Question, since you, as I recall, have firearms and a concealed carry permit: if you are legally carrying a gun, are you permitted to announce it to a would-be assailant as a means of deterrent? That is, if you suspected that someone was, for example, going to mug you on the street, are you allowed to tell them, "I'm carrying a gun and will shoot you if you attack me" or even simply tell them that you're armed?

Not answering for him - but HERE, yes, I can tell them that.

I do not know for sure about this last question. I have been taught that if you pull your gun, you're shooting. The other side of that is, if you're attacking me, and I pull my gun and you turn tail and run, I cannot shoot. If I do, I'm at most a felon, at least, a misdemeanor criminal.

The 3rd side is - if you are threatening me, and I pull my gun due to the threat, and you leave........I'm gonna have to explain myself to the police. IF they show up.

Thanks. By expose, I didn't necessarily mean to draw it. Say you have it in a shoulder holster (do people use those?) under a blazer or jacket...could you open your jacket so that its plainly visible?

Yes.

Then you should be able to expose the gun legally. I'd certainly be of the mindset though if I was exposing it I was planning on using it.

Actually - as I think about it - yes, a person can expose a gun if they are in a "fear" position. However, it's a fine line. Walking down the street, passing someone on the sidewalk - if I expose my gun for no reason, I could be cited with a misdemeanor.

Tough to prove - because a concealed carry license is NOT a license to intimidate - UNLESS the intimidation is a direct act to avoid a confrontation.

And having someone bang your head against concrete is also a forcible felony that one could defend themselves against.

In some circumstances, yes. In this particular instance, we'll probably never know. SYG can only be invoked in the prevention of a "forcible felony". Only aggravated assault is a forcible felony, and is defined as either "assault with a deadly weapon" or "assault with the intent to commit a felony".

I don't care who started what, if my head is being banged into a concrete sidewalk I will kill you if it the only way to stop your attack.

Many people look at the SYG as a one or other, but it is possible that both had the right to SYG.

Only if the initial aggressor has exhausted all means of retreat or "clearly indicates" that he is no longer going to use force against the other party.

Let me clarify. Both people at one point or another in a the situation could have had right to SYG. Not necessarily simultaneously, but what starts out as an attack on one person who could claim SYG could easily turn and become SYG for the other. If Joe starts beating Bob with a bat, Bob has the right to defend himself with lethal force, if Bob manages to get the bat from Joe, and now he's enraged and starts beating Joe, then Joe now has the right to use lethal force.

In a simple answer no. My firearm is to be used only if I am in emminant fear for my life. This is somewhat subjective, as a 80 year old man in a wheelchair would fear 2 men approaching in an aggressive manner before I would, as I could more easily retreat to safety.

======================================
(1) Except as otherwise provided by law and in subsection
(2), it is unlawful for any person to openly carry on or about his or her person any firearm or electric weapon or device. It is not a violation of this section for a person licensed to carry a concealed firearm as provided in s.
790.06(1), and who is lawfully carrying a firearm in a concealed manner, to briefly and openly display the firearm to the ordinary sight of another person, unless the firearm is intentionally displayed in an angry or threatening manner, not in necessary self-defense.

790.10 Improper exhibition of dangerous weapons or firearms.—If any person having or carrying any dirk, sword, sword cane, firearm, electric weapon or device, or other weapon shall, in the presence of one or more persons, exhibit the same in a rude, careless, angry, or threatening manner, not in necessary self-defense, the person so offending shall be guilty of a misdemeanor of the first degree
=========================================

By that you can see what I mean by subjective. When the question arises, you have to assure the officer(s) that you knew they were going to mug you. If you can not convince them of that, then you are in violation.

The basic rule amongst those I know in Florida, and on the Florida Concealed Carry fourms is that it is best not to display or pull your firearm unless you have full intent to use it against the person you suspect of doing you harm. The firearm is for self defense, but awareness of yor surroundings, and avoiding possible trouble situations are your best defense.

I know people who have been mugged while carrying, and never had the chance to draw their weapon, since the assailant approached them unexpectedly with a weapon drawn. In some cases it is best to give up your wallet and watch, than to try to outdraw a pointed gun.

And if the initiating event that started the fight was on you, then you should go to jail for that.

I'm not arguing from a legal standpoint, but from a common sense standpoint, if you start an unprovoked fight and end up losing to the point where you shooting the other guy is the only way to save yourself, then you should still go to jail.

At what point does a simple physical altercation justify doing something fatal to the other person, regardless of who started it?

There are physical scuffs everyday, and most do not reach the point of one person doing something that will most likely result in death or permanent physical injury.

In Florida? When you think someone is going to murder, rape, rob, kidnap, assault with a deadly weapon, set off a bomb or commit treason. That's provided you weren't the aggressor, or, if you were, you exhausted all means of retreat or clearly stated that you were no longer going to use force of your own and the adversary doesn't relent.

If someone is moving towards you by what means do you know it will be simple altercation? There's very little socking someone in the nose and moving on happening now days. You're down have having your head kicked in before you know it!

I WILL NOT be a victim! I will survive and THEN worry about the consequences! If I've drawn and fired it will have been necessary!

I have warned three times on one occasion then pulled and let it drop to my side. The guy abruptly turned and left. I've also told a guy outside a pizza shop who insisted I buy him a pizza that I was armed and he should leave. He did.

DO NOT fire a warning shot as you might be charged with attempted murder. Yes, Ohio has open carry but why advertise you have a gun? Someone can wrestle it from you and either swipe it or shoot you. Not to mention the police will most likely stop you for a chat. Why be bothered?

You can look up our laws online. They are not complete though. When you carry you cannot claim ignorance! If you don't know something you better darn well find out!

It sounds to me the police are handling Zimmermans case correclty. Too bad the media has not...

Wait, you hinted at shooting a guy because he was bugging you about buying him a pizza?

I mean, I wasn't there -- maybe he was really annoying or something -- but that seems a little extreme

I can sorta see this...you have to read a person.
Once when I was in lived in Erie I was brushing the snow off my truck. This guy came up to me and kept insisting I give him a ride to his friends house. I kept telling him no, but I could feel the tension escalate, and hear the tone of his voice becoming more agitated. He stood in front of the door to my vehicle, and wouldnt let me enter it. Finally he swung on me and tried to steal my car.

I'm not saying it's not entirely possible -- your case is a little different because he's blocking your entrance to your own vehicle, and this guy was apparently just standing on private property. It seems much easier to just duck into the pizza store where the guy isn't going to follow you.

Again, I wasn't there in the least -- it just doesn't seem like one of those instances I would even remember - much less feel it was necessary to have a gun for.

yeah, I guess it was just an excuse for me to remissness a bit. I didnt have a gun or a carry permit so I had to do things the old fashion way.

Given that I'll likely never know what actually happenned...your comment about the media is right on the money and has become my biggest beef.

We also have Obama inviting race into the situation...of course Jesse & Al clearly making it a race issue...and Trayvon's parents speaking to Congress about the problems with racial profiling...all with absolutely ZERO evidence that race played a factor in the incident.

I'm sorry...but what the people in the above paragraph have done is every bit as offensive as the derogatory use of the "N" word.
