Lawyers for Trump after 2020 election face professional reckonings

Fallout for lawyers who assisted Donald Trump in his efforts to overturn the 2020 election is coming into focus this week, as one ex-lawyer for Trump will find if he may lose his law license and another attorney is in the middle of a disciplinary trial.

John Eastman, a conservative law professor, and Jeffrey Clark, the former Trump Justice Department official whom Trump nearly installed as attorney general, face major developments in their attorney discipline cases in the jurisdictions where they are barred.

The developments highlight how, even years after the 2020 election, authorities that regulate the attorneys are still looking closely at the actions of attorneys for Trump, several of whom could lose their law licenses.

In addition to Eastman and Clark, three other lawyers for Trump in 2020 — Sidney Powell, Kenneth Chesebro and Jenna Ellis —have pleaded guilty to criminal charges in Georgia that could risk their law licenses.

Another lawyer, Stefanie Lambert, recently spent the night in jail for failing to show up for a case against her in Michigan, while the prominent attorney Rudy Giuliani is in bankruptcy and suspended from practicing law.

And Lawrence Joseph, Julia Haller and Brandon Johnson, who worked in battleground states to support Trump and on frivolous court filings alleging election fraud after the last presidential election, are now facing attorney disciplinary charges in Washington, DC.

The State Bar of California is expected to issue a decision by Wednesday regarding Eastman, the architect of an effort to halt Congress’ certification of the 2020 results.

Meanwhile, Clark’s professional ethics trial began on Tuesday.

The trial is scheduled to last through the week and will focus on attempts by Clark to use the Justice Department in late 2020 and early 2021 to boost the former president’s election fraud claims.

So far in the trial, Clark’s attorney, Harry MacDougald, has highlighted how Clark was following the lead of Trump after the election. MacDougald also suggested in his opening statement that Clark believed he had reason to question election results, especially in Georgia.

But a Justice Department official who outranked Clark, then-Deputy Attorney General Richard Donoghue, testified for several hours on Tuesday about Clark being out of line.

Donoghue testified that the Justice Department checked out claims of election fraud and found no situation where federal authorities would need to pursue further investigation. Nonetheless, he recalled, Clark believed smart thermostats could have interfered with votes, and harbored other suspicions of foreign interference in the election.

Clark’s theories “were just not supported by evidence,” Donoghue said under oath on Tuesday. “I said, ‘Where are you getting this from? You haven’t been briefed on any investigation.’”

Later, Clark was given an intelligence briefing that Donoghue and others believed could help Clark understand there wasn’t widespread fraud in the election. But he was undeterred, Donoghue said, even talking to an election doubter in Georgia directly instead of authorities in the state and continuing to ignore what his superiors at the Justice Department told him.

“It was clear he was sort of conducting an investigation on his own,” Donoghue testified, under questioning from DC Bar’s Disciplinary Counsel Hamilton Fox. “Nothing … credible, or could be corroborated in any way.”

Donoghue also testified about Justice Department leadership learning that Clark met with Trump directly — an approach outside of how the White House and DOJ typically communicated — when Trump wanted the department to pursue unfounded theories of fraud.

“My first reaction was, and I said it out loud: ‘You violated the White House contacts policy,’” Donoghue testified. “I was taken aback … I said, ‘Do not violate it again.’”

Clark’s DC trial is occurring before a three-person disciplinary committee that will make findings and write a recommendation to a professional responsibility board governing professional discipline for those barred to practice law in the city.

The committee could recommend disbarment, which it has already done for Giuliani after a similar trial related to his 2020 election actions, that would need to be certified ultimately by DC’s court. (The three people on the committee reviewing Clark were not the three who reviewed Giuliani.)

Eastman’s situation is closer to the end of the line regarding his law license. He has already sat for a long trial in California regarding his professional conduct as a lawyer for Trump. A judge there preliminarily found him culpable for ethics violations.

A decision from Judge Yvette Roland, of the attorney discipline court in the state, is expected Wednesday.

Eastman will have the opportunity to appeal if Roland decides to disbar him or otherwise punish him. The California Supreme Court will ultimately decide whether to endorse or reject the punishment Roland hands down.

Separately, Eastman and Clark are both charged criminally in Georgia in the racketeering conspiracy indictment against Trump and more than a dozen others. They have pleaded not guilty.

RNC staffers and new hires asked whether they believe the 2020 election was stolen

Current and potential staffers at the Republican National Committee have been asked in recent job interviews whether they believe the 2020 election was stolen, according to two sources familiar with the questioning.

Over the past few weeks, Trump advisers have asked current and potential RNC employees about their views of fraud during the 2020 election, with the question serving as an apparent litmus test for hiring, the sources said.

Use of the question comes after the Trump campaign has effectively merged its operations with the RNC.

The Washington Post first reported the substance of the interview questions.

A key focus for the Trump campaign, and newly-elected leadership at the RNC, ahead of the 2024 election is election fraud. Much of that focus stems from former President Donald Trump’s dissatisfaction with how the RNC handled claims of election fraud around the 2020 election, multiple sources familiar with the matter said. There is no evidence of widespread election fraud in the last presidential contest.

“Candidates who worked on the front line in battleground states or are currently in states where fraud allegations have been prevalent were asked about their work experience. We want experienced staff with meaningful views on how elections are won and lost and real experience-based opinions about what happens in the trenches,” RNC spokeswoman Danielle Alvarez told CNN.

Trump advisers have also told potential new hires that they should plan to move to West Palm Beach, Florida, where Trump’s campaign is centered, the sources said.

The new hiring questions come as Trump continues to falsely claim, both publicly and privately, that the 2020 election was rife with fraud, and suggest that President Joe Biden stole the election from him — a rallying cry that has united many GOP voters around him.

Trump’s relationship with former RNC Chairwoman Ronna McDaniel largely fractured over the former president’s dissatisfaction with how she handled alleged claims of fraud.

Shortly after former South Carolina Gov. Nikki Haley exited the Republican primary, and effectively made Trump the GOP presidential nominee, two Trump allies glided to roles at the top of RNC leadership.

Trump’s endorsed candidates – North Carolina GOP chairman Michael Whatley and his daughter-in-law, Lara Trump – were swiftly elected to serve as the organization’s new chair and co-chair, respectively, at the RNC’s spring meeting in Houston, Texas.

Trump also installed two of his senior advisers, Chris LaCivita and James Blair, to serve in senior positions at the RNC. LaCivita took on the role of the committee’s chief operating officer, while Blair was selected to help drive the RNC’s political strategy, sources familiar with the plans told CNN. Both will continue in their roles as advisers to Trump’s 2024 campaign.

In a recent interview with NBC’s “Meet the Press,” McDaniel said Trump “absolutely wanted me to move aside and wanted Michael Whatley and Lara Trump to come in.”

McDaniel added that while she thinks there are still concerns with the security of elections in the United States, Biden won the 2020 election “fair and square.” (McDaniel, who made the comments after being announced as a paid NBC News political analyst, was ousted from the network on Tuesday after backlash from the network’s top television anchors to her role in subverting the 2020 election and attacks on the press.)

While chairwoman of the RNC, McDaniel refused to acknowledge that Biden won the 2020 election. She also was involved in a phone call in 2020 to pressure Michigan county officials not to certify the vote from the Detroit area, where Biden had a commanding lead.

Trump advisers have since described the current relationship between the campaign and the RNC as “a symbiotic” one, where they will operate largely as one and the same.

Unfounded conspiracy theories spread online after Baltimore bridge collapse

Major news events — like the pandemic, natural disasters and mass shootings — now consistently serve as fodder for fringe figures.

Outlandish conspiracy theories circulated on X after a containership collided with a major bridge in Maryland, causing it to collapse, early Tuesday morning.

The ship hit a supporting structure of the Francis Scott Key Bridge, which is located southeast of the Baltimore metropolitan area.

Maryland Gov. Wes Moore declared a state of emergency and said the calamity that knocked down the bridge was most likely the result of an accident and not an act of terrorism. Moore told reporters that crew members of the Dali containership, which struck the Key Bridge on Tuesday morning, had notified authorities that they lost power.

As rescuers search for survivors, some online conspiracy theorists have attempted to uncover a nonexistent plot to explain the collision.

Major news events — like the pandemic, natural disasters and mass shootings — now consistently serve as fodder for fringe figures, many of them on the far right, to amplify their world views that often feature shadowy cabals or major unseen threats.

Once relegated to certain corners of the internet, these figures have flourished on X since Elon Musk acquired the platform and removed many of the rules that once tried to limit the spread of false claims. Musk has garnered backlash in the past for amplifying conspiracy theories and restoring accounts for known conspiracy theorists like Alex Jones. A spokesperson for X did not immediately respond to a request for comment.

Some on Tuesday claimed that the shipping vessel came under “cyberattacks,” or that Covid-era lockdowns were to blame. There have been no reports suggesting that any of these conspiracies are remotely true. In response to some of the posts, X had a “readers added context” note/disclaimer, in which people fact-checked the posters.

But it’s not just so-called keyboard warriors who are posting the theories. Several conspiracies were elevated by public officials on TV and by those with massive followings on social media.

On Fox Business, anchor Maria Bartiromo falsely suggested the “wide-open border” could have something to do with the collision, a clip of which circulated on X. No link to immigration has been made by officials.

A spokesperson for Fox did not immediately respond to a request for comment.

Controversial influencer Andrew Tate shared a conspiracy that falsely suggested the ship had been “cyber-attacked,” citing that in the video of the collision, the ship’s lights appear to turn off just before impact.

In video leading up to and of the incident, around 1:24 a.m. EDT, the ship’s lights turn off for a minute but then flicker back on. About 10 seconds later, smoke is seen coming from the ship’s chimney. At 1:26 a.m., the ship appears to turn and moments later loses its lights again. They come back on a half a minute later.

A spokesperson for Tate did not immediately respond to a request for comment.

This dem ran against R David Cole in 2022 and lost by 7%. The Dem Lands ran against Republican Teddy Powell on Tuesday night and won 62.4% to 37.6%-In Alabama; That is unheard of. Oh yea, the reason there was an open seat; The republican who beat the dem Marilyn Lands in 2022 had to vacate his seat after he pled guilty for voter fraud.

Democrat Marilyn Lands won a contentious special election for a state house seat in deep-red Alabama on Tuesday night, in a race that could signal the dominant role of abortion and in-vitro fertilization in elections across the country in 2024.

Lands, a licensed professional counselor, beat Republican Teddy Powell, a Madison City Council member, in the race for an open seat in Alabama’s state house that was left vacant after former Republican Rep. David Cole pleaded guilty to voter fraud. Lands ran against Cole in 2022 for the 10th District seat, which represents an area around Huntsville, but lost by seven points.

While her win won’t change the makeup of the heavily Republican Alabama legislature, it does showcase the enormous impact reproductive issues, such as abortion and in-vitro fertilization, could have down the ballot in 2024.


The election was one of the first tests of how Alabama voters felt about the state court’s February ruling, which threatened access to IVF when it found that frozen embryos were legally considered children. The state’s legislature also weighed in on the issue in early March with legislation attempting to protect IVF providers and patients from prosecution.

Alabama is also one of several states where a strict abortion ban went into effect after the Supreme Court overturned Roe v. Wade in 2022. The Democratic Legislative Campaign Committee, an organization that works to elect Democrats to statehouses, defined the 10th District race as a test of the influence IVF and abortion could have on swing voters across the country in 2024.

Lands focused her campaign heavily on protecting abortion and IVF access.

In a TV ad, Lands shared her experience getting an abortion for a “nonviable” pregnancy years ago with an Alabama woman who faced a similar situation but who had to travel out of state to receive the procedure because of the state’s abortion ban after the Dobbs v. Jackson Women’s Health Organization decision.


She argued that a law passed in response to the state Supreme Court’s IVF ruling, which aimed to protect IVF providers and patients from prosecution, fell short and did not address the root concerns with the court’s decision.

The approach ultimately proved successful against Powell, who mainly campaigned on infrastructure and the economy.


While Powell expressed support for IVF access, he argued that it was different from abortion. He also criticized Lands for defining the 10th District race around reproductive issues.

“I’m not sure any race can or should be about a single issue,” he told USA TODAY. “Our district has many challenges that we’re facing that aren’t related at all to this specific issue.”


The race could be a microcosm for broader 2024 election trends.

Republican candidates across the country, including presumptive GOP presidential nominee Donald Trump, are campaigning on issues such as immigration and the economy. They believe inflation and national security are among the most salient issues for voters this year.

Democrats, meanwhile, see abortion as a key motivating issue for voters, based on a string of ballot measure successes since the 2022 midterms.

But the Alabama race is among the first data points this year on which issues are most impactful. The results nod in favor of Democrats.

Man sentenced to 11 months in prison for voicemail threats to Nancy Pelosi, Alejandro Mayorkas: DOJ

David Carrier had pleaded guilty to making threats against public officials.

A California man was sentenced to 11 months in prison for making threatening calls to former House Speaker Nancy Pelosi and Homeland Security Secretary Alejandro Mayorkas, the Justice Department announced Wednesday.

David Carrier, 44, of Concord, had pleaded guilty to two counts of making threats against public officials in December 2023.

Federal prosecutors had only sought a sentence of four years of probation for Carrier, noting he quickly accepted guilt and acknowledged his "lapse of judgment" in making the threats, according to a sentencing memorandum filed last week.

The judge overseeing his case ultimately disagreed. In addition to the 11-month prison sentence, Judge William Alsup ordered Carrier to three years of probation as well as requiring him to seek mental and substance abuse treatment upon his release during a sentencing hearing on Tuesday, prosecutors said.

Carrier left a voicemail with Pelosi's San Francisco office on Jan. 21, 2021, the day after President Joe Biden's inauguration, according to federal prosecutors.

"You better resign, you piece of f------ s---," Carrier said in his voicemail to Pelosi's office, according to the sentencing memorandum. "Cause we got a bullet and a rope with your f------ name on it. We're gonna f------ get you b----."

An intern who initially heard the message perceived it as a threat and forwarded it to her bosses, who subsequently forwarded the voicemail to law enforcement for investigation, according to prosecutors.

More than a year later, he made threatening calls to Mayorkas, prosecutors said. According to the sentencing memorandum, on June 30, 2022, he told an operator with the Department of Homeland Security's Office of Inspector General to relay the following message: "If [Mayorkas] does not close the border someone is going to be shot. And it will be illegal immigrants."

Later that day, he left a voicemail with the DHS general hotline stating, according to the sentencing memorandum, "Tell that f--- Mayorkas to close the border before we citizens start killing those f------ illegal immigrants or we come looking for him and feed him to the dogs."

The voicemail message was perceived as a threat and forwarded to law enforcement for investigation, prosecutors said.

"Participating in the public political conversation is an important right for all citizens. Nevertheless, threatening our public servants is not protected by the First Amendment and corrodes our ability to engage in peaceful and important public discourse," U.S. Attorney Ismail Ramsey, whose office prosecuted the case, said in a statement. "This Office will not tolerate behavior that crosses the line to criminal threats."

ABC News has reached out to Carrier's attorney for comment on the sentencing.

What causes people to be that damned dumb as to make threats to officials? It's not going to stop them from doing their jobs. It's not going to make either of them resign. The feds will increase protective services for them and then the perps will get caught. tried and if convicted, will go to jail.

A Republican candidate for Congress in Washington state has suggested the CIA and Ukraine may be responsible for a terrorist attack last week that killed 143 people in Moscow, echoing a theory pushed, without evidence, by Kremlin propagandists.

Joe Kent, a conservative firebrand in a likely rematch with first-term Democrat Marie Gluesenkamp Perez, whom he narrowly lost to in 2022, made the comments in a Tuesday appearance on “Real America” on the right-wing One America News Network.

Kent, a retired Special Operations veteran and former foreign policy adviser in the Donald Trump administration, suggested the attack, which Islamic militants claimed responsibility for, could in fact have been orchestrated by Western interests and added that it was unlikely the truth would ever be known. He said Islamic militants had grievances with Russia that would lead them to attack, but he also said it was plausible the attack was a Western plot.

“If the Ukrainians were using CIA or [British intelligence agency] MI6 money, which they have a lot of access to, and they were tasked with conducting sabotage behind Russian lines, I mean, this is too easy. You can get access to these jihadis because they’re looking to work for the highest bidder, so it does kind of make sense,” Kent said.

Kent made a similar statement on “The Nunn Report” podcast the next day.

“If you’re looking for surrogates and you’re looking for someone who can do dirty work for you, if I’m a Ukrainian intel guy, I’m going to be, ‘Hey, these Muslims that have already an ax already to grind with Putin and with Russians, they might be a good pool for us to recruit from.’ So it’s not too much of a leap to think that,” he said on the right-wing podcast.

The Kent campaign did not immediately respond to multiple requests for comment.

A branch of ISIS, an Islamic militant group, claimed responsibility for the attack at a Moscow concert hall in which attendees were shot and the building was set on fire. The group issued its claim quickly after the attack and provided video to support the claim.

The attack appeared to catch Russian security services by surprise and shocked Russians. President Vladimir Putin, fresh off a reelection widely seen as illegitimate, pointed the finger at Ukraine, even as he said the attack was committed by “radical Islamists.”

“This atrocity may be just a link in a whole series of attempts by those who have been at war with our country since 2014 by the hands of the neo-Nazi Kyiv regime,” he said in televised remarks. Ukraine’s president, Volodymyr Zelenskyy, is Jewish and not a Nazi. Russia has, however, used claims that the Ukrainian government and society are rife with Nazis as a justification for its February 2022 invasion and ongoing war.

Sergey Karnaukhov, a Russian TV host, said, “Ukraine is a proxy force of American and British military and intelligence services. Does anyone have any doubt as to who did this?” Compliant Russian TV hosts and talk shows have long been seen as one way Putin shapes the public discourse in Russia.

The White House said the U.S. warned Russia earlier in March about the possibility of a terrorist attack and said there was no evidence Ukraine had any involvement.

“This was a terrorist attack that was conducted by ISIS. Mr. Putin understands that. He knows that very well,” White House press secretary Karine Jean-Pierre said on Monday.

White House national security spokesperson John Kirby was even more blunt on Thursday.

“My uncle used to say that the best manure salesmen often carry their samples in their mouths. Russian officials seem to be pretty good manure salesmen,” he said.

Gluesenkamp Perez said Kent’s comments showed why he should not be elected in Washington’s 3rd Congressional District.

“It’s shocking to me how willingly Joe Kent swallows and repeats the propaganda narratives pushed out by the Kremlin. Joe Kent would be Putin’s go-to guy in Congress, one of the many reasons why electing Joe Kent would be dangerous for the entire country,” she said in a statement to HuffPost.

In his appearance on the Nunn show, Kent also advocated for halting Ukraine aid, which has been stalled in the House due to GOP opposition, to force the country to the bargaining table and freeze the conflict, a prospect Ukraine says would only give Russia time to prepare for a bigger attack.

Kent also said he thought the U.S. should promise Russia that Ukraine would never be allowed into NATO, to entice Russia to stand down, and the U.S. should avoid getting dragged into helping redraw the borders between the two in any land-for-peace negotiation, if one happens.

“That is a conflict between Slavic cousins, and the Slavic cousins need to work out where those lines go,” he said.

A Republican state representative in Michigan, Rep. Matt Maddock, claimed on social media on Wednesday night that he had photo evidence of “illegal invaders” arriving at Detroit Metro Airport.

One of the two photos Maddock posted on the platform called X, formerly known as Twitter, showed an Allegiant Air plane. The other photo showed three buses. Maddock wrote: “Happening right now. Three busses just loaded up with illegal invaders at Detroit Metro. Anyone have any idea where they’re headed with their police escort?”

Facts First: Maddock’s claim is false. The buses were not for “illegal invaders”; they were for the men’s college basketball teams that landed at the Detroit airport to compete in the NCAA tournament known as March Madness. The only Allegiant Air flight to the airport on Wednesday was a charter flight that carried the team from Gonzaga University, which plays Purdue University on Friday.

“The four men’s basketball teams competing in the NCAA Tournament’s Sweet 16 at Little Caesars Arena arrived at DTW Wednesday evening. The buses seen in a photograph circulating online were transporting the basketball teams and their respective staffs,” the Wayne County Airport Authority, which operates the Detroit Metro Airport, said in an email to CNN on Thursday.

It’s not certain which team took the particular buses shown in Maddock’s photo. But Barrett Henderson, Gonzaga University’s assistant athletic director for communications, confirmed to CNN on Thursday that the team flew on an Allegiant plane, landed at Detroit Metro airport on Wednesday evening in the hour before Maddock’s post, and boarded buses that were waiting at the airport.

An Allegiant spokesperson said Thursday that a charter flight carrying the Gonzaga team from Spokane, Washington, was the only Allegiant flight to the Detroit airport on Wednesday. That is corroborated by an online flight-tracking website.

As for Maddock’s claim about “illegal invaders” getting a police escort? Henderson confirmed that the bus carrying Gonzaga’s players received a police escort to their hotel. Rob Anderson, sports information director at Creighton University, told CNN that their team landed at the airport on Wednesday afternoon, had buses waiting and received a police escort as well.

“I was on one of those buses,” Anderson said.

Maddock triples down

Maddock made his false claim in a month during which false and misleading claims about airplane flights involving migrants have proliferated on the political right.

Hundreds of social media users quickly disputed Maddock’s post on Wednesday, but Maddock refused to concede. He replied to one of the many people who pointed out the plane and buses were likely for NCAA basketball teams: “Sure kommie. Good talking point.”

Maddock continued to dig in on Thursday morning. He wrote a new post saying, “We know this is happening” and that hundreds of thousands of illegal immigrants are “pouring into our country.” He added: “Since we can’t trust the #FakeNews to investigate, citizens will. The process of investigating these issues takes time.”

CNN has asked Maddock for comment.
