Stallworth charged in man's death

MIAMI -- Cleveland Browns wide receiver Donte Stallworth was charged Wednesday with killing a pedestrian last month while driving drunk in Miami.

An arrest warrant charging Stallworth, 28, with DUI manslaughter was filed in the March 14 accident that killed 59-year-old Mario Reyes. If convicted, Stallworth would face a maximum 15-year prison sentence.



Stallworth

Stallworth's blood-alcohol level after the crash was .126, well above Florida's legal limit of .08, according to results of a blood test. Stallworth will also be charged with DUI, which carries a possible six-month sentence plus fines and community service for first offenders.

Stallworth, who is expected to surrender in court Thursday, released a statement last month saying he was "grief-stricken" over the accident. Prosecutors said they will ask that he be released on $200,000 bail.

A Miami Beach police report said that Reyes was not in a crosswalk on busy MacArthur Causeway when he was struck by the Bentley luxury car driven by Stallworth. The construction crane operator was trying to catch a bus home after finishing his shift around 7:15 a.m.

The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40 mph zone.

An additional police affidavit filed Wednesday said that on the morning of the crash, Stallworth was drinking at a club in the posh Fountainebleau hotel on South Beach. He left to go to a nearby home -- it's not clear if the home was one of Stallworth's three Miami-area properties -- and then headed out to the causeway where Reyes was struck.

"I hit a man lying in the road," Stallworth told officers arriving to investigate the crash, according to the affidavit. One officer smelled alcohol on Stallworth's breath and said that his eyes appear "bloodshot and watery."

Stallworth's attorney Christopher Lyons did not immediately return a telephone call seeking comment.

Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He previously played for New England, Philadelphia and New Orleans.

this is why this board sucks anymore people just jump on someone for their opinions. I didnt know that it was promised in his contract, so get over it already. I dont read each and every thread on this board as i actually have a life other than Dawgtalkers.net

maybe some of you should try getting one then you wouldnt feel the need to jump in and start attacking someone cause they asked a question or gave an opinon

hmm i never thought of that....not pleading IGNORANT just to clear that up before i get gang tackled again. if he was all ready laying on the road then he wasnt the first to hit him, but since it said he tried to flash his lights and honk the horn i would say if he was laying in the road he would be dodgeable

i was just reading a article on cleveland.com and it stated that he said he hit the man lying in the road. the way i take that is he told officers that the man he hit is laying in the road. also can we get any of the roster bonus back and what happenes with the contract now that he is facing a minimum of 4 years in prison?

Barring some unforseen circumstances I see him getting cut within the next few days.

I'm sure the FO will be able to recoup at least some of the RB and his conract. As far as the cap goes, we don't have anyway of gettig any relief, even if he is cut.

According to the legal experts on ESPN, the trial likely won't be for another year. So barring any plea agreement he won't be going to jail until 2010.

After doing some quick research online, if Stallworth is suspended his base salary won't count against the cap, but his RB and prorated portion of his signing bonus will count towards the cap.

Also if Vick set any precendent, the FO won't be able to recoup any of his RB, only a portion of his signing bonus. This however will have no affect on the cap. That's just money back in the pocket of Lerner.

This of course is based on my limited knowledge of the salary cap. There are plenty of others on here that know it a WHOLE LOT better than me.

That's probably not a good idea.

It doesn't sound like any other team is looking it up, either. I'm sure for good reason. People have to let it go. Yeah, he's a great guy, a Browns fan, and a reliable receiver in his prime, but that's gone....

We are in SERIOUS trouble at WR and as BIG of an advocate that I have been of Mangini, I am just baffled that we have not brought in a Torry Holt to talk with ...

I mean seriously, we let our sure handed TE go in a trade, we released our sure handed yet oft injured WR, our #2 is now charged with manslaughter, we have Cyndric Slaphoe fresh off the practice squad, The Sleeper pick of last years draft class in Mr. Hubbard and last but not least we have our #1 guy that could not catch a case of the clap in a brothel possibly leaving after the season is over...

44- I don't think Mangini or Kokinis knew that Donte was going to have some drinks, get behind the wheel, and then kill a man when they traded Kellen.

Maybe they'd still have done it, maybe not.

We have a couple of 2nd rounders. Maybe some moves on draft day will net us more. But I'm sure we'll be drafting a WR. There's a few guys who will be there in round 2 for us.

I personally would want to keep Edwards for this year since I think he'll do amazing trying to get another big contract. That should be enough to keep his focus on playing well. Then I would franchise him, OR, I would trade him and acquire a WR as part of that trade, either from the other team or through the draft. I'm not big on taking WR's high - especially ones with attitude problems - and I would prefer more devotion to the running game anyways. I mean, hell, how many Super Bowls have Moss or Owens won?

First round, I wouldn't take Crabtree. I would go with Curry or Brown or even Raji. I would tend to go either trenches or Front 7 at that spot. That's how the Eagles have done it, and they've been a perpetual contender. Hell, the Patriots 3 D Linemen are also 1st round picks. Pittsburgh - Casey Hampton is a 1st rounder and so were Hartings and Faneca IIRC, etc. etc.

I am far from being more knowledgeable than tons of people on this board, but when I don't know, I ask questions instead of chirping about something and then getting all defensive when I'm called out.

Most importantly, your problem is that you happen to take things too personally. I don't think anyone here is trying to insult you. We're all football fans rooting for the same team. I don't think any, or most of us, actually want to make our fellow fans feel stupid.

That being said - back to the topic - I really can't imagine this leading to any sort of plea deal that doesn't mean jail time. I think he's cooked.

Just a frustrated fan here as I had to stomach the cRAC years and his inneptitude with picking a QB... Season three with BQ and we are STILL not sure what we have in him??? We already have enough evidence of what DA is and isn't but Quinn is a relative unknown still... Lewis is old and his days are truly numbered... What I am getting at is I would like to see us not even be sniffing in Crabtree's direction and if we truly are going to be a run first team, we have a few holes on that o-line that need addressed in order to pull that little feat off... It makes sense to me to sign more than these ... ... damn scrubs we keep seeing us sign... I think Mangini is a good coach and he was my first pick when rac got ... canned but this signing of suck ass scrubs is starting to get annoying. Seems we will be picking in the top 5 again next year with the lack of talent we keep passing up or letting go...

It would seem that it's smarter to just have someone drive you home doesn't it..

Anyway, he's being charged today, but this is a long way from over. Being charged and being convicted are two different things.

Once convicted, Yeah, I hope he goes to jail.. not a question in my mind.

My thoughts are with the reyes family right now..

i just saw a video on yahoo, that said ... ( I take it that it said you were forbidden to link to it.)...So do we keep him or dump him now? with the state of our WR core i suppose we need all the help we can get.

I think he should have to sit in jail until trial but with the way the legal system works he can get out on bond, so should we play or should we dump him?

... The question is, will the Browns take a chance using a roster spot on a guy that may not be here by mid season?

I'm thinking that if we find a guy that we think could be as good or better than Donte,, or even close, we should take a chance on the new guy and cut/release Donte. And yea, if it's possible, I'd ask for some of that bonus back. But that's just me....

Stallworth Stallworth will be prohibited from driving while on bail and not allowed to drink alcohol, according to court documents. He also must observe a midnight to 6 a.m. curfew, submit to random alcohol and drug testing through the NFL's substance abuse program, and seek permission for any travel other than between Cleveland and Miami.

Stallworth, 28, was led away in handcuffs after a short hearing before Miami-Dade Circuit Judge Dennis Murphy. He was expected to be released on $200,000 bail later in the day.

Stallworth attorney Christopher Lyons said he would "vigorously defend this case" and that the defense team has already begun its own probe into the March 14 crash that killed 59-year-old Mario Reyes. Lyons also expressed sympathy for the Reyes family.

"We want to stress there are no winners here. It was a tragic accident," Lyons said.

Stallworth, dressed in a dark suit, white shirt and blue tie with white polka dots, said little at the hearing and did not speak with reporters outside the courtroom. He was accompanied by his mother, Donna, in the courtroom.

If convicted of DUI manslaughter, Stallworth faces a maximum of 15 years in prison. The NFL and the Browns are also reviewing the charges, and the Browns issued a statement saying the team is "disappointed" with Stallworth's actions.

The judge set an April 23 arraignment date for Stallworth to enter a plea.

"We are saddened by the circumstances that have taken place and our thoughts and prayers go out to the family of Mario Reyes," the Browns said in their statement. "We have been in communication with the commissioner, who is reviewing the situation under league policies, and we will withhold further comment at this time."

NFL spokesman Greg Aiello said the league would review the case under its conduct and substance abuse policies.

Innocent until proven guilty is the rule isn't it? I'd say that if he's free on bond, charged but not convicted and available to play, we could do so. The question is, will the Browns take a chance using a roster spot on a guy that may not be here by mid season?

While all politically correct emphahsis is on the Reyes family loss, this just makes it easier to replace what was highly overvalued in the first place. I wouldn't care if he "became" innocent even though he's apparently guilty, he needed to go anyway,....

CLEVELAND -- Browns receiver Donte Stallworth was already in the NFL's substance abuse program before being charged with DUI manslaughter according to a report, meaning he'll most likely face stiffer sanctions from the NFL if convicted.

In March of 2007, the Philadelphia Inquirer reported that Stallworth was a participant in the league's substance abuse program and faced a suspension if he violated the conditions again.

Asked about the report a week later when he signed with the Patriots, Stallworth told the Associated Press, "All that stuff is in the past. There was a situation a couple years ago. There's nothing now that's going on that will affect me preparing for helping this team."

Stallworth, 28, surrendered in a Miami courtroom Thursday morning on the DUI manslaughter charges in connection with the death of pedestrian Mario Reyes, 59. He made a brief appearance in front of Miami-Dade Circuit Judge Dennis Murphy before being led away in handcuffs for booking. He was released a few hours later on $200,000 bail.

Holding his mother Donna's hand outside the Miami-Dade county jail around noon, Stallworth told a group of reporters and cameras, "I just want to extend my condolences to the Reyes family. My prayers are with them. I have full confidence and faith in the legal process."

The Inquirer report from 2007 did not specify why Stallworth was entered into the NFL's substance abuse program or what stage he was in. A player in Stage Two faces at least a four-game suspension if he violates the conditions of his program. A player in Stage Three faces a one-year suspension.

Players in Stage Two can rotate out of the program after two years if they've been compliant, but any prior history of substance abuse is a factor in determining NFL fines and suspensions.

For comparison's sake, Rams defensive end Leonard Little was suspended eight games by the NFL in 1999 after killing a four-year old girl while he was driving drunk. It's not known if he was in the NFL's program before the conviction.

Stallworth's blood alcohol level was .126, well above Florida's legal limit of .08, when he struck and killed Reyes with his Bentley on March 14 at 7:17 a.m., according to a police affidavit. He'll be arraigned April 23rd in Miami-Dade circuit court, at which time he'll most likely plead not guilty and a trial date will be set. If convicted, he faces four to 15 years in prison.

Stallworth, who was headed back to Cleveland to continue working out in the Browns off-season program, can enter a written plea and does not have to appear at the arraignment.

Stallworth's attorney Christopher Lyons, a former Miami-Dade prosecutor, said in a brief press conference outside the courtroom Thursday morning that he would "vigorously defend this case." He also said that his defense team has already begun its own investigation into the accident.

"We want to stress there are no winners here," Lyons said. "It was a tragic accident."

Dressed in a dark suit and tie, Stallworth barely spoke at the hearing and did not address reporters outside the courtroom.

The Browns issued a statement Wednesday saying that the charges are very serious "and we are disappointed he has put himself in this position." They added NFL Commissioner Roger Goodell is reviewing the matter under league policies "and we will withhold further comment at this time."

The affidavit said Stallworth had been drinking at the upscale Club Liv in the Fountainebleau Hotel in the hours before the crash. His defense team is expected to argue that Reyes was not in a crosswalk, and that Stallworth honked and flashed his headlights to alert him.

How late do Florida bars close?

I mean ... a .126 at 7am is either a whole lot of alcohol before 2am .... or a night of drinking into the 6-7am range.

Either way ..... it was just idiotic on his part ... and now a man is dead. Could he have avoided the accident if sober? Who knows? The bottom line is, he was drunk ...... and a man is dead ..... and he deserves whatever punishment comes his way.
