I'm curious if they did a sobriety test. You would at least think they would've done that. I don't remember hearing about one.

They only do those if suspected.

The blood draw is standard procedure in a serious accident..

So, basically, they had no reason to suspect he was intoxicated.

This is just sad. Regardless, 2 lives completely altered, one gone, the other could be facing jail time, but has to live with it. Last night was probably a long night for Donte, I'm sure that moment has played in his head over and over.

Not sure if he is guilty or not, but perhaps this might be the moment that makes him realize just how damn fortune he is to be playing in the NFL.

I don't know if others had noticed but everytime I saw him on the sidelines he was F#*kin around, regardless of how bad we were getting beat.

If any good can come out of this maybe we will have a more dedicated football player.

It can be that long....they won't be testing for just one substance.




If it takes three weeks that is because the first test he failed. If he passes the test that is a done deal, that takes about 2 or three days. If that test comees back dirty it has to be sent out to a certified testing facility where it gets the full work up and that can take three weeks.

There is a big difference in a standard drug/alcohol test and a certified drug/alcohol test, also a big difference in price. Any testing that has legal ramifications must be a certified test.

I know this because as a union delegate I got sent to a seminar all about dryg testing.

All kidding aside, I sincerely hope that Stallworth wasn't impaired in any way when this happened. It would be hard enough to live with knowing that you'd done every thing you could to try and avoid the accident while sober ..... but if someone died bacause you were drunk ..... man that would be damn near impossible to live with.

As another aside .... I find it amazing how fans will assess someone's guilt or innocence in a situation like this based on how they perceive the players value to the team. If Stallworth killed soemone because he was too drunk to be driving, then I hope he faces the maximum penalty. If this was an unavoidable accident .... then I hope he is able to deal with it mentally and spiritually, and his career takes whatever path it takes based on his abilities and productivity. I would wish the same for any of our players or coaches .... no matter how much I might like or dislike them. Players are just people ..... except that players have to deal with the good and bad in a very public arena.

They did do a sobriety test. The ignorant news station in Miami posted a video of part of it, as well as the paramedics attempting to revive the guy. I don't agree with them posting a video of a dead man lying the street being revived. But of course, some of these places do whatever it takes to gain viewers.

I wonder what would happen if Stallworth tested positive for Marijuana. Cuz Marijuana is one one those substances that you can test positive for weeks after a single use.

Wouldn't it be ridiculous if he had smoked a joint three weeks ago and it caused him to test positive and then be faced with the looming manslaughter charge.

If that transpires it would be ridiculous. And to go a little further---I think that unless he was ridicuously, passing out drunk/high he doesn't deserve any of these "charges" that currently are poised to throttle his livelihood real soon.

You have to test over a certain level that is measured in PPM. If your PPMs of THC is still that high then you still have enough in your system to be under the influence of that drug. It is not a all or nothing test like a drug test for a PO or something like that. The only thing about marijuana is if you are a regualr user the THC builds up in your cells,especially in your fat cells,

Um...that's not really how it works. They can detect marijauna weeks after a single use, but they can also detect how much marijuana is in your system. They aren't going to charge you for driving under the influence of marijuana if you simply have a detectable level of marijuana. They are only going to charge you if you have enough marijuana to cause impairment.

I guess i would disagree with you on that, he killed someone and if he has anything they are going to throw the book at him....stuff afftects everyone differently so saying you had more in your system than me doesnt mean that i wouldnt be more messed up than you.

OK....I suppose if you have nothing in your bloodstream it could take 3 days.

Considering most people have something in the bloodstream in the way of some medication at minimum, it has to go through a full testing to find out exactly what is in there.

The local news did this to my family,...had it on air before I could even get home to console my parents.

In addition, the driver who killed my brother ran over him from behind, was never tested and never charged.

This ticks me off if its true. This is the way people drive in the DC area and it ticked me off to no end. Traffic is bad in DC and sometimes you have to pull into traffic (whether you're driving or trying to cross on foot) with less than an ideal amount of space before the next car and so many drivers, rather than see you and simply slow down to let you in or let you cross, will go immediately to the horn, never slow down and try to whip around you. It's just another indicator of our "me first" society that doesn't just affect pampered athletes, it affects everybody because what they are doing is so damn important they don't have time to slow down to avoid an accident. I swear court cases involving traffic accidents in the DC area must be hilarious, I'll bet that most of the people that are in there actually believe if they hit their horn first, that means they win...

If, and I state IF IF IF, he saw this guy and had time to go to the horn and flash his lights, then he had time to slow down or stop.

The repost I just hear on TV(I will try to find it online) stated that it was reported by a witness at the scene that Stallworth pulled around a stopping car that was in front of him in order to beat a red light and that charges for DUI,reckless Op,and Vehicular Manslaughter are being wokred up.

Agin, that is not how it works. Legally you have to have over a certain amount in your system. If your test does not show over the certain amount that is allowable in your system then the lab sends it back as a passed test. They do not inform the police(or employer) that their was marijuana in the system ,BUT you were under the legal level. Marijuana is different in the bloodstream than alcohol because of the fact that THC settles in your cells. Like Lyko said you can detect THC in someone system a month after use, but not enough that they would be under the influence of it.

The point of the test is no to determine if the person has even smoked marijuana, it to determine if they were under the influence of marijuana when the accident occured.

It was a intersection, if the reports are true then the light turned red and he started to cross. Donte swerved around the car in from of him to run the red light and ran the guy over(aleegedly).

I know that, but he hit the guy in the innermost lane. The guy would have to be a world class sprinter to make it from the curb across three lanes of traffic in probably the second or so between the light turning red and it getting run, if he even did actually run the light. Since he allegedly swerved around a car that would mean that his car was initially in the middle lane and swerved into the left lane.

The only thing I can really think of is the guy was on the island that divides the six lanes when the light turned yellow and was about to go red he saw the guy stopping so he stepped off the curb abd started to cross and then Donte swerved around the guy in front of him and nailed the guy crossing the street. Again, purely speculation.

To add top what adam said. There is normally a delay between a light turning red and a walk signal. Stallworth Would have to be blatantly running a red light, not running a light that was in the process of changing for the guy to be legally in the intersection.

To me there are still alot of missing facts in this case.

I think there is a good chance the guy made a assumption and stepped out into the street.

I dont know exactly what happened but I do know it is illegal to gun your engine to get through a yellow light.

Yeah, its certainly hard to do much more than speculate. I swear one of the initial stories I read said that the guy had gotten off work and had gone to eat breakfast with some co-workers, but the stories I'm reading now say that he had clocked out just minutes before the accident, and worked only a short distance away. It also said that he worked for a shipping company, and the only docks that are that close to the accident site are to the south of the site. The accident occurred in the eastbound lane, which is the more south of the two lanes. I'd have to guess then that he was trying to get to the bus stop on the westbound lane, meaning he'd have to cross all six lanes of traffic. The bus stop, like the articles say, is close to but not right next to the crosswalk...probably 100 feet or so east of the crosswalk, across from what appears to be parking lots for the docks to the south.

Let me put it this way.

I live a few miles from Fisher Island and unless you have been here you really have no idea the mentality of the drivers around the area. Where the guy got hit is like the Autobahn.(sp).

Traffic lights and stop signs are inconveniences for people here and red lights are run constantly. On the other side of that, people rarely wait for walk signals and cross the road at ANY spot they choose. And intersections with walk signal white? Forget it. You have to constantly look both ways as drivers feel that if they have to slow down to yield to pedestrians, they may miss their 2o'clock Starbuck's coffee.

This combination makes for the usual local story of pedestrians killed and your monthly hit-and-run homicide. Also, drag racing on the streets here is a constant.

I used to live in Ohio and yes, nearly everyone drives as the law allows. Here, it's a crap shoot when you walk in the streets.

Its a shame for the dead guy and his family .... and its a shame for Donte regardless ... it is going to affect him in a remarkably negative way ... it just depends on weather it entails the justice system or not ....

the thing that bugs me about this .. why no skid marks???? .... my initial reaction would be to honk and HIT THE BREAKS .. i would not honk and hit my brights .... sumptin is missing here ...

what am i missing in the breaks/skid marks area that everyone else obviously gets??? .

I don't think you are missing anything, but I think the correct sequence would be brakes, horn, then lights (IF the lights at all, at 7 am it's already been sunrise for a half hour at this time of year according to the US Naval chart I just looked at, granted sunrise CAN be a hazy time and tricky to see)

The important thing is to stop forward progress first, then worry about the rest, wouldn't you agree?

I think there is a great deal of speculating for us not really knowing anything. Who knows what happened. We've all seen people cross the street without looking while talking on the cell and we've also seen people run a red in reckless abandon of any pedestrians.

Who knows?

I'm eager to hear the details of the tests and more of what really happened.

We really don't know anything with what is currently available.

The lack of skidmarks doesn't mean much. I mean, my 1994 Bonneville has ABS. Just about any car bought today has ABS, I'm sure the Bentley had ABS.

Aside from the outcome of the blood tests (an unknown at this point in time), the only thing that doesn't make sense to me is the honking and flashing of the lights. IF he had time to honk and flashlights, he had time to stop. I say IF, because we don't even know if that is true at this point, do we?

7:00 am the sun is just starting to rise, and if he was heading toward the beach, that means he was driving east and directly into the sun. I know driving to work in the morning around that time, the sun is blinding, I've at times had to put the visor down and lean toward it, leaving me a very narrow field of vision out the windshield.
