Biden isn't under impeachment. We're examining what TRUMP did as POTUS .... Which is NOTHING like what Biden did.

Two options.

1. Biden was carrying out USA foreign policy. It was in keeping with official policy. It was in keeping with the same policy as many EU partners ... This version has been corroborated by EU officials/partners.

2. Biden did this as VP and did it off the books and acting alone. He did it to protect his son. This theory had been debunked but we'll throw it out there.

IN EITHER SITUATION, 1 OR 2, IT IS NOTHING LIKE TRUMP POTUS BRIBING UKRAINE TO UNDERMINE A POLITICAL RIVAL. NOR DOES IT EXCUSE OR EXONERATE HIM.

Even if 50 of the Senators were Democrats, he would still beat this very easily. The House has no case.

they literally impeached him on "Well these people said he done this therefore he is guilty"

Jim Jordan tore their entire case to pieces in the Impeachment Inquiry hearings, even got most of the witnesses to admit the case was trash.

Even if 50 of the Senators were Democrats, he would still beat this because his legal team will tear this case apart, there are more holes in this case then the Titanic...thats why Pelosi won't hand over the articles, because she knows they don't have a convictable case...

1st it was "quid pro quo", then it was "bribery",then it was "extortion" and the articles ended up being Abuse of Power and Obstruction of Congress. Its called Pelosi and the Dems jumped the gun thinking they had charges of "Quid Pro Quo", "Bribery", and "Extortion", but once the testimoney came to light they realized they had none of that, so they had to vote on something to keep from looking foolish.

they will probably hold the articles until the election. Its the only card they have. Too bad for them the Dems will probably lose every single seat in both Houses they have up for Election except Joe Manchin who seems to be the only Democrat left with any damn sense. Manchin is a moderate Democrat, the old school Democrat that represents the rank file working man of the middle class of America. I wish my state had Joe Manchin...he is the only Democrat in Washington worth a damn to the average American.

Oh I am paying attention. I just know the articles are baseless.

I stand by my statement. He walks, easily, even if the Senate was a 50/50 split between parties, he still walks with at least 62 no guilty votes.

there isn't a prosecutor in the country that would even take a case like this in front of a Grand Jury, let alone actually try to take it to a trial.

Envoys pushed to oust Ukraine prosecutor before Biden

European and US officials pressed Ukraine to sack Viktor Shokin, the country’s former prosecutor-general, months before Joe Biden, the former US vice-president, personally intervened to force his removal, people involved in the talks said. Mr Biden did not act unilaterally nor did he instigate the push against Mr Shokin, despite suggestions to the contrary by supporters of US president Donald Trump, people familiar with the matter said.

The circumstances of Mr Shokin’s sacking, which took effect in March 2016, have become a flashpoint in the impeachment saga enveloping US president Donald Trump.

Democrats accuse Mr Trump of putting pressure on Volodymyr Zelensky, the Ukrainian president, to investigate Mr Biden and his son Hunter, who served as a board member of a prominent Ukrainian gas company for several years, to benefit the president’s own re-election campaign in 2020. Mr Trump and his allies, including Rudy Giuliani, his personal lawyer, have retorted that the request was entirely legitimate, arguing that Mr Biden had forced Mr Shokin’s removal by withholding a $1bn loan guarantee, to protect his son from an anti-graft investigation.

EU diplomats working on Ukraine at the time have, however, told the FT that they were looking for ways to persuade Kiev to remove Mr Shokin well before Mr Biden entered the picture. The push for Mr Shokin’s removal was part of an international effort to bolster Ukraine’s institutions following Russia’s annexation of Crimea and the armed conflict in the eastern part of the country.

“All of us were really pushing [former Ukrainian president Petro] Poroshenko that he needs to do something, because the prosecutor was not following any of the corruption issues. He was really bad news,” said an EU diplomat involved in the discussions. “It was Biden who finally came in [and triggered it]. Biden was the most vocal, as the US usually is. But we were all literally complaining about the prosecutor.”

Mr Shokin had been appointed prosecutor-general of Ukraine in February 2015, but the discussions in Washington and EU capitals about pushing for his removal started as early as April after he failed to follow through on a burst of expected early anti-corruption moves, one former US Treasury official said. Mr Biden entered the fray in December 2015, placing Mr Shokin’s removal at the top of his agenda on a visit to Kiev. “I know how the idea to have Shokin fired came up, and it wasn't Biden. His direct involvement came late in the game,” the former US Treasury official said.

Even once Mr Biden did take up the issue, former Obama administration officials said he did not mention his son’s business or the Ukrainian gas company, Burisma. “I had never heard of the company”, the former official said. “I didn’t even realise there was a nexus — it never came up.”

Another senior Obama administration official at the time added: “The idea that Shokin was investigating Burisma, I learnt that theory for the first time from Rudy Giuliani.”

In addition to the US and the EU, senior IMF officials, including Christine Lagarde, the former managing director, forcefully called on Ukraine to boost its reform efforts, including anti-corruption measures, in early 2016, before Mr Shokin was ousted. The fund’s focus was on institutions rather than individuals, IMF officials said.


Prominent Republican senators, including Rob Portman of Ohio and Ron Johnson of Wisconsin, were on a similar push at the time, calling for “urgent reforms to the prosecutor-general’s office and judiciary” in an early 2016 letter to Mr Poroshenko.

Ukrainian officials have said its anti-corruption authority had been investigating Burisma for the company’s actions between 2010 and 2012, which predated Hunter Biden’s arrival on the board in 2014.

They say he was never accused of any wrongdoing and the inquiry was dormant at the time Mr Shokin was removed in 2016. Hunter Biden earned $50,000 per month for his position as a Burisma director.

“Is there a problem in my view that while Biden was Mr Ukraine his son was anywhere near it and getting paid for it? Yes, that’s a problem,” the EU diplomat said. “But [they allege] that he tried to push out Shokin [because of that]. That’s a complete fabrication and has been debunked several times — but Giuliani keeps repeating it.”

A Poroshenko government adviser added: “Everyone was pushing for Shokin’s resignation, not just Biden. The difference was Biden came with an amount of money Ukraine found hard to ignore. If the Europeans had had that leverage, they would have used it.”


Yet Mr Trump has not shied away from the accusations. Mr Trump’s 2020 re-election campaign released an ad called “Biden corruption”, suggesting it could emerge as a big theme in the presidential contest should the former vice-president win the Democratic nomination.

“Joe Biden promised Ukraine $1bn if they fired the prosecutor investigating his son’s company,” the narrator in the ad said. “But when President Trump asked Ukraine to investigate corruption, the Democrats want to impeach him,” it went on.

The ad includes a video clip from an appearance by Mr Biden at an event at the Council on Foreign Relations, a think-tank, in which he boasted of how he handled the firing of Mr Shokin. “If the prosecutor’s not fired, you’re not getting the money,” Mr Biden said as he recalled the episode. “Well son of a bitch, he got fired.”

“Donald Trump’s presidency is in freefall after he tried to bully Ukraine into lying about the candidate he’s terrified of running against next year,” said Andrew Bates, a spokesperson for the Biden campaign. “Viktor Shokin was a major barrier to fighting corruption in Ukraine, which is why there was bipartisan agreement in the United States — bolstered by the EU, IMF, and Ukrainian reformers — that it was imperative he be removed from office.”

An apportionment may be reapportioned under this section.
(b)
(1) An appropriation subject to apportionment is apportioned by—
(A) months, calendar quarters, operating seasons, or other time periods;
(B) activities, functions, projects, or objects; or
(C) a combination of the ways referred to in clauses (A) and (B) of this paragraph.
(2) The official designated in section 1513 of this title to make apportionments shall apportion an appropriation under paragraph (1) of this subsection as the official considers appropriate. Except as specified by the official, an amount apportioned is available for obligation under the terms of the appropriation on a cumulative basis unless reapportioned.
(c)
(1) In apportioning or reapportioning an appropriation, a reserve may be established only—
(A) to provide for contingencies;
(B) to achieve savings made possible by or through changes in requirements or greater efficiency of operations; or
(C) as specifically provided by law.
(2) A reserve established under this subsection may be changed as necessary to carry out the scope and objectives of the appropriation concerned. When an official designated in section 1513 of this title to make apportionments decides that an amount reserved will not be required to carry out the objectives and scope of the appropriation concerned, the official shall recommend the rescission of the amount in the way provided in chapter 11 of this title for appropriation requests. Reserves established under this section shall be reported to Congress as provided in the Impoundment Control Act of 1974 (2 U.S.C. 681 et seq.).
(d) An apportionment or a reapportionment shall be reviewed at least 4 times a year by the official designated in section 1513 of this title to make apportionments.

US Code Title 31 Section 1513

(a) The official having administrative control of an appropriation available to the legislative branch, the judicial branch, the United States International Trade Commission, or the District of Columbia government that is required to be apportioned under section 1512 of this title shall apportion the appropriation in writing. An appropriation shall be apportioned not later than the later of the following:
(1) 30 days before the beginning of the fiscal year for which the appropriation is available; or
(2) 30 days after the date of enactment of the law by which the appropriation is made available.
(b)
(1) The President shall apportion in writing an appropriation available to an executive agency (except the Commission) that is required to be apportioned under section 1512 of this title. The head of each executive agency to which the appropriation is available shall submit to the President information required for the apportionment in the form and the way and at the time specified by the President. The information shall be submitted not later than the later of the following:
(A) 40 days before the beginning of the fiscal year for which the appropriation is available; or
(B) 15 days after the date of enactment of the law by which the appropriation is made available.
(2) The President shall notify the head of the executive agency of the action taken in apportioning the appropriation under paragraph (1) of this subsection not later than the later of the following:
(A) 20 days before the beginning of the fiscal year for which the appropriation is available; or

(c) By the first day of each fiscal year, the head of each executive department of the United States Government shall apportion among the major organizational units of the department the maximum amount to be expended by each unit during the fiscal year out of each contingent fund appropriated for the entire year for the department. Each amount may be changed during the fiscal year only by written direction of the head of the department. The direction shall state the reasons for the change.
(d) An appropriation apportioned under this subchapter may be divided and subdivided administratively within the limits of the apportionment.

As you can see by the law, the President IS designated as official appropriations executive under section 1513.

Furthermore, the law gives the President SIGNIFICANT leeway on when, how, and why he gives or witholds aid.

Trump asking about anything, including a political rival, is NOT a crime under US Code Title 31 and i quote:

"An appropriation for an indefinite period and authority to make obligations by contract before "appropriations shall be apportioned to achieve the most effective and economical use." "[b]An apportionment may be reapportioned under this section. [/b]

You read that? That means the President can ANY damn question he wants to ensure he is faithfully carrying out the duties of US Code 31 sections 1512 and 1513.

In this specific case it does NOT matter if Biden is running for President or not, its the duty of the President under these statues to ensure that countries we give aid to are going to "play ball with US" in order to ensure US interests are met before contracts and money is put out.

Furthermore, Under US Code Title 31 1512 & 1513 The President CAN withhold aid to anyone for any reason he wants, all that is required is he send a letter in writing to Congress recommend the aid be canceled, reappropriated, etc.

Lastly, the law has a built-in buffer date.

The start of the US Fiscal year is October 1st and ends September 30th.

Simply put, If The President feels, for any reason, that the country does not deserve the aid, he can recommend to Congress that the aid be delayed or revoked. Obviously the aid can’t be delivered if he’s still deciding. He is not required to provide an explanation, notify Congress, or “ask” anyone. The only other requirement he has is to notify Congress of his decision at least 20 days before October 1st. So the DEADLINE for the President to either deliver the aid or inform Congress is September 11th! And THAT is why it was delivered on that date.

It’s only “late” or “withheld” or “delayed” AFTER October 1st.

Simply put, the US Code Title 31 1512 and 1513 make this whole thing game, set, and match for Trump. Pelosi and them all know this, and this is why they are really withholding their impeachment articles. The House NEVEr had any intention of ever handing over or following through on the impeachment at all, this is being done soley as a political ploy, and they will keep this going until the election.

The law is FIRMLY on Trump side that he done nothing illegal. Title 31 allows him to ask any other natiosn leader anything he wants, even about someone running for political office in the US as part of his job as charged by Congress who passed the US Code to esnure foreign aid given to other nations fits the interests of the US. It is very much legally within the Presidents rights legally to ask about corruption involving as US Citizen.

I know this will burn some peoples behinds, I get it there is a faction of people who hate Trump more than anything, but he didn't do a damn thing illegal. Just because folks may not like it don't make it illegal, and even with a 50/50 party split in the Senate, Title 31 pretty much makes this a slam dunk in favor of the President.
