The false jackpot message went to Louise Chavez Friday while she was playing penny slots in the Fortune Valley Casino in Central City. The machine announced she'd won $42.9 million -- a far richer sum than the posted top prize of $251,000.
Fortune Valley doesn't dispute that the machine told Chavez she'd won millions. But the casino says workers immediately told the gambler the message was an error and reported the mistake to the Colorado Division of Gaming, which regulates casinos.
Chavez says she's owed the full jackpot. The woman told news stations she earns only about $12,000 a year as a home assistant in suburban Denver.
"I just felt like, you know, I was being cheated. I was being cheated out of the money that I won," Chavez told KCNC-TV in Denver.
Colorado gaming authorities say the casino has no legal obligation to pay the $42.9 million. Don Burmania, a spokesman for the division, said the top prize of $251,000 was clearly posted in the casino and that a software malfunction is to blame for the glitch.
Burmania said Chavez likely won a prize, triggering the message, but that the game's structure wouldn't allow such a rich jackpot.
"If she is owed some money, the casino and the manufacturer are more than willing to pay her what she's owed. But it will not be $42.9 million, that's not possible," Burmania said.
It's not the first time a Colorado casino has had to fess up to a phony jackpot. In 2008, Burmania said, a penny slot machine at another Colorado casino told a player she'd won $164 million. Her correct prize should have been $6.60.
That casino settled a lawsuit out of court with the gambler.
Chavez says the Fortune Valley Casino gave her a free breakfast but that she is owed more. There was no immediate word on a lawsuit, and casino spokesman Joe Behm said the casino was waiting for the state investigation into the glitch before deciding what to do.
"Of course, once the division's inquiry is completed, we will follow any instructions we receive," Behm said in a statement.
Chavez told ABC's "Good Morning America" that she deserves the full prize.
"There are dreams and there are things I'd like to do -- helping my family, helping my kids. That's why I'm disappointed," she said.

Two schools of thought here..
1. It's clearly marked that you can win up to $251K.. So why should you expect more?
2. Thier machine did make the error and did tell her that she had won $42.9 million, then they come from everywhere saying it's a mistake. so the first thought that ran through my mind is that,, are they trying to scam her out of the winnings?
If they didn't want this out in the open, if they hadn't called the gaming commission and been upfront about it, if there wasn't a sign stating the max win is $251k... Then yeah,, I'd say this has scam written all over it. But they did all those things so to me, it's probably exactly what they said it was.. a glitch..
To make it right, since it's thier software, maybe a show of good faith would be to offer her something in addition to the $251k.. Maybe a weeks vacation with luxury room, all meals and some shows and some house chips to play with... Or even a free weekend with all the meals and drinks for two once a year for a few years.. something like that.. Oh, and of course her legit win of $251 k........
That's about it and I bet when it's all said and done, that's the way it will come down..

Pay her the $251k in a good faith payout. Outside of that, she's owed nothing.
Now, if they come back and say she's really only due $10. Take them to court.
Get your code in working order before you roll it out to the public losers.

I bet a lawyer will come up with a way for her to get more than $251K. If they have ever used a sign over another sign to promote a special jackpot, I bet they wuld be open to paying out the prize shown on the screen.

How do we know that this wasn't the casino's plan all along? - Set the machine so that it hits on a jackpot that isn't conventional so that you can claim error.
I hope she takes this to court and wins. - Maybe not 42.9 million, but something substantial - and well above what the casino claims as the maximum payout allowed.
I'm sorry, but for a casino to cite one of it's own machines as faulty after a huge payout is produced is totally, totally, wrong. I hope she pushes this as far as she can and I hope she makes out big - maybe 5 million.

This is funny...about 4year's ago the same thing happend to me, the casino said the exact same thing  But When I asked for the manager the tone turned to...Let me go talk to the pit boss, Im like What! im not on a table, so then a Manager came over, said he would call up stare's  ...I said WTH does that mean? Well a long storie short, I got what the machine was max'ed out for, not what it said I won...All in all , I felt it was fair after they explained it.

Were these machines manufactured by Toyota? If so, it was probably just an unfortunate event of accelerated earnings, due to a faulty carpet. Or maybe an electro-magnetic malfunction.

I wonder if the odds get taken into account when the machines are programmed. Meaning they tell you that you have 1000/1 odds at hitting the jackpot of 5,000. But the machine is programmed not to hit on anything short of 42,000,000, and the odds of this happening are a billion to one.
So, essentially, the odds of hitting a jackpot are a billion to one, even though the casino is advertising it at 1,000/1. - When it does happen, all the casino has to do is surrender their max jackpot, and not the one that the customer is due. - Casinos cannot be allowed to have errors like this in their favor.

All slot machines clearly state: "Malfunctions Void All Plays and Pays" If there wasn't $42.9 even at stake, sounds like a malfunction. This is why the states have gaming commissions. They'll investigate and they'll say, "sorry" if the Casino isn't pulling a fast one. She might get her pennies back, a comped room and meal. And like others said....$12K / year, crying poverty and gambling?

All I heard was how Fortune Valley Casino in Central City, CO has slot machines with SW malfunctions that award big payouts (and for just pennies).
Sure, you probably get capped at the top listed prize, but I am betting without the SW error that the prize would have been nowhere near that large.

There was a posting above the machine stating the top prize, along with the traditional disclaimers on the machines, I wouldn't pay her a dime over the max payout.
Slot players usually know exactly what the payouts are.

yeah we all have dreams and things we'd like to do, but once the gaming commission finishes their inquiry you'll get what is owed to you, but it won't be 42 mil. But don't act like 251k isn't going to nice. Besides, she'll blow through it in 3 months and be back to playing penny slots with her lunch money.

Again, I don't think the casino pays her a dime. Slot machines in Vegas give faulty payuts all the time. When thiis happens in Vegas, the Nevada gaming comission sends their own people in to investigate. I can only assume CO has their own people.
If she gets any money out of this I don't see how this doesn't snowball out of control to casinos everywhere.

I don't think the machine went into jackpot mode for no reason, so she will get whatever she was supposed to win once the inquiry is done, which is probably more than a dime. Although on a penny slot, it could be a 10 pennies.
