Drunk Man Drives to Police Station, Demands Breathalyzer Test

Belinda Prinz Fox 8 Reporter

April 10, 2009
COPLEY TOWNSHIP, Ohio - Police gave a man a break, but the man landed himself in hot water when he demanded a breathalyzer test.

Copley Police were called to the Steak N Shake Restaurant Friday night to investigate a complaint of an intoxicated, disorderly man annoying customers.

Police Chief Michael Mier says the officers confronted Erik Salmons, 39, of Copley Township. They convinced him to take a cab home and not arrest him for creating a disturbance, but Salmons was apparently unhappy with leaving his truck in the parking lot all night.

An hour later, surveillance shows Salmons driving his daughter's car into the Copley Township police station.

"He demanded a breathalyzer test," Mier said.

Officers obliged.

"Based upon the officer's observation at the Steak N Shake, as well as when he arrived at the station an hour later, it appeared he was too intoxicated to drive," Mier added.

Salmons blew a .123 in the breathalyzer -- nearly double the .08 legal intoxication limit. He was charged with OVI, operating a vehicle under the influence.

Salmons appeared in Barberton Municipal Court Wednesday. He pleaded guilty to OVI. A judge revoked his driver's license for 6 months, ordered him to pay a $375 fine and gave him a 180-day jail sentence. All but three days of the jail time was suspended, however.

Salmons was also ordered to spend the remaining three days in an alcohol-treatment program.

At least he owned up to his own stupidity and pleaded guilty.

This guy is an idiot. Both for driving while intoxicated and for demanding the breathalyzer. But, then again, so is the journalist that thinks .123 is "nearly double" .08.

.12 is 50% more than .08, not 100% more. Jeesh.

I believe the "wtf is this guy smokin" was referring to the journalist who thinks .123 is nearly double .08, and not to the actual idiot who is the subject of the article.

so the cops make him take a cab home, then from his home he drives to the police station and order them to give him a breathalizer?

Ok he was drunk and stupid, but even in a drunken stuper, what was he trying to gain/prove by driving to the police station? If he just wanted his truck, why not drive back and get it, leave the other car there?
