McDonald's sued over Happy Meals

The Center for Science in the Public Interest files a lawsuit claiming McDonald's toys entice children to make unhealthful food choices.

By Sharon Bernstein, Los Angeles Times

December 16, 2010

Happy Meals are again under attack, this time in court.

The Center for Science in the Public Interest has filed a lawsuit against McDonald's Corp., claiming that the company's meals with toys unfairly entice children into eating food that can do them harm.

The Washington advocacy group warned McDonald's in June that it would sue if the company did not stop providing toys with children's meals that have high amounts of sugar, calories, fat and salt. The suit, filed in San Francisco Superior Court, seeks class-action status.

"McDonald's offerings consist mostly of fatty meat, fatty cheese, French fries, white flour, and sugar — a narrow combination of foods that promotes weight gain, obesity, diabetes, and heart disease — and may lead to a lifetime of poor diets," Michael Jacobson, the group's executive director, said in a news release.

The lead plaintiff in the suit is Monica Parham, a mother of two from Sacramento who said the company "uses toys as bait to induce her kids to clamor to go to McDonald's," the organization said.

McDonald's spokeswoman Bridget Coffing said Happy Meals offer quality foods in smaller portions that are appropriate for children.

As the debate over Happy Meals and childhood obesity has raged in recent months, McDonald's has consistently pointed out that parents can choose apple slices instead of French fries for their children, and order milk instead of soda.

"We are proud of our Happy Meals and intend to vigorously defend our brand, our reputation and our food," Coffing said Wednesday.

"We listen to our customers, and parents consistently tell us they approve of our Happy Meals," Coffing said. "We are confident that parents understand and appreciate that Happy Meals are a fun treat, with quality, right-sized food choices for their children that can fit into a balanced diet."

Last month, San Francisco banned promotional toys served with meals that don't meet nutritional standards. This was widely seen as an attack on Happy Meals.

Santa Clara County enacted a similar measure in April.

More nannyism... I guess some parents just do not know how to tell their kids a two letter word of NO..

BTW the lead plaintiff is a state worker who works in a health segment of the group suing McD's.

How many children are walking in and dropping the 5 bucks for one?!

What a wimpy, unaccountable, sissified society we've become...

What happened to telling your fat little kid "no"? I see kids ruling their parents everyday and it makes me sick.

Me too. And while I may spoil my little girl, she is told no. And she does deal with it. Sure, she may cry (which breaks my heart), but I let her cry for a few seconds, tell her to stop and she does. Be the parent, people!

Then we need to make this an all-inclusive, class-action lawsuit.

A friend of mine was just talking about some advice she got from her Mom. She said "make them cry now, or they'll make you cry as an adult" She didn't mean to beat them til they cry, just tell them no and stick to it.

seriously. "My kids want me to buy your product, so you should pay me money!" What about Kellogg's? Froot Loops aren't healthy. Nickelodeon? Watching TV isn't healthy. Nintendo? Video games aren't particularly good for you either. You all owe me money. GMAB.

You go Monica! .....I think I'm going to file suit against all "fatty" food manufacturers and grocery stores who print coupons in the paper as bait to buy their products.

I'm not so sure it is just about parenting as it is about pushing an agenda on society as a whole and corporations specifically. A witches brew of nonsense if you ask me.

I don't like McD's food (except their fries), but they have by FAR the best toys. Hands-down and not even close.

She needs to become the parent in the relationship.... She needs to learn to say no... and if all her daughter wants is the toy.. then just buy the toy... McD's will just sell you the toy by itself... and furthermore she keeps saying crap about the commercials... Turn off the freakin' TV then! And become a parent... do not let your kid run over you...

To play the Devil's Advocate:

Everyone is saying that the parent needs to parent and tell the kid no.

If the parent is unable or unwilling to do that, does one just like the cycle continue or does the government step up to be the "nanny" and work to ensure young people have better nutritional habits?

A nanny is provided to people who need care......maybe there's enough people out there that need the care that government has to do it?

A sad commentary to be sure.

If the parent cannot say no to their kid about a Happy Meal, they are going to have more problems as the kid grows to be older... Perhaps instead of telling McD's that they cannot hand out toys or offer healthier options(which they already do, but some parents are still too stupid to ask for them), maybe they should just take the kids away from the parent who cannot say no to their kid and stick with it.. The problem here is that she is letting her daughter run things.. She probably says no but eventually says yes which then teaches her daughter to just keep asking because eventually it will lead to yes..

But this is more to regulate McD's than anything... It's trying to push their beliefs onto everyone else.. If they had their wish, they would shut down McD's and other fast food places..Keep in mind that this lady, Monet Parham-Lee is a state worker that works for the Dept of Public Health. I totally agree Tux.

Really, its a silly move as it doesn't change anything. Parents need to buck up and not feed kids crap constantly.

I'm more concerned that this is a gov't agency going after McD's under the guise of a mom suing them, which happens to work under the same gov't agency... Yet the media ignores the fact that Monet Parham is working for the agency that is suing on "her" behalf..

I thought California only had to worry about the Global Warming Religion... Now we also have to deal with the Health Nut Religion..

Pretty soon we'll have to ban the toys at WalMart because parents just can't say no and they'll go broke pacifying little Jack & Jill.

Ugh.

I'm going to have to sue McDonalds too. Every time I took my kids there and bought them a happy meal, they ignored the food for the toy. As I'm the type of person that hates to waste, I'd eat their meals along with mine. When that crap stops my heart, I'll have my wife sue them for enticing my kids away from their food.

well, maybe if McD's puts pot in their Happy Meal, then they won't be sued? then the kids will get the munchies and buy a 2nd Happy Meal. win/win
