Two people with knowledge of the case said on condition of anonymity the charges will be filed Wednesday against the 28-year-old Stallworth in the March 14 accident that killed 59-year-old Mario Reyes. They requested anonymity because the charges haven't been announced. The charge carries a possible 15-year prison sentence. Stallworth earlier released a statement saying he was "grief-stricken" over the accident. Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He previously played for New England, Philadelphia and New Orleans. Yup, same here. I wouldn't be surprised to hear that no charges will be bought, just like I won't be surprised if charges are brought.

I'm not referring to those publishing the articles, though. I'm referring to the fact that this is the third piece of information to be put out without a credible source. The first two proved to be unsubstantiated. What makes this one any different?
Every news outlet was also reporting that he he swerved around a stopped car to run a red light and that his BAC was .12 to .16, too.

Well no surprise here I guess. This whole situation sucks. I would have rather gone defense with our first pick but it appears Crabtree will be our pick.
I can only hope some team offers us a 1st round pick and a veteran WR for Edwards come draft day.

ESPN and the AP weren't....go back and check. Every rumor site and the miami herald were, big difference.
Also, the term has changed from 'may' to 'will' in the news reports, also the charges are expected to be filed today
these are all huge differences

I doubt The Associated Press would run this without very reliable sources. It's possible, but highly unlikely. No doubt ESPN picked this up off the AP wire.

yeah they got it from the Associated Press
Edit: Now that is pretty much official we have to deal with it. We may as well act like Stallworth no longer exists. If convicted I expect the Browns to go after his salary and the NFL to suspend him.

well now how many people want to get rid of Edwards? fact is with Stallworth heading to the slammer we have to keep him. That is unless you want Steptoe and Sanders and Cribbs as your WR's....I think we will draft Crabtree, re-sign Edwards, and still might take a late round wr this year

IF I understand the situation IMO the charges won 't stick....Sure Stallworth was drunk , but did they ever test the victim for illegal intoxication ?....Apparently , the victim was Jay Walking on a busy highway and shouldn 't have been there in the first place....If he was also intoxicated I can't see how the DUI Manslaughter case stands....That said , I am not sure I want Stallworth back in a Browns uniform....His cost to value ratio just isn 't worth it !....

Well, I'm not sure what Florida's laws say, but I have to think that a drunk person walking is going to be "less" at fault than a drunk person driving.
The fact of the matter is that Stallworth's car killed this guy, whether the guy was drunk or not. By the black-and-white of the law, that's manslaughter. Now, if it was a complete accident, like Stallworth was stone sober and this guy just jumped out in front of the car, then the charge would be dropped, or wouldn't even be brought in the first place once the DA had a chance to look at the facts.
But, as soon as you throw in a drunk driver, things change dramatically. Like I've said before, it's my understanding that, in Ohio at least, if you are involved in an accident and you are under the influence, it is automatically assumed that you were at fault.
And, it's my understanding that the guy that Stallworth hit was leaving work (please correct me if I'm wrong), so he likely was not drunk.

There are some minor differences between this story and the one filed a couple of weeks ago.. This one says he WILL be charged, that one said he MAY be charged,,
Otherwise, it's the same story rehashed with a slight twist..
If I were to guess, I'd say that it's probably true,, but I'll wait until I see him turn himself in..
Then I'll know for sure.

The fact that the victim, drunk or sober, was crossing the street illegally and that is what caused him to be hit and killed will be a substantial mitigating factor, IMO. A person can't simply enter the path of oncoming traffic, get hit, and collect. The law doesn't work that way.

Oh, I agree it's a mitigating factor. But it's tough to be *too* mitigating when the guy ended up dead because of the negligence of Stallworth, too.

The charge carries a possible 15-year prison sentence. Stallworth's blood- alcohol level after the crach was .12 above Florida's legal limit of .08, according to results of a blood test. Stallworth also will be charged with DUI, according to the people informed about the case.
Stallworth, who is expected to surrender in court Thursday, released a statement last month saying he was "grief-stricken" over the accident.
A Miami Beach police report said that Reyes was not in a crosswalk on busy MacArthur Causeway when he was struck by the Bentley luxury car driven by Stallworth. The construction crane operator was trying to catch a bus home after finishing his shift around 7:15 a.m.
The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40-mph zone.
Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He previously played for the New England Patriots, Philadelphia Eagles and New Orleans Saints.

Stallworth Will Appear In Court Thursday Posted by Mike Florio on April 1, 2009, 3:19 p.m. PFT. On Thursday, Browns receiver Donte’ Stallworth will appear in Court in connection with looming DUI manslaughter charges.
The appearance will be voluntary, and is the result of a brokered deal between authorities and Stallworth’s lawyers. Stallworth will not be arrested in the traditional cuffs-and-perp-walk sense.
Lawyer David Cornwell explained the situation via a statement forwarded to us via e-mail earlier this hour.
“Today, law enforcement filed an affidavit to establish that there is probable cause to arrest Donte’,” Cornwell said. “We have been in constant communication with law enforcement and the prosecution and, as result, Donte’s appearance in court tomorrow is voluntary and by agreement among the parties and Court. Donte will be processed and released on bond. These matters have been in the works for the past two weeks or more.”
Cornwell also pointed out that, contrary to published reports from WSVN and others, Donte’ will not be charged at this time.
Though in many cases it’s a distinction without a difference, Cornwell explained that the absence of formal charges is particularly important in this matter because the charges listed in a probable cause affidavit often differ from those that are formally made at an arraignment.
Cornwell also has been communicating on Stallworth’s behalf with potentially concerned parties in the NFL and the players’ union.
“I have spoken to the Browns, NFL representatives and [NFLPA Executive Director] DeMaurice Smith to ensure that all parties are aware of the status of the case,” Cornwell said. “De’s availability and his concern for Mr. Reyes’ family and for Donte’ and his family has been particularly helpful.”

Stallworth should have been cut before this even happened, now we had to pay a roster bonus to a guy heading to prison! we could have used that cash on holt, harrison or another servicable wr

Coulda shoulda woulda.....dude, relax. Believe it or not, the Browns didn't know what Stallworth was going to get into, not even Stallworth knew.
The money is gone as of now. (I have no idea how getting any of the signing bonus back would work - but remember, he's only charged as of now - he's not guilty yet) This is crazy - I didn't like him when we signed him, and obviously last year didn't change my mind about him.
But hey, there's something more serious than football going on in this mans life right now.

That bonus was guaranteed, hence the reason we kept him.  You want to keep Edwards and draft Crabtree. Sounds like Matt Millen to me.
