STALLWORTH DETAINED IN PEDESTRIAN FATALITY
Posted by Mike Florio on March 14, 2009, 12:22 p.m.

Friday was a good day for Browns receiver Donte’ Stallworth. As of 4:00 p.m. EDT, he officially earned a $4.875 million roster bonus.

But Saturday is turning out to be a very bad day for the one-time first-round pick. According to CBS4 in Miami, Stallworth has been detained after an automobile accident that killed a pedestrian.

Per the report, the accident happened at the intersection of Fisher Island Drive and the MacCarthur Causeway in Miami.

We’ve separately been advised that police are investigating whether Stallworth was driving under the influence. According to a source with knowledge of the investigation, authorities performed a mandatory blood draw on Stallworth, and they are awaiting the results of the test.

We’re also told that prosecutors are involved, and charges could be filed very soon.

Stallworth, per the source, was driving a Bentley. As our own Aaron Wilson discovered while chasing the tip we’d received (yeah, we were responsible and tried to confirm before posting . . . for a change), Stallworth was arrested in 2006 while driving a Bentley. According to USLaw.com, Stallworth was busted after he refused to turn of his cell phone and shut off the engine after a traffic stop for driving with an expired license.

Wilson is in the process of gathering more details, and he might be posting a follow-up soon.

And let’s not forget that someone died what by all appearances was a preventable death. We hope that, regardless of what happened, the tragedy will cause the Donte’ Stallworths and Albert Haynesworths of the NFL to be a lot more careful in the future when driving their cars.

Coincidentally, Stallworth and Haynesworth both played college football at Tennessee, and both were picked in the first round of the 2002 draft, only two selections apart.

Why should it be locked? we can't complain that our one of our idiot receivers is an even bigger idiot in real life?

Cut him now, and sue for the bonus back.

Good thing you're not in charge. I'd hate to live under that system.

Miami Herald story

Miami Beach Police were questioning Donte Stallworth, an NFL wide-receiver, in connection with the death of a pedestrian who was hit and killed on the McArthur Causeway Saturday morning.

Traffic on the McArthur and Venetian Causeways was backed up to the mainland Saturday for hours because of the accident, which happened near the stoplight at Terminal Island.

The accident happened at 7:17 a.m., according to Det. Juan Sanchez, a police spokesman. Police had not released the name of the pedestrian.

Sanchez said Stallworth is cooperating with the police investigation. Officers drew blood from Stallworth at the scene, a way to determine if he was drinking. It is routine for officers to draw blood after fatal accidents.

Stallworth, 28, has not been charged.

He played for the New England Patriots and recently signed a $35 million contract with the Cleveland Browns.

I'm pretty sure they would routinely test in a situation where a death occurs. I hope for his sake and the victim that he wasn't, and it was purely an accident.

Drawing blood is routine in fatal accidents.

Lets wait and see what the deal is before we.....never mind...attitudes like yours and the guy before you are what is wrong with this country.

Wow tubby_dawg, Though they may not take blood for the fun of it, as stated in the article, it is procedural when an accident involves a death, and the fact he hasn't been charged with anything leads me to believe they really don't think he was under the influence.

People amaze me, because Stallworth was hurt all last year and didn't earn his money, he is somehow automatically guilty of being under the influence after an accident results in the death of a pedestrian.

It's people like you that allowed things like the Salem Witch Trials to take place.

It's what is wrong with fans today in America, and why sports (and entertainment in general) is taken way to seriously in this country. I guarantee you if DS had caught 90 balls for 1500 yds and 12 TDs last year, you would be hearing post after post about how it had to be the victims fault...lol. However, since he wasn't a very good football player last year people automatically assume he must be guilty. It's like they can't distinguish between what goes on the field and what goes on in "real" life.

It's a new phenomenon, and I read a book about it recently.........interesting stuff. Anyway, I will be praying for everyone involved as this is a truly tragic situation.......no matter how it happened.

They're saying the guy was crossing a busy causeway.

You can't jump to conclusions until you get all the facts. Crossing a busy causeway isn't a bright idea, but I'm sure more details will be forthcoming.

1) I hate to see someone pass away on account of drunk driving. If that is the case.

2) He just gave the Browns a reason not to keep him now.

Sounds like this is a real tragedy. But lets not jump to conclusions. IT is spring break time? Maybe the pedestrian was under the influence of something????

I am surprised that the law enforcement in FL draws blood at the scene. Its not uncommon for "the smart drunk" to demand a blood draw instead of the breathalizer- that can easily waste an hour or so as the person in question is taken to the local hospital lab for the draw- giving time to burn off more alcohol.

Stallworth kills pedestrian in auto accident in Florida
Updated 24m ago
MIAMI BEACH, Florida (AP) — Cleveland Browns wide receiver Donte Stallworth hit and killed a pedestrian with his Bentley on a busy causeway linking Miami and Miami Beach on Saturday, police said.

Stallworth was headed toward the beach when he hit a 49-year-old man around 7 a.m., said Miami Beach police spokesman Juan Sanchez. The unidentified pedestrian was taken to a nearby trauma center, where he was pronounced dead about an hour later. He was near a crosswalk but it's not clear if he was crossing legally.

Stallworth was cooperating and no charges have been filed, Sanchez said. Officers drew his blood to test for drugs or alcohol, which is routine, but police said it was too early to tell if Stallworth was impaired or violating traffic laws. Police would not say where he was coming from or where he was headed.

A message seeking comment was left on the voicemail of his agent, Drew Rosenhaus.

Stallworth signed a seven-year, $35 million contract with the Browns as a free agent before last season but hardly played because he was hurt. He was due a $4.75 million signing bonus on Friday.

we are so quick to judge and asume that a athelete is doing something wrong many times, when i read the first artical i know that's what i thought. A drunk driver went left of center hitting us head on a couple years ago, my wife and I were ok, but from that I have absolutly no sympathy for drunk drivers, and as far as I am concerned a drunk driver should be charged with murder.

On the other hand, what if some random guy walked out in front of him from behind a parked truck or something. That would be hard to deal with knowing that someone just not paying attention caused you to take thier life.

this story is not over.

It's done down here a lot. Alcohol is a major draw to the tourists, they come down with the "Margaritaville" attitude/state of mind. Which isn't a bad thing, it's what's buying my house for me, but there is a line. Don't get behind the wheel after driving.

The police in the area deal with it a lot, and have the kits in their cars and the training to take the sample, or if they don't, they will call for a EMT/Paramedic to take it at the scene of a accident.

I know the bartenders in the area I live and party in have a habit of calling a cab for those who are impaired.

Roger that, but until someone tells us the real story, I'm going to assume he was on his way to the beach for a morning run/workout in order to improve his conditioning as a professional responsibility of his employment.

The media always seems to throw a little blurb about alcohol in every article about an automobile accident. It's like they want everyone to think drunk driving was the cause before anyone gets the facts. They did that when my coworker died last October in a motorcycle accident. Said it was alcohol related. Turned out he had swerved to miss an object in the road, lost control and went off road.

PROSECUTORS POISED TO CHARGE STALLWORTH WITH DUI
Posted by Mike Florio on March 14, 2009, 6:47 p.m. EDT
As authorities in South Florida wait for the results of a blood draw performed on Browns receiver Donte’ Stallworth, a source with knowledge of the investigation tells us that prosecutors are preparing an indictment for DUI manslaughter, under the assumption that the results will show that Stallworth’s blood alcohol content exceeded the legal limit of 0.08 percent when he collided with a pedestrian, who later died.

Per the source, Stallworth admitted to drinking at least four Patrons and two Margaritas. A separate source called that information “basically right,” but added that Stallworth contends he had his last drink at midnight. The incident occurred after 7:00 a.m. local time.

We’re also told that Stallworth claimed in his statement to police that he saw the man crossing the street from a distance, and flashed the high beams and honked the horn of the Bentley he was driving. Apparently, there’s an issue as to whether Stallworth could have taken evasive action because of a barrier along the median.

We’re told that Stallworth is badly shaken by the news that the pedestrian had died.

And, frankly, he should be. Apart from the fact that he was involved in an accident that claimed a man’s life, Stallworth could be facing serious criminal liability, if the pending test reveals an impermissibly high concentration of alcohol in his blood.

I normally thought if the person dies they're charged with vehicular manslaughter, that could be really bad.

Ya' think???...I didn't think so...

Consider going 55 MPH and hitting something unexpectadly...Reaction time plus normal stopping distance...I thought his car was VERY close to the actual...Much closer than I would expect...And that IS his car...It's still dark at 7 in Florida right now...It's daylight in the pix...That's his car...
