I guess it is when they spend many dollars trying to prosecute you for something you didnt do because some busy body was upset becaue someone actually corrected their child for not doing what they were told. They actually showed up at my house(metroparks rangers) and took me from my fron yard in cuffs while my wife and kids watched on a Saturday morning and then wouldnt give me bail until I appeared in court on Monday and then the prosecutor for the metroparks insisted on a protection order against me for my whole family against their wishes. So not only did I sit in jail for three days I wasnt legally allowed to go to my own home for almost three months while they case was worked out despite the fact that my wife took my son and had him examined by a doctor immediatly after my arrest and the doctor said he didnt have a mark on him but yet the arrest report by the ranger said I was accused of striking him with a closed hand. The judge read the prosecutor the riot act for wasting his court time and space in his jail for a case like this. So after all that the prosecutor wanted something so rather than go through the further hassle and delay of a trial everything was dropped in exchange for a guilty plea to disorderly conduct.
I do beleieve though that without the lawyer who knew the judge well and could go in his chambers and talk to him about what was going on the prosecution would have pressed on with midemeanor 1 domestic assault.

Get a local attorney who deals with this judge on a regular basis.You have to remember you are in a small town and the good old boy system will be in effect big time. Last year I yelled at my son in the Cleveland Metroparks and he threw himslef down on the ground and threw a fit so some people on the other side of the park saw him on the ground and claimed I knocked him down. I got a lawyer who works in the Lakewood courts all the time and was very aquainted with Judge Carrol. The judge even told me I had retained very good counsel when I went in for my plea. Technically my town may be small but it is part of Mahoning County which is a branch off of a much larger Youngstown area. Most of the people working in the court system in my town are from the youngstown area and that is where this attorney Charles Dunlap does alot of his case work I believe.
BTW that was crappy what happened to you. Some people might not see things sometimes so they just decide to fabricate the rest which is idiotic.

I can't speak for him but it sure sounds like you have a selective memory. When people get as drunk as you claimed to be I think it is a common problem.
I don't know if it is illegal for police in Ohio to use headlocks. I do know there was a big flap over them a few years ago.
When you get a lawyer I'm sure he will be able to answer all your questions. If you know all the people that were around you and the cop it might be a good idea to write those names down. If they can back up your story it couldn't hurt.
I don't know you and have no reason to believe you're anything but a nice guy, even when you are drunk. This is the second time you have been in trouble when alcohol was related. Staying out of bars when drinking a lot is probably a good idea. I have enough trouble with some of the sobs in bars when I'm sober. If you do go try to drink less. Your tolerance for trouble makers might go up and keep you out of trouble.

I didn't call him today. I'm going to wait until after court tomorrow and plead not guilty and waive my right to a speedy trial then get a later court date so I can call a few people attorneys and weigh my prices and see how much I am going to have to save and see how long I have to do it.
This isn't the first time I have been in trouble with the law for assault but y last one got dropped to disorderly and that is what I did the first time was plead not guilty and got a later court date.
I know what you are thinking, must be a trouble maker. Actually the first time it happened a friend of mine was passed out in her car and some guy took her car with her in it without her knowledge while he was so drunk he could barely walk. I have had numerous friends die in car accidents and it pissed me off so I tracked them down and started yelling at the guy and he swung on me so I beat the crap out of him and put him in the hospital. I got charged because his girlfriend was the only one they questioned and she said I attacked him and he tried making me pay his hospital bills but I got out of it and only got disorderly.
My biggest problem is I value my friends and I would do anything to keep them safe. When trouble arises I have a big problem of sticking my nose in it. Could be a good thing could not be.

One thing about this is I can be certain I never actually hit him and someone else might have because his eye was cut from his brow all the way around his eye and he had blood everywhere. I did not have a drop of blood anywhere on me. Absolutely no-where. My hands arent bruised or hurt or anything.
So that proves that whatever damage was done to him was done after I was escorted out of the bar by the police.

Pleading not guilty and taking it to trial is the only way I would go about this. I just got through jury duty and the burden of proof is placed on the state to prove that you are guilty beyond a reasonable doubt. Which, at least from what I encountered, seems to help out the defendant more times that not. Good Luck.

Went to court today and got a later court date. Talked to my cousins ex who is going out with the guy that all this happened with. She knows I didn't hit him and so does he and she wants me to go to their lawyer and kind of fight this together.
Not sure whether that would be a good idea but it's worth looking into. Can't hurt my situation if we are on the same page.

No. Nobody actually hit him. A piece of glass from two girls fighting hit him. The guy who I am being accused of hitting wants me to go to the same lawyer as him and fight it together because we both got arrested.
It's complicated.

No it doesn't. It just proves you didn't hurt your hand in the act of hitting someone.
I am not saying you did.....all I am saying is it doesn't prove anything. You don't have to break a knuckle or bruise your hand to hurt someone else.

It doesn't matter anyways. The kid knows I didn't hit him and so does his girlfriend.
I tried which is still going to be the argument but I didn't cause any bodily harm.

Like you said somewhere earlier, you need to pull a lesson from all of this.
No matter what happens, and I am not going to join the speculation of what might and might not happen, the bottom line is you need to seek ways to avoid being in these situations in the first place.
My hope is you don't get 45 days in the workhouse as a lasting memory of why this isn't a good thing. Let's hope it is limited at maximum to a $500 fine and 80 hours of picking up trash.

First, I have all the respect in the world for police officers - I know 3 of them. Second, this cop is very dumb for putting you in a choke hold and leaving your arms free, that's asking to have your gun taken from you. If he put it as I have envisioned, no matter what you decide, I'd be sure to tell the captain what happened (without anger) because that's dangerous to the cop and the patrons of the bar.
If it went down like you said, I'd talk to a lawyer first and tell him the story and then heed his advice.

Believe me I've learned my lesson already.My hope is I don't get any jail time because I need my job and I have a son to take care of. If I don get jail time I will almost certainly lose my job. Unless I can get the time spread out and maybe do some weekend things or take up some vacation time.
