive. I believe the reports say he was traveling east at the time, which adds up. In one of the shot's of the video, you see the victim's shoes lying in the road with the car further on down to the right hand side. On the ground there is a big letter S, which, judging from the street view imagery on the Google Map, should be from the word "BUS" painted on the ground. There is a bus stop between where the victim's shoes are and the intersection.
The report also says that his car was in the leftmost lane, closest to the center divider. The speed limit on the Causeway is 50 mph, but there's no mention of whether he slowed down at all or not. There is indeed a big concrete barrier which would've made swerving to the left impossible, and traffic conditions would determine if he could've braked hard or swerved to the right. I obviously have no firsthand knowledge of the area. Keys said that its very busy, especially on Saturday mornings.
But just looking at the pictures and video and kind of piecing everything together just reinforces, in my mind that either the victim was crossing illegally or he ran a red light. The victim's friend said on that video that Stallworth had to have run the light, but I take that with a grain of salt. There had to have been other witnesses around, and if he ran the light I don't see why it wouldn't have come out. Considering that its a 6-lane, 50 mph freeway, I'm sure that many precautions are taken to ensure that pedestrians are safe from traffic.
JMHO. I'm interested to see how this plays out, but like I said before, I don't think it'll be good for anybody, regardless of the outcome.

That is exactly it, if he was under the influence he would have been arrested on the spot, the fact he wasn't charged there means the officers felt enough time had passed since his last drink to the time of the accident that it rendered him sober.
I've been involved in a DUI, and I didn't kill anyone, and they still arrested me on suspicion.

I'm not passing judgment on a guy based on his last season. This will be a life-changing event for him. He's still a person, and this will be with him for the rest of his life.

I believe that in some cases, if you are found to be driving under the influence, you are automatically presumed to be at fault. Now, that might be more with drugs than alcohol, but someone please correct me if I'm wrong.
In any event, it's a terrible situation. I don't like Stallworth the player (never given a reason to), but I wouldn't wish something like this upon the guy, or anyone. You wanna talk about something that will wake him up at night and be burned in his brain forever.

the only thing that bothers me is the FACT/QUOTE if it is true - Stallworth saw the pedestrian and honked and flashed his lights...one would even expect both actions to be done in separate intervals and not at the same time. Still if it is fact he saw the pedestrian and if there was time to react why not step on the brake as part of the reaction. Its the only part that bugs the crap out of me and doesn't make one bit of sense.
His admission of drinking as much as 7 hours prior - probably had the local prosecutor "POISED" to arrest Stallworth with DUI n vehicle manslaughter.
But its still is all pending on the results of the test. Also if Stallworth exhibited any symptons of being under the influence one would have to believe that he'd be finally leaving the incident in handcuffs.
Again its that statement of flashing lights n honking the horn that bothers me. Cause I saw the sattelite portion and there are a lot of trees (if I was looking at the correct street - marked "A" ) where a pedestrian darting out to make it across the road could be hard to make out (low sun) and unavoidable. The only thing I can think of is that he went to make a panic stop and the foot slipped off the break onto the gas??? And he's trying to hide that and feels that if he confessed to that it would open another whole can of worms and suspicions???
All I know is its 3:40 pm and there has been no arrest announced - I assume it would be posted all over by a vigilant poster or two. Blood test results don't take this long even if its Sunday - if illegal levels one would assume they would look to arrest him immediately!
JMHO - could care less about his team contributions - I don't wish Ill on anyone - I just hope this was one unavoidable accident. They do occur. Wish they could report more on why this guy was crossing that busy road at 7a.m.???

There's nothing that said he didn't slow down. It's already been proven that he couldn't swerve to the left at least. Assuming traffic is as busy as multiple reports have said it generally is on that road and at that time of day, I'd say he probably had traffic to the side and back of his car as well.
The victim was crossing the street trying to get to the bus stop near the intersection. He worked third shift and had just finished eating breakfast after getting off of work. Donte honked and flashed his lights at the guy. This seems to indicate that he was fairly aware of his surroundings. My guess is he assumed that somebody who sees a vehicle moving quickly towards him flashing its lights and honking its horn will attempt to safely get out of the way. But that's just me.

Yeah me too, if I see pedestrians I lay on the horn. If they're like those stupid geese and just stand there I mow'em down.Don't they know who I am?

The only thing that is unbelelievable at this point is the way some people automatically have him guilty of involuntary manslaughter and dui. And one thing that doesn't yet make sense is the flashing lights and horn honking. I don't care for stallworth for one simple reason: he didn't help the Browns. With that said, the only way he should get charged here is IF he was drunk, or IF recklessness can be PROVEN. Otherwise, it was just a bad and sad accident that no one needs to go to jail over - whether stallworth is worth $100 million or $100. I find it interesting that as of now, I still haven't heard of an arrest. As others have mentioned, if he was obviously drunk, or even if the officers THOUGHT he'd been drinking (smell, bloodshot eyes, whatever) he would've had to take a breathalyzer, or refuse one - which, if he refused, trust me, it would be the headline. So, either the officers didn't see any need for a breathalyzer, and therefore no reason to cuff and stuff, OR he refused, and therefore that would be the lead headline. None of those happened. Yes, there are some incompetent cops, but most of those err on the side of arresting too quickly, not letting someone go. Now, did he run a stoplight? We don't know, but really, if stallworth had no place to manuever, then we would have to guess that a bunch of other cars ran a red light as well, wouldn't we? Let's wait and see what happens here. Let the cops do their thing. It could've been you, me, or anyone else that hit the guy. All it takes is someone walking in front of you at the wrong time. If it happened to me, and I'd had 3 or 5 or even 7 drinks the night before and simply because of that people were wanting me in prison......well, that would bug me.  Again, I don't care for stallworth based on one simple thing: he didn't help the team I root for. I also had a grandfather that died from a drunk driver. I'm not being biased here.
